I signed a contract January 2020 with *************************** to build me a house in ***************** ** in the amount of $215,000. We agreed on 20 percent cash payment in advance of 4 phases then 10 percent at the end and 10 percent at completion of the house and the punch list. Every time we make payment he asks to be cashier check so he doesnt have to wait few days . Since we made the first payment he disappeared for few months then lies here lies there took him 14 months to get the permit from Saint **** county permit department, when I called them They asked me if I abandoned the project I asked why they told me we asked ****** few he never answered and it s been months and I founded out he applied 6 months after we paid him , when I confronted him , he apologized and promised to make it up for me. Since then its been a nightmare 3 years and 7 months the house not finished he is not answering his emails texted or tens of phone calls a day. I keep getting liens on the property first it was from ******* *********** then I had to pay the ********* now its united electric just filed a lien against my property .last time about 5 months ago he was begging for cash or he will sto , I asked says who you are not disappearing as usual and asked him to sign a paper and notarize it stating you will finish building the house and it will be ready in 5 weeks, we gave him $15,000 after we got the letter from him stating he is gonna finish by June 26 2023 and he is fully committed and all the contractors are his responsibility and ready to start , few months later nothing been done and he run out of excuses and lies and told me he is broke. I offered to help him buy whats needed which I did , now everything I bought is in the house and to avoid the law he sends someone for like an hour every2 to 3 weeks. I have every evidence, emails texts and the letter but I cant fire him because other builders asking for over $80,000 to finish the house that I already paid in full.Help
