      The car has broken down many times & many days. I've had to drive a rental car which is a serious health issue because I suffer from skin cancer. I am on file with State of Florida so I'm allowed to have special window tint on my car but the rental cars don't have tint. I've recently had a surgery on my right arm for skin cancer and its mainly because of driving without tiny my doctor said. The car engine died and blew up on the road while I was on a road trip a few hours away and I had to get someone to tow me and my partner at the time at my own expense. The motor should not have gone bad with only ****** miles on it and this was a safety issue in of itself. The motor acted up again on 8/1/2024 and made the same indication and noise and not working (trying to dry crank and not turn over and make same noise as it did last time if blew up on 2/12/2024) and I told the service director this happened on 8/1/2024 so I am also now concerned the engine will go bad again. What's worse is that the suspension and service leveling system has now broken 4 times and it has not been able to be fixed. This is a safety issue because I had to drive the car with NO RENTAL being supplied to me for a long time and the vehicle would not perform and kept bottoming out on the road because the suspension was not working properly. I was told the parts, and the dealer was backed up so it could not go into service but now it has gone in 4 times, and it is still broken. At this point, I want my vehicle to be replaced with the same exact vehicle but NEW and not a LEMON and I don't want to be priced gouged and taken advantage of for $40,000 premium on the sticker price. I bought the car from DeVoe Cadillac on 4/18/2022 and the sticker was $114,140 but with the $40,000 price ***** it was $154,140 and a total sticker price of $164,836.08. I feel I have been totally taken advantage of with the price gouging and a LEMON. Call me ************ or *************************** Sincerely, *********************

      The business did call me and I did tell them that Im talking to GM however GM has not settled with me or given me anything, so my claim is still 100% valid and in effect and I still have a case and a claim against this business. The problem I have with Devoe Cadillac is that they sold me a brand new car that I never saw, and I wired to purchase price to them in full, and when they delivered the car to me, it was not in perfect condition. It had some issues which I was told would be covered by the warranty , but even though I went to the dealership here locally that I was told I could do the front fender the back trunk. A lot of those pieces were never fixed and they're warped. I never knew the car was like this because I never had the chance to see it in person, I driver drove it to me from the West Coast of ******* to where I live, which is the East Coast of *******.  The front bumper is not in perfect condition when I bought it the rear of the vehicle which is the hood that opens up was also warped and parts of the sides of the car as well. I complain to a dealership in ***************. They didn't do anything for me and I complain to another dealership that I'm currently at now which is where the car has been taken to and they tried to call in and replace some of these pieces . I was told this comes from but I find hard to believe that I would pay $164,000 for a vehicle for not to look perfect. Furthermore, This business price ***** me very hard. They charge me over $40,000 over the sticker price for the vehicle and in the state of *******, I know there are certain laws where you can only charge a certain amount of money or certain percentage. Im not sure with cars but they gouged me $40,000 on this car in this car turned out to be a bad car and a lemon this cost me a lot of things, including my health and more skin cancer  Because it keeps breaking down since I bought it and have to drive rental cars that have no special tent and the car. I like to state my case to you because I do want to file something against the dealership potentially because of what they did in regards to price gouging me. With this being said, I still have a claim in a case that I can file against this dealership and their license because I don't believe they acted properly. Every dealership has a license and I believe they want to protect that license so I find it very rude and sad that they told me my case is closed because I'm dealing with GM because that's not the fact I still have a case against them and I'm interested in seeing what they want to satisfy me because at the end of the day if I'm not happy then I will be forced to potentially file something against their dealership and their license. I think it was very rude for them to say that my case is closed because I'm talking to GM as if they believe it's OK to sell me a car and overcharge me an extreme amount of money when in fact the car was never a perfect car that I should've been delivered. You can check the records. The engine blew up. The car had plenty of problems. It's considered a lemon and it's been a major headache. Even the car when it was delivered to me, the roof had glue all over it from when they glued it or how they put it together. I believe this should be documented in *************** at *******. I believe it's where I took it and a lot of other problems I'm talking about are probably in their files as well At ************************************************************** in ***************, which I would have to call them and pull those work orders as well. The only orders I filed were the ones with **** Cadillac.

      **************** is going through the correct channels to address the issues he is having with his Escalade.  In *******, the manufacture has to be the one to handle any lemon law complaints.  We do not have any other avenue to assist **************** with his desired outcome of replacing his vehicle.  That must go through GM and he is doing that per his own admission on this complaint and through our conversation.

      As we explained to ****************, the amount he paid of MSRP is not price gouging.  We deny that part of his claim and again consider his complaint handled as best we can as he is going through the correct and legal channels to address the service concerns of his vehicle.

      I am rejecting this response because:

      They are avoiding the facts that it is NOT just with GM its with them as well because they drove the car to me and I never saw the car in person when I bought it and they represented it was a perfect car in mint condition, brand new and that was not the case as I have proof and evidence in my car repair and work orders from when I bough it from them. If you look at the last documents, I uploaded I immediately started taking it to the dealership here locally to try to fix the dints, dings, and the imperfections of the car that they sold me new.

       

      If they are not willing to do anything with this case so be it and if they are not willing to reimburse me at least the $40,000 over sticker they gouged me on when the car was not in mint condition then that may end up being a big problem for them so you can send them this email.

      **************** agreed to a price based on Market Value, which is not price gauging.

      **************** needs to work with ************** if he feels his vehicle is a lemon, which he stated to us he is working with **************.  We do not service his vehicle and the sale of his vehicle is our only transaction with him.

      We have nothing further to add.

      On June 9th 2023 I was giving an estimate to check my windshield wipers , and I was giving the cost will be $849.15 but since they did not have the necessary parts in stock I was ask to pay for the part in advance and I agreed to pay $592.35 and after I left Devoie Cadillac and before I made it home it started to rain and I turn my windshield wiper on and it worked, so I call Devoie Cadillac and told them to cancel my order and they agreed to refund the money paid , instead they refunded part of it, I do have in my possession all the documents , so would you please let me know if you can help me resolve this problem, and if you need any additional information please let me know and your anticipated cooperation will be very much appreciated and thank you in advance

      ************ has a **** Cadillac that required a special ordered part, specifically a module for his windshield wipers.  He agreed to the repair, we ordered the part and had it shipped overnight.  The price for the part was $372.60.  ************ called back and decided not to do the repair so we refunded him $344.66 on 6/13, which is the price of the part, plus tax less the restocking fee that ************** charges on special ordered parts. The $175.00 he was not refunded was our diagnostic fee to discover what repair/parts needed to be done to restore his **** *******'s windshield wipers back to working order.

      I am rejecting this response because: When I was told that my car need new parts for the windshield wipers but they did not have the parts in stock so I was asked to pay for the parts in order to have shipped and As soon as I left Devoie Cadilac It started to rain so I turn on the windshield wipers and it started to work. so Immediately I call Devoie and mentioned that the windshield wipers is working and to cancel my order and I was promised that I will receive the refund for the money that I pay, instead they only refunded a part and they are trying to charging me for a miss Diagnosis for a repair that was unnecessary .
