      Florida native garden/landscape I had was sprayed at my family's house which is clearly separate from the sod and were instructed to not spray. The damage includes groundcover, shrubs, and trees which provide food and habitat for hundreds if not thousands of living things that make for a functioning ecosystem. On March 13th, ******************* of Assure Green came over a week after I had contacted them and I showed him all the damage done. There was no denial of said damages at this point. He apologized and told me to e-mail him a list of the plants. Attached are said e-mails.About two weeks later he called to say he was on his way with plants and said they didn't have all of them. This later proved to be untrue as I called Sweet Bay Nursery and asked if they had specific plants that he did not acquire. When I met him to help unload the plants he did bring, I asked in person if he could write a check to cover the damages. He said he could not do that because I am not a business.As the month continued, he would show up two more times with plants. The second time I wasn't there. My mother, ****, asked ***** if he could write a check for damages. He told her he couldn't because he was concerned about being audited. Before the third time he showed up- which was around the beginning of April, I had talked to him again on the phone, asked about covering the costs of damages again as he still didn't acquire all of the plants and was taking his time despite my emphasis on how urgent this was and he said if I write him an invoice he can write a check. I gave him the invoice, and said he would have his people take a look at it.On that last visit I showed him one of the trees that was sprayed, which I had shown him the first time and is also listed in the e-mail. He denied any wrongdoing and lied about what they use in the solution that they sprayed.

      This is unfortunate. While I do not believe entirely, we killed said plants and groundcover we did in fact agree to replace the plants that were dying in good faith. I say this because the son told me he was pouring roundup on the plants in question, which in fact would kill them. We simply applied fertilizer however we were not supposed to so we did take the blame. I began replacing the plants a week after I met the father and son on the property. I had to drive to ******** to get the plants to be replaced. I do in fact have correspondence through email and phone with the nursery letting me know when other plants were in. I took several trips down there to retrieve the plants for them. The total of $1619.90 were spent on the plants that were replaced. I have had multiple conversations with Mr. and ******************* and their son. Finally, since their son does not live there, they asked that I correspond with the Mrs. only to make an easier communication between the four of us and to no longer talk to the son. I was prepared to write a check for $107.95 but they insisted on including a 15-foot Magnolia Tree we do not treat and have not treated. I knew for certain it had active bugs on it but they insisted so I stated that I would send a sample of the tree to the ********************* lab to see their diagnosis. They indeed came back that the tree had ****** that would cause this damage. Mrs. agreed previous to sending the sample that if indeed it was their responsibility, they would cover the cost. I emailed Mrs. the report and have never heard back. I feel we have exhausted all means to make the Mr. and Mrs. who live there as happy as we possibly could. If you need further documentation, I would be happy to send it.

      I am rejecting this response because:

      Just flat-out lying and twisting of words. 

      the son told me he was pouring roundup on the plants in question, which in fact would kill them.

      I was talking about a very specific section of our yard(the rock bed) which I had poured round-up in localized areas of on in July of 2023, when there were no plants except for one particular weed with a deep tap root. I began planting this area in November of 2023 with no adverse effects. Not even from AssureGreen, thankfully. 

      I had to drive to ******** to get the plants to be replaced. I do in fact have correspondence through email and phone with the nursery letting me know when other plants were in. I took several trips down there to retrieve the plants for them. The total of $1619.90 were spent on the plants that were replaced.

      ***** was not in correspondence with me at all while he was were there to tell me what plants were available/unavailable. He didnt replace all of the plants, and some of them werent even the right species. While I was grateful the first time he came through, the fact that he could have obtained these plants through other nurseries but didnt bother because he assumed I didnt want him to goto ****** to get plants, and didnt goto the other nursery I recommended because they didnt answer their phone. I never said dont *****************, I said I personally dont go there. The total cost of plants from our calculations was over $3,000.

      Finally, since their son does not live there, they asked that I correspond with the Mrs. only to make an easier communication between the four of us and to no longer talk to the son.       Aphids dont cause that type of damage, nor do scale insects. It is mind blowing to me that ***** chooses to blatantly lie. We had an arborist come out and confirm that the magnolia tree was sprayed. Again, he told me in person, that they dont use any herbicide in their product. The sample her had tested is admission of his guilt. 

      I would like to reiterate again that ***** told me the first time I asked for a check, he said he couldnt because Im not a business. The second time my Mom had asked, he told her he couldnt because of an expressed concerned of being audited. The third time when I asked again, he said write him an invoice. That is when all of the sudden the tree was not his fault. Also, if he was asked not to contact me, why bother he calling me regarding the tree but then e-mailed my Mom the results instead of me?

      I see the game ***** is playing. It is to exhaust me my efforts into holding him accountable.

      I am attaching the following documents: the e-mail of the tree sample test results, an e-mail from the arborist, photos of two sweet bay magnolias on the property, both of which I showed ***** in person, which shows the comparison of one that was sprayed vs one that wasnt.

      I am very confused... I received a final list of plants that were wanted from the Mrs (mom). I added the list up and it was ****** however taking out the Magnolia that we had discrepancies about the total was a little over $107.00 that was wanted after all was said and done. I was willing and offered to write that check without the Magnolia (until we had it diagnosis as discussed). We had it diagnosed (which Mrs. agreed to pay for ($125.00)) if it was a bug problem, which was attached from the *********************. It was indeed a bug problem. If the son doesn't believe this I think it would be better taking it up with the lab that did the testing...not me. It is unfortunate he does not believe them but there is really nothing further I can do about that. Since the Mrs (mom) agreed to pay that invoice and I was going to give her a check for $107.00 I believe I have not heard back from her and we have come to an unspoken understanding that it is a wash. I feel I have tried to satisfy this complaint to my greatest ability, and I am not sure what else the son is asking for since I have not heard back from the homeowners themselves. All of this is documented through email and recordings on our phone system.
