      I contracted with ScreenWorks Inc to rescreen my pool enclosure on 1/17/23. They started rescreening on 03/02/23 and completed it on 03/03/23. After they left I noticed some of the frames were shifted and misaligned. After contacting them about my concerns *** **** came to my house twice, on 3/7&3/22/23. Without listening to my points or even reviewing the structural frames, he tried to persuade me those misalignments were due to original construction or wear of the enclosure. I had a licensed Professional ******** ** ***** ***********, *** **** ****, review the whole structure of the enclosure on 04/08/2023. After examining in details the enclosure, frames and screws, he concluded that a shift of the frames happened during the rescreening process. His conclusion is based on reviewing the frames, screws, whole structure and the working conditions during the rescreening. In the rescreening process the enclosure was kept unsupported with the supporting brackets, supporting cable wires and old screen completely removed all at the same time. They left the frames in that condition overnight. One of the people from ScreenWorks laid a ladder directly on the unsupported frame and stood on top it with all his weight during rescreening process. Both of the supporting bracket and cable wire were completely removed from the structure when he did this. I happened to have the incident captured. I also have some pictures of the screen enclosure before rescreening started. The picture shows no misalignments of the frame. I want ScreenWorks to admit that they have caused the misalignment of the structure and to fix the damages they caused during their rescreening. Some retouch of the paints on the frames needed and two panels of screens need to be replaced due to manufacture defects of them. Those items, *** **** verbally agreed to fix them when he came here on 3/22/23, but they have not completed them yet.

      After meeting with *** ****** a couple of times to view her complaints, ScreenWorks maintains that the misalignments pointed out were there as a result of the initial installation 15 years ago. We have offered numerous times to meet with *** ****** along with a company that specializes in screen enclosures.... a screen enclosure company or an aluminum engineer. We also requested to be present at this appointment to be able to address any questions. ScreenWorks is also willing to pay for this site visit. Regarding the service work discussed we would be happy to take care of those few items when an agreement can be reached since there is currently an outstanding balance.

      **** ****** has not provided any documentation or proof that any damages were done during the rescreening process. Any pictures provided that reflect any misalignment does not mean that the misalignment occurred during the rescreen. **** ****** scheduled appointments by other companies without Screenworks present and without providing any documentation from these companies explaining that damages had occurred during the rescreening process. We feel these appointments were deliberately scheduled without ScreenWorks present. In regards to the cousin of **** ****, who is one of the other screen enclosure experts she had visit her home, there has been no contract with this individual for many years. If his statements happen to coincide with what we having been trying to explain to **** ****** then that is further proof that we are correct regarding our findings. As this is the first time we have heard that she had other companies visit and review the enclosure we would like to see what documentation these companies have provided as the "proof." WE would also like to see the documentation and invoice from the aluminum engineer that came out to review the enclosure. ScreenWorks maintains the stance that the shift in the enclosure that **** ****** is saying Screenworks did during the rescreen is simply impossible. Any existing misalignments have been there since the original construction. Screenworks is still willing to meet on site with another specialist to review the project.

      Screenworks still maintains and feels confident that there was no shift as it would be impossible from the rescreening process. When pool enclosures are constructed they are engineered and built to withstand 120 mph hurricane force winds. With that in mind there is no way that leaning a ladder against the frame would cause a shift in the enclosure. 

      Screenworks has yet to be provided with any proof to substantiate *** ******'s claims. An image of a worker standing on a ladder is far from proof that the structure was misaligned due to this action. We are more that willing to review any documentation that is provided by the engineer or other contractors but there has been no information provided despite numerous requests. Statements from *** ****** on their behalf will not be considered as proof.

      Since *** ******'s basis of claim revolves around statements from an engineer and professional screen enclosure experts, Screenworks requests the following information to review: 

      1- The "solid proof" that *** **** gave to *** ****** in his writing.

      2- The statements from the "many professionals and layman" who have stated that the shift was caused at the time of the rescreen in their own writing.
