A deposit of 8788.20 was given May 8, 2023. A scheduled date to lay concrete was 6/14/2023. I contacted the company to reconfirm because no one had shown up for the job. I was told that due to the forecast they wouldn't be coming. I informed the business that there was no rain in the forecast at the job site for that day. Then I was told they were ordering more concrete stamps so they could complete the job faster and would not be coming back until Monday 6/18/2023. I informed the company that pushing me out another 5 days doesn't get the job quicker, and there is rain forecasted for that day, which would delay project completion further, to which there has been no resolution.

We have been in communication and are working as quickly as possible to complete this project without sacrificing quality. At this point in time all concrete has been poured, finished and stamped. To give time for curing we have scheduled to stain and seal the project 7/11/23. It is unfortunate that we had to reschedule and does not serve us well. In the interest of delivery a quality finished concrete pour we sometimes have to error on the side of caution to prevent loss of materials or failure in our finished product.

Contracted for Concrete Stain & Seal floor (same as existing floor). 42 days after we paid non-refundable deposit, Company said the claims their sales rep made were false. Company claimed that we could only achieve the results promised if we upgraded to epoxy floor at an added cost of $2,646. Work began November 15th. First application of floor was defective (craters in floor). Second application was defective (instead of brown and black floors contracted, colors were orange, blue and gray; Company admitted had sourced colors from a different supplier). Third application was defective (delivered sticky, oily floor not representative of sample, not capable of being swept or functioning as intended, scratched, with craters and other defects). Company admitted on November 22nd that floor "was not practical." In addition, significantly damaged property causing thousands in damages, including: gouged, scraped, scratched and epoxy coated baseboards, doors and door trim; blue painter's tape glued into baseboards, door trim and floor; epoxy on kitchen cabinets; epoxy on kitchen countertops; epoxy on dishwasher and refrigerator (including on appliances, affixing appliances to floor); epoxy on stair hand rails; epoxy on doors; chipped kitchen countertop; scratches from grinding machine across refrigerator, dishwasher, ice maker, wine refrigerator, kitchen cabinets and bar cabinet; epoxy on patio table Company was using to mix chemicals on without permission; dead grass where Company was mixing epoxy; damaged pavers; outlet ripped off wall; chipped walls; and gouged stair steps. Company also failed to ventilate the home in any manner resulting in strong, persistent and toxic fumes for weeks. Permitted Company to inspect floor and damage on November 22nd. On January 15, 2022, delivered demand for Company's insurance information pursuant to Florida Statute 627.4137. Company failed to provide information within the required 30-day period and otherwise not responded.

      Business response

Business Response /* (1000, 10, 2022/04/18) */ We were contracted by *************** for Concrete Overlay Flooring at first. After learning more of their wants and needs we suggested a Metallic Epoxy Flooring for a Marble Like Finish. The prep of the floor removal was all done correctly and documented daily with notes and photos every single time we were on the property. We applied a Epoxy Primer as a base coat and followed manufacture guidelines as we always have. We proceeded to apply the Metallic Epoxy on top of the primer and the substrate concrete slab off-gassed too much making the topcoat of the epoxy to bubble (not fail). There's nothing the installers did wrong. The concrete just off-gassed too much. We advised the customer that we needed more time to apply another coat of epoxy of top which is the correct steps. Our normal supplier was out of Black Metallics so we outsourced from another local suppler Black Metallics but they gave us Gun Metal Metallics which we could not tell the difference immediately. There was no blue added. Once the wrong color was added we added a 3rd layer of Metallics. Both 2nd Coat & 3rd Coat was on DreamCrete dime and never asked the customer to pay. Once we applied the 3rd coat it came out perfectly as Metallic Epoxy should. Customer walked the property when the epoxy cured and was happy and handed us our final check. The customer then proceeded to STOP PAYMENT over the weekend and text the owner that footprints and handprints could not be cleaned and nothing was working and claiming the floor was ruined. DreamCrete Owner went to the house immediately and showed them how to clean the floor properly and video recorded himself that nothing was "defected" and yes the floor can be cleaned properly with the correct products and proceeded to leave the products and cleaning solution and cleaning equipment with the customer. Their main complaint and concern at that time was the floor always leaves fingerprints and footprints. We advised the customer A Black Glass Like Mirror Finished Floor that is almost 90% Black is going to leave fingerprints like Black Glass, Like your cell phone glass screen, like a brand new black vehicle. If you buy a brand new Black ******** and drive it off the lot and realize over the weekend that the brand new all black ******** has finger prints all over it because you touched it, the dealer is not going to return it just because. We showed the home owners how to clean and left them all the equipment and materials. We ALSO came to an written agreement that DreamCrete at NO COST would come back and apply a satin finish sealer which we supplied a hard sample and both homeowners approved which should have been a Change Order but we decided to do it for free. The home owners wrote us a email approving the sealer over the epoxy which would give the epoxy a satin finish and not a mirror glass like finish. The end result would not leave Footprints or Fingerprints on the epoxy surface because of the satin finish and no more glass finish. We purchased the material and blocked off dates to apply the approved sealer. Days before we were to start the customer emailed and refused to allow us to fix the issue demanding a refund At this point we have turned everything over to our attorney and will be more than likely going to court and countersuing. Consumer Response /* (3000, 17, 2022/05/16) */ ***Document Attached*** On April 6, 2022, I spoke with Dreamcrete's attorney (Robert S****). S**** acknowledged Dreamcrete's defective work product and offered to send a contractor to my house to provide an estimate of the repair costs. At that point, we would discuss a settlement amount. S**** asked me to wait until the week of April 25th to arrange for the contractor to come because he was currently working on another trial. When I received a copy of Dreamcrete's response from the BBB on April 19th, I contacted S**** who asked me to hold on any response as he was still in trial and would respond to me as soon as he could. I contacted him again on April 29th and May 3rd and was asked once again to wait. It was not until May 6th (after the deadline to respond to BBB had passed) that S**** contacted me and told me that his client was not interested in any settlement negotiations. This was a complete about face from what we had initially discussed. Accordingly, I would like to reopen this case as I was relying on inaccurate assurances provided by Dreamcrete's counsel when I did not respond to Dreamcrete's answer.
