I registered my two sons at J Tiger Martial Arts at ************************************************* for the twice a week classes. On May, 18 2024 I paid $736 dollars. That includes the first month and last month fees. Unfortunately my boys attended classes just (1) one time and it doesn't seem we can continue the classes. I contacted J Tiger Martial Arts and explained the boys are unavailable to continue their enrollment and will like to terminate the enrollment. I was surprised when J Tiger Martial Arts said they can't do anything even after I had explained to them the above reason why. They told me Premier Member Plus Inc was the company in charge of their billing and they can do nothing. I contacted Premier Member Plus Inc via email at ************************************************ and through phone contact at **************. I received two verbal confirmation from Premier Member Plus Inc on August 5th and 7th, 2024 that they can't cancel the contract and that I need to pay the full 12 months before I cancel the contract. Also on August 5th, 2024 Premier Member Plus Inc attempted to draft my account for another months payment.

I am rejecting this response because: The kids are unable to attend the classes in the past and in the future. In fact they attended only one class. Should I pay for a twelve (12) month service when we have not been serviced?

      Sincerely,

      ******************

I am rejecting this response because:

Under consumer law, a business generally cannot charge for services that were not rendered, as this is considered a deceptive practice and is often illegal.

It would seem that from Premier Member Plus Inc responses and their refusal of my rights. They are trying to charge for a service that have not provided.

My son( 5 yr old) registered in *** ***** *** **** **, Houston, Texas and was going for couple of days a week and we got excited and signed a contract for 12 months( *$140 /month). After a month or so he became really sensitive to the noise since its a closed venue and was complaining about it at home and even crying for hours. I spoke to the Master and he recommended to take a break and we put a hold on the payment for 3 months * 2 times. After the hold, we took him again to the class and this time, he was holding his mum so tight and got very nervous and immediately started crying. We felt that this is causing him trauma and we do not want to take him inside( Nothing to do with Master however the environment made him nervous). I explained my situation to the Master and asked him to cancel the agreement and he asked me to talk to Premier Member plus since they are handling the contract. I spoke to them and explained my situation. They were so rude on the call saying that they cannot cancel the contract and it doesn't matter what my kid go through. As a parent hearing those, I was so upset and want to talk to their manager. Their manager was on leave last week and we had our call today( Apr 24' 2023). The manager was even more rude and said they cannot do anything and nothing is mentioned in the contract. I even explained why my kid's situation and provided my option of paying part of the contract. The manager didn't hear any-word I said instead put in like even your kid is not going to school, you need to pay pending 9 months payment and doesn't matter he goes through a trauma. Their business is so cunning and they use contract as a way to hold the parent hostage even if the kid goes through health issue or a trauma. I didn't have anywhere else to make a complaint and I want to make sure others read the review and make sure that they are not going through what I am going through now.
