      I hired Proxima Property Solutions on November 23, 2022 to do some tree work and repairs to my pool cage damaged due to Hurricane ***. We agreed on a cost of $3250, with 50% ($1625) due up front. I sent him the money via Zelle. From that day until December 31, 2022 there were multiple reschedules with no work being accomplished. On December 22, 2022 I foolishly asked him about how much it would cost to do extra tree work and again we agreed on a price. I sent him an additional $600 (via Venmo) for 50% of extra amount. On December 31, 2022, again after several reschedules, he showed up to remove the tree. At completion of the job he requested $1000 that would pay for the tree in entirety and still have $725 deposit for screen work. I was still crazy enough to think he would finish up my screen work since he had come to do some of the work. I gave him the $1000.After several more no shows I told him I was done and requested my $725 be refunded. To date this has not occurred.

      I signed a contract with ***************** of Proxima Property Solutions LLC on 9/23/22 to do extensive landscaping work for $9000.00, and paid a $5400 deposit. Hurricane *** hit, and then after the majority of the post-hurricane clean-up was over, Mr. ******** promised to complete 2 jobs for me. (1) Remove my hurricane shutters that he put up, that I pre-paid for the removal of, and (2) to complete the landscaping project. The shutters were finally taken down on 11/23/22. They were taken down by 2 people hired by Mr. ********* who also did minimal prep work (relative to the project scope) on that day..From 10/25/22 through today (11/28/22), Mr ******** constantly promises to complete the landscaping job, and never shows up. I have repeatedly asked for a refund of the $5400 deposit, and he refuses. He has only be deceitful, untruthful, and neither he nor any employees show up, even when promised. Despite his claims to do so, he has produced no orders, invoices or photos as proof of what he claims to be the truth.The workers whom he sent on 11/23/22 also openly told me 'that that was ****. He always overextends, overpromises, and does not ever complete jobs in a timely manner.' That **** frequently calls them in emergencies to quiet angry and upset clients. He called them that morning, and did not even explain the job to them.I do not trust that this project will ever be completed, and even if it were to be, I feel that it will be poor quality because of his deceitful practices. I simply want my deposit back, and I will happily pay for the minimal prep work performed on 11/23/22.I cannot approach other businesses to do this work, because I do not have the money for another deposit. I have attached pictures of the contract, and have an MP4 video of our text exchange (but below it does not say that videos are accepted), which is the only means of communication that we have had. It shows the dates, times, and full text of our communications throughout this period.

      On 09/22/2022 *************************** messaged us on ******** regarding an estimate for landscape design and install. On 09/23/2022 We met with *************************** at her residence to go over a design and provide an estimate. The same day an estimate was provided outlining the scope of work. We agreed and signed contract the following morning (09/24/2022). The job was to take 1-4 weeks dependant on overwhelming circumstances and or Acts of God. (4) Days later Hurricane *** made landfall and obliterated our coast. We attempted to schedule a start date multiple times but for a few weeks our schedules didn't line up. *************** had to go out of town the week of (10/27/22) which was when we were planning on starting the job. We still offered to work with her on scheduling and get her taken care of at both of our earliest convenience. Since then, and on the day of this complaint, *************** and I have agreed to continue the work and execute the project. Materials are all paid for and ordered. The materials are scheduled to be delivered on 12/16/2022 and scope of work will be completed by 12/18/2022. We will complete the job up to standard of the contract and go above and beyond to satisfy *************** with our work. Attached is conversation.

      I am rejecting this response because: The business is not telling the truth. I was NOT out of town during the week of Oct 27 - please review the original and now 2nd attached chat logs which have detailed dates and times. I have repeatedly asked the business to provide more details about the work, because in part, Hurricane *** destroyed parts of my landscaping that are no longer eligible for the landscaping work, because they were so seriously destroyed, and so those items are no longer needed. I have also asked for proof of ordering or delivering of goods as proof of good faith - they were most recently supposedly delivered on Nov 26, and now the delivery date is Dec 16? Proof that this business does not tell the truth, and makes statements that he wants me to believe. This business does not act or speak in good faith, and does not tell the truth. I simply want a refund.

      I am rejecting this response because:
      **** promised to complete the job by Dec 18. Still not complete.
      Dec 19-**** promised to be at my house. Never showed up.
      Jan 4-**** dropped off some plants.
      Jan 7-**** and his wife spent less than 1 hr working. Brought 3-4 plants, mulch, did some plant bed cleanup. He and his wife left claiming that they were uncomfortable around a vendor who I asked to give me a quote for tree ***** removal of 2 stumps. He was very angry when I told him that I was not going accept his 'free' offer for 'a ****** to remove the stumps, and angry that I would prefer to pay a licensed, insured, established company to do the job instead, even at an additional cost. **** dumped landscaping debris on the property across the street (citable offense by ********** Code Compliance), claiming that the '****** would pick it up when he removed the stumps, even though I declined that '****** for ***** removal. I had a vocal conflict with ****'s wife, where I again requested a refund, and ****'s wife ultimately said that I was owed no refund. **** and his wife left the property, but returned shortly with ********** Police to ensure his safe removal of his *****, shovels, and garbage can from my property. I had never suggested nor tried to prevent **** from access to any item of his on my property. In fact, I was not aware that they were even on the property.
      Jan 8-**** and his wife spent about 15 minutes. I heard noise and reminded **** that I asked him to knock or ring the door bell when he was on the property, and I said that in the future, if I heard someone on my property that I would call the police. **** and his wife became angry at this, saying that I knew they were there. I said that I did not know until I heard them, and reiterated my request. They left threatening to have me arrested, after screaming at me, and **** shouting "I'M DONE!".

      On 01/06/2023 work/prep was done. My wife and I both spent hours even working past dark to get the prep taken care of. Between 01/04/23 & 01/07/2023 We delivered 30 bags of premium brown mulch, ****+ SF of commercial grade weedmat, 5 gal of fertilizer, 1 triple head adonidia palm, (6) black magic ti plants, (12) blue daze plants, and (27) mixed liriope plants. I also added (2) purple fire spikes plants, and (6) foxtail ferns. Valued at approximately $450. That was all of the plant materials for entire scope of job, plus some. We arrived at *******'s property and immediately started discussing the removal of the two stumps she still has in her yard. I told her I would have a company that I work with often come out and take care of them at no extra charge. (I was going to pay the company out of pocket) She agreed but asked that I have them write up something stating she does not owe for the service. I told her that was no problem and continued working. Not one time did she tell me that she did not want me to have the stumps removed. Shortly thereafter, ******* called ********************* (Somebody she knows I have history with him stalking my family, threatening me, and filing false police reports against me) to come over and "Give her an estimate". I was right there the whole time they were discussing the stumps. **** does not own or represent a legitimate company. In fact, I heard him and have video audio of him stating he would call "**** from GB Trees and he can take care of it". Moments after that, ***************************** another person who I have a known issue with ironically showed up and started walking around the property aimlessly. At this point, the bogus "estimate" was over and ********************* was hovering by his truck for an extended amount of time. I noticed he was armed so my wife immediately pulled ******* aside to let her know that she did not feel comfortable being there with him there and we would return for my tools. My wife did not get upset but tried vigorously to get ******* to be mature about the situation after she continued to lie and name call. ******* claimed that I never sent her a receipt for materials. That was clearly a lie, so I pulled my phone out and showed her where I not only sent it, but she acknowledged receiving it. We then left and called **** to record the situation and ****** me to get my tools from her property. While doing so, I told ******* that I knew what she was doing and I didn't appreciate it. That I would give it ONE more attempt to complete the job without interference, otherwise we would stop work and she would have to pay the remaining balance. This was all in front of the **** officer and on body cam. We agreed to return to the property the following day 01/08/2023 between 9:30-10:00 am. The police officer told ******* that if she becomes combative again, I had every right to stop work and charge her for the balance. We all agreed. On 01/08/2023 We arrived at the property around 9:45am and I started blowing the road off and making my way up the driveway. ******* then came running out, screaming, yelling, and being very aggressive (shouting expletives). She said she would call the police on me if ever step foot on her property again without first ringing the door bell. Which, is impossible to do as her doorbell is obviously at her front door. It was clear to me at this point, there was no working with *******. I informed ******* both verbally and via certified mail that I would no longer be completing the project and that she would have to pay the balance on the invoice. ******* refused delivery of rock claiming she would "Call the police" if it was dropped. Attached you will see a copy of the letter I sent certified as well as the new invoice for work already completed and materials already delivered. ******* was also made aware months prior that the nursery charges a 30-40% restocking fee. You will see that with the work completed, plants delivered, and her credit for partial refund of rock.. ************************* owes a balance of $500 that was due on 01/12/23. Being that ******* is refusing to pay her balance, I contacted **** in regards to pursuing charges for "Theft of services" which is a felony in FL. I will also attach pictures of plants and other materials delivered on site. I will also upload the police reports.
