      On April 2023, We were offered $1200 credit to cover Acid Wash to repair and refill the pool from damages caused by Tornado Roofing Company (TRC) during roof replacement. An acid wash will shorten the lifespan of the marcite and cause patching. Additionally, stress fractures will form on the marcite when the pool is refilled after an acid wash. On December 2022, TRC (Tornado Roofing Company) neglected to keep the pool covered as promised resulting in permanent damage to the pool and its floor. The only manner to remedy the pools condition is to resurface the pool. This was determined through consultation with pool experts who witnessed the pools current condition. We have provided 2 estimates of approximately $5500.00 and $5800.00 from reputable companies along with our paid invoice for the newly marcite pool.

      Tornado Roofing & Contracting, Inc.entered into a written agreement with the owner (complainant) for a re-roofing job. Exhibit "A" is the contract. The base contract price was $47,000.00 plus unit pricing for the replacement of wood. The total value of all work performed, base ************* unit cost items, was $50,168.75. A copy of the final invoice is enclosed as Exhibit "B." All required permits were pulled and the work passed all final inspections. See Exhibit "0." The owner has paid a total of $34,908.13 to date. A detailed breakdown of payments received are contained on **************** terms and conditions of the contract specific require the owner to protect his property during the performance of the work, and in particular, the expressly states that the owner assumes the risk of damage to pools. Notwithstanding, Tornado Roofing most recently offered an additional discount of $1,200 towards the alleged damage to the pool coating. The owner/complainant rejected that offer. Regardless,the owner/complainant is withholding over $14,000 from Tornado Roofing when the alleged damages are less than $6,000.00.

      I am rejecting this response because:

      Owner acknowledges there is a balance due however as verbally stated numerous occasions, owner wanted for the roofing company to leave the pool in its prior condition prior to completing payment in which ***************** agreed to. The pool was in perfect condition, it was a newly installed diamond brite months prior to the Roofing companys neglect.
      The roof company covered the pool on day 1 however the pool cover was removed on day 2 while the rip off and install process continued thus exposing metal along with other old roof debris into and onto the pools floor.By doing so, metal rusts stains formed onto the newly installed pools finish,causing permanent damage.
      Roofing company acknowledges their neglect  and tried to fix the damage by seeking inferior solutions on two separate occasions. By addressing the pools condition months afterwards and attempting to seek remedial solutions to the pool, the pools sustained permanent damages caused by the roofing company.

      The roofer proposed credit of $1200 for acid wash and refill the pool is not acceptable. This is another inferior method of attempting to fix the pool. As previously indicated, An acid wash will shorten the lifespan of the marcite and cause patching. Additionally,  stress fractures will form on the marcite when the pool is refilled after an acid wash. The pool's current condition was evaluated by two different pool experts and their proposed solution by submitting their estimates to adequately address the pool's condition.  

      Attached are the two pool estimates for pool resurfacing, owner's paid pool's invoice, debris left by Roofing company on 1st occasion.
