      Tuesday, November 15, 2023 Complaint From: Homeowner, *******************************, *****************************************************************, *************** .com, P ************ **************************************** **********************************************************, company: Construction Synergy Associates LLC as Contractor and ***************** ******* **** as Construction and MGR, *** ******* Agreement made as of February 8, 2023. Project converting an existing pergola on the side of the house to a garage.List of issues and concerns to finish this project:The number of days past the estimated completion date for this project I think most people would agree is unreasonable. Countless excuses were provided but given the project is now 140 days past the estimated completion date one might understand why I might question the truthfulness given for the multiple delay and what might be the real reason. It almost appears he has abandoned the project.1.Contractor not completing project after several request to finalize the job 2.During the process most all of the subcontractors threatened me with liens against my property 3.Original ***** block contractor fired 4.What appears to be a handyman hired to do significant portion of the job much of which had to be redone was also eventually fired. much of his work had to be redone specifically to *********** component.5.Months have passed regarding a broken window his subcontractor broke still remains not repaired after several requests.6.Install adjustable shelves, months have passed still no progress 7.Four holes in the ceiling needed to be repaired still remain after several requests 8.Locks on windows needing adjustment still remains after several requests 9.During construction security camera detached, reattachment still remains

      RESPONSE *********** WITH ATTACHMENTS

      Agreement made as of February 8, 2023: 

      The contract was signed by ************************* on February 13, 2023.

      The number of days past the estimated completion date for this project I think most people would agree is unreasonable:

      The contract states work would start ********************************************************** approximately 3 months unless change orders, supply chain issues create extended times.  In a perfect scenario the job would be complete on July 13, 2023 or 120 days, if nothing noted would delay the process.  Mr ************ job had 8 total change orders.  The construction industry is also experiencing a labor shortage and due to this along with extended time to receive products also created a minor delay in the project.  In addition, there are a couple of very important items to point out that created delays. The property has a drive gate and even though this project was on the exterior of the home he insisted to be home if any workers are on site.  Where this is an issue, we use subcontractors that do have other customers to complete business with.  ************************* wanted an exact time of arrival and not just an AM or PM and only on certain days of the week.  He was only available Tuesday and Thursday mornings and Monday and Wednesday afternoons.  In addition, if he had a conflicting appointment, he requested no workers to be on site.  This is a scheduling nightmare.  If you take in account, the availability of actual work days his comments are not valid.

      Contractor not completing project after several request to finalize the job:

      ************************* on August 7, 2023 was notified he was in contractual default for nonpayment.  This alone took two weeks to solve with many emails back and forth.  This adds 2 weeks on to the schedule.  The job was finalized except for punch out items several weeks before he made this complaint.

      During the process most all of the subcontractors threatened me with liens against my property:

      No one placed any liens on the property.  In *******, the law states a *************** is to be completed by subcontractors and material suppliers.  A NTO notifies an Owner if a general contractor doesnt pay then there could be possible lien rights.  A NTO is not a lien in any sense.  I explained that to ************************* on many occasions.

      Original ***** block contractor fired:

      Yes, he was.  As a contractor I oversee the job and yes, I do hire and fire.

      What appears to be a handyman hired to do significant portion of the job much of which had to be ****** was also eventually fired. much of his work had to be redone specifically to *********** component:

      This was not a Handyman that completed the Hardi Siding.  Unfortunately, the work performed was not up to standards and we immediately within a few days hired another crew to fix the issues.  ************************* reviewed the work after punch-out was completed and signed off on the attached worksheet.

      Months have passed regarding a broken window his subcontractor broke still remains not repaired after several requests:

      ************************* was told we would either replace the broken glass or the complete window with frame.  We ordered a brand-new window.  Special order windows have long lead times.  Unfortunately, the window arrived in October damaged which requires another wait.  We have offered a credit back of the true cost of the window plus cost of install as ************************* feels he cannot continue to wait but have not received his decision.

      Install adjustable shelves, months have passed still no progress:

      Since ************************* started hiring his own workers without our knowledge to complete the attached punch-out list we offered again on this item the same terms as with the window, but he has not given us decision yet.

      Four holes in the ceiling needed to be repaired still remain after several requests.  Locks on windows needing adjustment still remains after several requests.  During construction security camera detached, reattachment still remains:

      When we arrived to complete the attached punch out list, the 4 holes in ceiling were already repaired, again without our knowledge.  We adjusted the windows as required.  When I was reinstalling the security camera, ************************* requested not to do it as he wanted to be moved to another location.  As this was not a contractual item and would require a licensed security company to add the appropriate wiring, we told him we could not complete the relocation.  We proceeded to say we can have our licensed firm come out to do it, but it would require a change order.  He declined.


      ************************* has an outstanding invoice with us which remains unpaid.  The balance remaining due is $2,213.15 after subtracting for the window and shelving as mentioned above.  All contractual work has been completed except the window replacement and shelving.  Hillsborough County has inspected the project and has issued a Certificate of Completion on 11/21/2023.
