      On 11/22/2023, I brought a lawn mower deck to be fixed. The mechanic said he could repair. When I picked up the mower deck he had further damaged the deck as it showed visible hammer marks making the deck worse than when I brought it to him and he also broke a part on the deck. He said it the deck could work and as he loaded it in my car, the part he broke fell off. He committed fraud by saying the deck could be used after he hammered additional dents in the deck and he broke a critical pulley part which worked fine before I brought it to him. He lied and caused me additional money because I have to buy another expensive deck and also buy another pulley assembly.

      As a business owner, we are sorry that ******** feels this way, since she is not been 100% truthful. The deck she brought in did not had a dent, it was completely bent, including the pulley where the blade its been held. She should complain to the person that damaged and bent her deck. The only way to strainght a deck, since its all metal, its hammering it, because human strenght its impossible, unless you have super strenght. The pulley, yes broke off, but she dit not even checked it when she brought it in the condition it was. The mechanic was been helpful trying to help an elderly person, to whom he did not even charged. Now a days it seems that people who are treated cordially and with respect are to get the blame for helping, instead of taking the blame to whom actually "bent", not dent, her deck. Two different things. And if she is taking it this far, I hope she realises how ungrateful she is acting. And now is trying to get a new deck for a used lawn mower that was second hand, and trying to get someone else to to pay for a new one for her. The odasity that people has. She found the pulley to only be $30 on amazon. She showed it to me on her phone, and that ****** would work just fine on her not bent deck, of an old lawn mower. It seems she is trying to find some else to blame for her real problem, who ever bent her deck.

      I reject the businesss response for the following reasons: 1) The businesss response admits they broke the pulley by stating, The pulley, yes broke off.  2) Whether the mower deck was bent or dented is irrelevant to the fact that by hammering the deck, the mechanic caused two out of the four pulley attachment points to break (see picture provided in the original complaint) which the business does not deny.  3) when the deck was brought to the mechanic, the pulley was firmly attached to the deck at all four attachment points.  4) The mechanics hammering resulted in further denting and bending of the deck.

      The business owner acknowledges the cost of $30 to replace the pulley so im revising my original desired settlement and wish to proceed with the business paying only the $30 for the pulley they broke and not the deck.

      I am rejecting this response for the following reasons:  1) The business admits to breaking the pulley by stating, The pulley, yes broke off.  

      2) Whether the mower deck was bent or dented is irrelevant to the fact that the mechanics hammering on the deck resulted in two out of the four pulley attachment points to break off the deck (picture provided with the original complaint).

      3) The pulley was firmly attached to the mower deck at all four points when I brought the mower deck to the mechanic.

      4) The mechanics hammering resulted in further denting and bending of the mower deck.

      5) The business acknowledges the $30 cost to replace the pulley.

      Im revising my original desired outcome in hopes of resolving this matter by asking for the $30 to replace the pulley the mechanic broke.

      Thanks for the reply.

      Thanks to the mechanic straightened the deck, which was none workable because the blade wouldn't fit on the pulley, because of how bent the deck was, not dented, and the blade fit just fine after he straightened the deck. We did not charge *********************** the pulley broke off, but since she admits that ****** would work just fine with the deck getting straight. We would have charge her $60 for the service. We did not charge her because the pulley broke off. She got a free service because of what happened, if the pulley would have not broken off, she would have had to pay $60 for the service. We thought that everything was left in amicable terms when she left, we even told her that if she brought it back the mechanic would install it without a charge. But she chose to go this route, and we will not service her no longer, and we will not pay her the $30 for the pulley.

      The additional information attached is a sworn affidavit from *****************************, a subsequent mechanic I took my lawn mower deck to for repair.  I took the deck directly to **************** on 11/22/2023, after the initial mechanic broke the pulley and hammered deep dents into the deck.

      I am rejecting this response because: the initial mechanic is not truthful, has lied, and has admitted several times to breaking my equipment. There are several inaccurate statements (out right lies) and admissions of fault as follows:

      1) The mechanic DID NOT straighten the deck as evidenced by me and ****************.  **************** states that in his sworn statement #3 in the attachment.

      2) The initial mechanic lied about the blade fitting on the pulley because there was no blade with the deck and the attached pulley I left with him to repair.

      3) The blade DID NOT fit just fine after the mechanic hammered several deep dents into the deck because, as I stated above, there was no blade.

      4) The mechanic admitted to breaking the pulley when he states in his reply, we did not charge . . . because the pulley broke off.

      5) The mechanic states in his reply and admits again, we did not charge her because the pulley broke off.

      6) The mechanic yet again admits to breaking the pulley when he states in his reply, if the pulley would have not broken off, she would have had to pay . . . .

      7) After further damaging the deck by hammering metal in several places, the mechanic tried to hide the deep dents he had made by painting over the dents. **************** observed this and stated the paint was still wet when he touched it as evidenced in Mr. ******* sworn statement #3 in the attachment.

      I want $30 for the pulley the mechanic broke and partial payment of $50 for the additional dents this mechanic caused me to spend in repairing the damages he caused.

      Ms. ********. With due reapect we will not pay anythung, unless ypu pay us the straighten of your deck, and making your blade fit, which is labor done, if you brought your deck knowinly that hammering your deck was the only way to fix it, then you know the outcome. You broguht to us a non functional deck, that means that it was noy cutting your yard, as per what you said. When you left, yes the spindle fell off, but ypu had a perfectly straight deck that now your blade fit. Since you knowingly knew this, why are you trying to scam a small business like ours, we are hard working people, that were nice enough to give an alternate solution to the big problem you had at hand. Instead of trying to scam us in trying to give you a deck that you yourself damage by going through a tree trunk. You and the person that damaged the deck knew that a deck is made of hard metal that no human can get straight with bare hands, but with a hammer. Please stop harrassing our business, and accept that everything that you are doing is because you are trying to find someone to fund the damage you and the driver of your lawn created by going through a tree trunk. If your email is truly Psalms 61, please do read it again, and while you are at it, also read psalm 34:13-14, and become a true honest person if you really read your bible, and give your next geberation someone to look up to. You are lying back and foeth and with every answer your true face and true intentions are obvious. God Bless you, and may the Lord shine light on your heart, so that we can continue work peacefully. Everything in my previous comments are true, and you acknowledge them ******. If you would of never brought us your deck, you would still had to buy the deck, so the only person that seems to want to scam us is you, by blaming us for something you and the driver of your lawn mower caused by running over a tree trunk.

      This mechanic continues to lie and admits to breaking my equipment.

      The mechanic did not know what he was doing by thinking hammering the deck was the only way to fix it. It was not the only way - see Mr. ******* affidavit. The mechanic damaged the deck by hammering metal in several places and then tried to hide the deep dents he had made by painting over the dents. **************** observed this and stated the paint was still wet when he touched it as evidenced in Mr. ******* sworn statement #3.
      I want $30 for the pulley the mechanic broke and partial payment of $50 for the additional dents this mechanic caused me to spend in repairing the damages he caused.

      Small businesses are the heart of Fort Lauderdales business community and I support them and do business with them as much as possible. This business however, does a disservice to small businesses by lying and not owning their mistakes.

      ********, if *************** knew how to do it another way, then why he didn't do it, and if he couldn't why not buy yourself the deck. You brought the deck bent where the blade did not fit, and that's what you said you want it, to make it fit. The mechanic made the blade fit for you, so since he was able to do that for you. The deck was half way bent, and if **************** its a specialist on the matter, then he should of have done it himself. And if according to you the ***** were so visible, where you able to tell the amount of damage your deck had when you brought it? It was half bent, and since you started this complained, you stated that it was slightly bent, which is not true, and you know so. There is no human hands that can unbent a deck, as hard as the metal the deck is. If you had the strength of supermen maybe. We are not paying anything to you as stated before. Because of the incident we did not charge you the $60 we charge, so considered yourself paid. And if you truly support small business, then you should of been honest from the beginning of your complaint. Trying to get someone else to pay for your deck, when you destroyed it, where it was half bent, is not an honest thing to say or do. The mechanic did you a favor, because truly no deck, the way that deck was bent, is even repairable, and we are pretty sure, you and whoever rode and destroyed the deck, knew this before bringing it. But note this, because of you, this type of things that you are doing, you take away the will from small business to actually help individuals who actually need the help, and we try to keep our prices low, to help customers with this high inflation and are trying to survive nowadays.

      I am rejecting this response because:

      1. The history of this case file on the BBB record shows an image of the consumers broken mower spindle which was not broken when the consumer brought the mower deck to the defendants business.

      2. The defendant businesss responses on the BBB record admit several times that they broke the spindle when they hammered the deck in several places.

      3. The consumer demands payment from the defendant business for breaking the spindle.
