      We entered into a two year contract after a presentation by a Premier Media Solutions salesman. I was told several things about how their advertising worked. I tried and signed up for the two year program. The advertising did not work and not a single contact was made. I fulfilled the contract and was surprised when I was billed for a 3rd year. I immediately responded that after no results I would like to discontinue their services. I received a response that they require a SIX MONTH cancellation notice and that I was still responsible for the full 3rd year. The cancellation policy was NOT discussed during our sales presentation and their policies are listed on a separate page than the contract and I have no recollection of seeing this. I have been trying to connect with a sales rep to discuss for over a week now and they do not pick up thier phone. Regardless, the 6 month cancellation notice is intentionally designed to force their clients into a forced 3rd year. No one should ever do business with this company. There should be a warning about the shady practices of this company. This has also caused me to negatively review the real estate company that promoted and partnered with this terrible company.

      Further to the complaint submitted by Costal Kitchens &Baths, please find below and attached our response.

      Costal Kitchens & Baths entered into an advertising Agreement (attached) on the 5/26/2022 to advertise their products and services on a Interactive touch screen and associated marketing products to be located at the *************************** ****************** in **************. Please see attached photos of the touch screen in situ.

      The Advertising Agreement was signed my a *************************** a Manager of Costal Kitchens & Baths. I have attached several emails between ***************************** and Premier Media, where you can see there was clear communication between us.

      We find the Customer Complaint disingenuous for the following reasons:

      The first thing I would bring to your attention is the second sentence of the complaint I was told several things about how their advertising worked. The sales presentation was made just to *************************** at ***************************** office, ******* was our sole point of contact and signatory of the Advertising Agreement and you will see from the attached email copy (Fwd_Payment Reminder) from a ***************************, that *************************** hasnt worked for Costal Kitchens & Baths for two years, so how could the writer of the complaint, know what was agreed with *************************** on behalf of Costal Kitchens & Baths?

      I have also attached a screenshot of ************************* ****** Calendar notes made by a gentleman call *********************, whom spoke to *************************** first. You will see from the notes that *** asked ******* if here boss would be attending the meeting and she said no and that she had been given full authority.

      The unknown complainer also states we entered into a 2 year agreement after a presentation by a Premier Media Solutions salesman and they were surprised when they were billed for a 3rd year. Please can I direct you to the Advertising Agreement just below where ******* signed the agreement, where it says in bold letters I fully understand that this is an automatically renewable advertising service Agreement as per clause 9 of the terms & conditions.

      Please can I also direct you to the attached email sent to ******* on Monday, August 22, 2022 6:52 AM where again, we are clear about the advertising agreement being automatically renewable and as the terms and conditions, it points out what the client needs to do, if they no longer wish to continue with the advertising.

      We find the accusation of ***** practices offensive and clearly untrue. Whom every made up this nonsense obviously had nothing to do with the process of agreeing the agreement or the advertisements implementation and they are just trying to use the BBB to avoid its obligations under the terms and conditions agreed by a authorised member of their company.

      Thank you for forwarding us the Premier Media Business response.  We have read the response and neither accept nor reject it.  The problem lies in the fact that a contract was signed three years ago by an employee that has not worked for our company for the last two years.  We believe that if Premier marketing was on the up and up, they would have reached out to our company 6 months ago to follow up with the contract renewal terms to see if we were satisfied and let us know that 6 MONTHS advance notice was required for non-renewal or it would be automatically renewed.  To send an invoice of $2600 Due after knowing the upcoming year cannot be canceled without 6 months advance notice is the shady part.  It is a ****** learned for us, and hopefully an eye opener for other businesses considering using this digital ad service.

      Very deceptive business practices. Under their DBA name Guided Luxury this company promised me many things they did not deliver in a print ad they sold me. They explained that it came with several services such as a home referral program with a partner company, Sibcy Cline where I would be referral to all the local Sibcy Client real estate clients purchasing new homes for two years and the ability to visit all the branch offices and pitch my services to their agents. When I tried to set up these meetings with the agents I was told it cost more money. They are scammers, beware. They charged me $855 four times for print ads but did not include the two items I actually wanted. I have no use for print ads. I was heavily pursued by their employee ********************* and promised over and over all these extra things.

      I have attached 4 documents in support of our position. 

      The Flourish by Design Agreement is the contract between us and Flourish by Design. This is to produce a ******************* for Sibcy Cline in **********. The magazine has been produced and delivered in paper and e-magazine format and Sibcy Cline are very happy with the publication. 

      Part of the discussion with Sibcy Cline and Flourish by Design was that they would become part of the approved Home Referral Vendors programme. We admit there was some confusion over this as it was introduced by an employee of Sibcy Cline, while the project was being carried out. 

      Once the Home Referral Vendors programme was brought to our attention by ********************************* we contacted Sibcy Cline and their head of the programme ******************* invited Flourish by Design onto the programme for an initial 12 months with the second 12 months at Flourish by Designs discretion. Please see the attached pdf's of the emails.

      We are confident we have provided everything under the advertising agreement and beyond.

      11/29: *********************** reached out to me to state that my son's company was recommended as a part of a real estate outreach program. I thought this would be a nice Christmas gift for my son and consented to a meeting. I am a senior citizen on limited income and ***** has lied to me and misrepresented himself to me.11/30: Had teleconference with ***********************, Premier ************************** signed a contract. Later that day, I called the real estate office that ***** mentioned as the referring company. I left several messages and no one called me back it was then I called ***** who stated their office was very busy and someone would get back to me. During the meeting ***** presented himself as a representative of the real estate company. I found out later that was not true.11/30: Called ******* answering service to request a return call - no one called me back 12/1: Sent email (attached) asking for downzize of ad. Received email stating someone would contact me-no one did 12/1-12/20: Made various calls & sent emails to cancel the contract - no one has bothered to respond 12/6: I called my bank and stopped any further payments to Premier 12/21: ***** sent me a note that the contract states I cannot cancel it 12/23, 12/24: More emails & phone calls without response

      Hello BBB, we have looked into the complaint by ******************** of NuVision Home Improvement LLC and we strongly believe, we haven't done anything wrong.

      They entered into a business to business contract (attached) to advertise on an interactive touch screen in the window of *************************************. 

      The contract clearly ****** that the contract is none cancelable directly above where **** signed the Agreement, it also clearly states this in the terms and conditions. The contract also clearly states there is a lead in time of 12 weeks to set the project up. 

      Their artwork was being sorted out and due to the Christmas holidays the ************* was very busy and we know the owner was keen to work with and promote **** and her Son as promised.  

      To be honest and from looking at the communications, we don't think **** and her Son can afford the advertising which they signed for and this is why they have tried to cancel and involved the BBB. 

      We don't want companies involved in the project whom are undependable, so we have emailed **** to say they will be refunded their deposit and any instalments made and they will be removed forthwith from the Project to promote their services to people looking to buy a new property through the real estate office.

      I hope this is the end of the matter and we feel it is a shame that companies whom enter into legal binding contracts, feel they can use your services to try and damage our companies good name for no other reason than buyer remorse. 

      Please can you let me know, if there is a mechanism within the BBB to complain about companies like NuVision Home Improvement LLC, so other companies like ours don't waste hundreds of dollars and hours of time with someone whom lacks an understanding of their business commitments.

      Dear BBB, whom may concern, I am writing to file a formal complaint against Premier Media Solutions for their unethical business practices and misrepresentation in the advertising contract I signed with them on February 1, 2023. I believe it is important to warn others about the deceptive conduct and lack of fulfillment of their promises. On the aforementioned date, I entered into a contract with Wesley Smith, a representative of Premier Media Solutions, for a two-year advertisement service at the Livermore and Pleasanton real estate locations. The contract was for the installation of two touch screen displays at these locations to promote my business. Premier Media Solutions proceeded to charge my account $2,500 each month for four consecutive months from February to May, totaling $7500. However, several issues have arisen with their services that have led me to dispute the charge for May, which is currently under review. My primary concerns are as follows: 1.Non-Fulfillment of Promised Services: The Pleasanton location has not received any advertising as promised, despite numerous inquiries and emails sent to the company regarding its status. The Livermore location received a non-touch screen display, significantly different from what was initially agreed upon. Additionally, the promised ribbon-cutting party, social events, and the opportunity to meet other agents were not provided. 2.Lack of Communication and Transparency: Throughout this ordeal, I have sent countless emails seeking clarity on the status of the Pleasanton location and the reasons behind the non-touch screen installation at Livermore. Unfortunately, the company has been unresponsive and evasive in their replies. 3.Misrepresentation and False Claims: Premier Media Solutions misrepresented their abilities and services during the initial contract discussions, leading to false expectations and dissatisfaction. As a result of these issues, I have been severely disappointed by the services provided by Premier Media Solutions. Their lack of professionalism, breach of contract, and unwillingness to address my concerns have left me with no choice but to seek resolution through this complaint. I kindly request the BBB to intervene and investigate this matter thoroughly. I urge you to give this complaint the utmost attention, as I believe it is crucial to protect other consumers from falling victim to the corrupt and deceptive practices of Premier Media Solutions. I would appreciate your assistance in facilitating a resolution to this matter promptly. My desired outcome is to receive a full refund of the $7500paid to Premier Media Solutions, as they have failed to fulfill their contractual obligations and misrepresented their services. Have them flagged as a unethical business practice. I would also like to warn other consumers about the risks associated with engaging in business with Premier Media Solutions.       Hello BBB, firstly we are surprised and very concerned that ******* ************ have gone down this path as we are in the process of corresponding with their Lawyer, which was instigated by ******* ************ and we see this complaint as nothing more than an attempt to try and influence the legal process. I will be writing to ******* ************s lawyers tomorrow on this matter. 

      I strongly suggest this complaint process is put on hold until the legal position has been sorted out. ******* ************ also owe Premier Media Solutions $2,500 and until the legal position has been resolved, we believe the BBB would be wrong to publish any of the information.

      For the record, ******* ************ signed a legally binding business to business agreement (attached) to advertise on two touch screen systems in the windows of ****** *** ***** in Pleasanton & Livermore. We arranged to install the touch screen systems with ****** *** with the Livermore one being installed in goodtime. We found a problem when we went to install the Pleasanton office as the window glass was unsuitable. This has now been resolved and the touch screen system has been installed. The advertising agreement is very clear that "time is not of the essence" in regards to the installation, which ******* ************ agreed too. The Agreement also says that the advertising term doesn't start until the touch screens are installed. So ******* ************ has not lost any advertising time. 

      In fact, we have offered ******* ************ a $2,500 refund and an added 6 months to their advertising term, which I want to be clear is by no way a admission of fault or breach of contract. ******* ************ have not even tried to reach any mutual resolution, which makes us believe this is nothing more than buyers remorse and a cynical attempt to break a legally binding agreement.

      In fact it is ******* ************ who have now breach the contract and once we have finished with their lawyer, we will be using the law to reclaim what we are owned. 

      As I have already mentioned, this matter should be put on hold until the lawyers have finished. We will not be happy if any untruths are published under these circumstances.
