      5 Dec. 2022 Company did not show up for work on pool deck . The company did not call to report they were not coming as arranged. I called the company around **** am .I left a message, they did not call back. At about 11 am I called again. A lady answered she stated she had a prior appointment and was going to call. She stated it would be a week before the work could be done. She stated she would call by the end of the day. She did not call back. The work was agreed to in April and was scheduled for Dec 5, which was verified weeks ago. No reason was given why they did not show up on 5 Dec.2022. I had cleaned the lanai and pool deck and cleared all the outdoor furniture.

      We did call ****************** the following morning and told him we would be there on Tuesday Dec13. to pressure wash the deck.  The deck was washed on Tuesday.  Painting of deck was started the following day and all work was completed by Monday December 19.  After all the work was completed ****************** stated he was happy with all the work and paid for the work. At this time we feel we have fulfilled the contract and all work has been completed to the customer's satisfaction.

      Hired to fix pool deck. Suggested injection method to raise pool deck. Solution did not work. New contract for helicon posts solution is full of untrue statements that contractor says he told us.

      Business Response /* (1000, 5, 2021/12/22) */ Gulf Breeze Enterprises, will be referred to as GBE, contracted with ******** to resurface the pool and install new tiles on the pool. The back corner of the deck was sinking at that time. I advised ******** I had installed brick pavers on this deck approx.15-20 years ago and at that time the deck was beginning to sink. The previous owners did not want to correct the sinking issue. They had sand added to level the area and had brick pavers installed. I proposed to ******** the pavers need to be lifted in areas and have a process of grout injection performed. This process involves drilling 2" holes through the concrete and a solution is pumped under the deck to fill in the voids. I also suggested that in the back area of the deck, we dig under the deck and in several areas install a concrete pad of approx. 12" x 12" and set up hydraulic jacks to lift the sinking deck with the jacks to lift the sinking deck in that area, then reinforce the jacks with concrete piles. I told ******** this process would be less expensive than having Helical piles which are driven deep into the ground to hold up the deck. AT that time a price on installing the Helical piles was not provided because I felt they did not need to spend that much money to have that process performed because I felt there may possibly be a chance it may or may not solve the sinking issue and no warranty is provided on the sinking issue. I explained all this to ******** and a decision was made to have the jacks installed which was performed and the deck was lifted to a point where if it was lifted more it would have cracked. Apparently the soil has settled again and the jacks did not stop the sinking. ******** contacted GBE and John H. from GBE and Levi Scarberry from Liamco,LLC which is the company who performed the grout injection and installation of the jacks, inspected the deck and we both are in agreement that the solution to stop the sinking is to have four Helical piles installed under the deck. Liamco, LLC provided a proposal to perform this work which is typically a price of $11,400.00. However a discount of $7200.00 is deducted off that price which brings the price to $7200.00. The amount ******** had paid on the work already performed was $7000.00. An additional credit of $200.00 is being applied to bring the price down to $7200.00. This amount is less than if the Helical piles had originally been installed. I am sorry if there was a misunderstanding or if Matthew does not recall our original conversation. But we are trying to work with them by offering a greatly reduced price by providing a credit on the work which was already performed. Unfortunately we cannot determine the condition of the soil under the deck. I have suggested ******** may want to hire an engineer to perform a compaction soil test to find at what depth stable soil is found. GBE tries our very best to provide quality service to our customers and want our customers to be happy with our work. We feel by offering a credit on the previous work performed we are showing good faith to resolve this issue particularly because there is no warranty on the work. I have tried my best to provide the facts in a way to help provide a reasonable solution and it is my desire to get this resolved. We hired this business to fix the problem.The owner suggested to us what would be the best solution for us. We went with his suggestion because he told us it would be the best way to fix the problem. However, he stretched the truth about what he said to us. The new contract he sent us has untrue statements and he wants us to sign it. We refuse to sign something that is not true Business Response /* (4000, 9, 2021/12/28) */ I have presented all the facts to the best of my ability. I feel the customer misunderstood or does not recall all the information I presented to them before a decision was made. A credit of $7200.00, which is the amount the customer had paid on the previous work, will be applied to the new contract. Therefore, I do not understand what the problem is. The customer will not be paying any more than they would have paid if this work had been performed in the beginning. Again, as the new contract states, there is no warranty because I do not have any control over sinking soil.
