3/20/24- new shower glass enclosure installed.at my home.3;21;24- advised *** at American Shower that there's an error in the glass fabricated. left glass panel was supposed to be 42 5/16" long, but is only 41 1/2" long, thus leaving a cut-out gap on the top of the shower sill. On account that the left ******************** panel was too short they had to cut into the inside of the shower sill to make the shorter glass panel fit. Had the left glass panel been the correct length, as per the contract diagram it would have placed the glass enclosure further forward and the cut-out gap would be hidden. The dimensions taken our consult estimate were correct, but the glass was fabricated too short. After not hearing back from the company for almost a week regarding a resolution we stopped payment of the deposit & final payment through ************ totaling $1790,00 in order to protect ourselves from a dishonest contractor.4/2/24 ****, the measurer came out to inspect & gave us a bunch of senseless numbers. We showed him with a tape measure that the left glass panel was short. **** offered us two solutions:1st **** states he would disassemble the entire enclosure & build a new one. This would be nice but would cause many more holes to be drilled into the shower walls.2nd- **** offered to have a repair company come out to repair the cut-out at the company's expense. We both agreed to this solution. Then **** changed his mind when he found out we temporarily stopped payment. The shower also leaks & he cancelled our appointment to have it re-sealed. I stated that I am more than willing to make payment as soon as they repair the cut-out, at their expense, as **** originally stated. **** is currently unwilling to resolve this issue, even though he was the person who offered the 2 solutions. Instead, **** is trying to strong arm me by saying he will turn it over to the company attorney in accordance with the Florida Lien Law, because of non-payment.Your intervention would be appreciated.0

This customer got a new frameless ******************************************* door from American Shower Glass to replace an old framed one from another company. We made the new glass, took out the old frame, and put in the new one.

The old framed door had a thick metal frame (3/4), so they had to cut into the wall a bit.

Our new frameless door follows Florida rules with thinner glass (3/8), so there's a gap where the old notch was made after the new installation, which is normal for all customers with the same situation.

We tried to satisfy the customer by offering to pay a granite company chosen by them to fill the gap in courtesy, but they refused to find someone and tried to attribute the research to us.

During the above discussion, we asked if they tested the new door for leaks since we try to use as little silicone as possible. They found a leak, so we scheduled a service call.

But then, they disputed both payments the down payment and the final one. We have a contract with all the warranty terms and payment details. We did nothing wrong.

Despite our efforts to help and our responsiveness, they're not acting in good faith. So, we're willing to remove the shower, accept the back charge for them to get their money back, and let them find someone else who can meet their needs.

      Complaint: 21612086

I am rejecting this response because: American Shower is in breach of our contract, our new shower enclosure was not fabricated correctly, as per my contract. This has nothing to do with whether the enclosure is framed or frameless. The left glass panel was to be 42 5/16" long, as per the contractual diagram, instead it was built to 41 1/2" long. If it was made longer to proper dimensions, it would have pushed the entire enclosure forward, which would have hidden the gap cut-out (see diagrams). The enclosure also has water leakage at all the seams. I reported this within **************************************************************************************** addition, since the left glass panel was cut short during fabrication, the installer had to saw away at the inside of the corium sill to make the panel fit, something they are not permitted to do. I reported the error the next am after a 9pm installation. But after not receiving a definitive solution to the fabrication error, we felt it necessary to issue a temporary stop payment. At a later inspection we showed ****, from American Shower, the error with a tape measure. He offered us two solutions and we all agreed to the second solution (4/10,11 emails). American Showers offered to obtain and pay a granite repair company to do the repair. They then changed their mind & wouldn't secure a repair company. Then they changed their mind again & wouldn't pay for it either. I've tried diligently to resolve this problem, but they have stopped communication after they threatened me with sending to their attorney in accordance with the Florida Construction Lien Law (4/17 email). I am just a homeowner who has saved a long time to afford the new enclosure & it is unprofessional of the company to go back on their word as to the solution we all originally agreed upon.

      Sincerely,
