      1. No running water on the site when the concrete was being poured that resulted in bad foundation in many places. 2. Horrific carpentry work - nails that went into wood never touched another piece of wood that it was to be secure to. 3. NO insultation between the floors or the walls as it was described to us to have insultation. 4. Water in-between the walls once they were up due to a flood caused by one of the contractors from the 2nd floor shower into the in-law suites - never dried appropriately. 5. Mold/water that had gathered around the elevator shaft that is due to the foundation no being poured properly. 6. Water again flooding in from the roof. Three times water flooded the in-law suites due to the shabby workmanship on the contractors that put in a wall on the 2nd floor balcony, and the roofers. 7. Balcony tiles are popping off for the 3rd time and now we are being told they will not honor the 1 year warranty. Home was finished on 6/30/22 and we could not even move in until October due to the work not being completed. We have been told that the builder - Florida Green Construction bypassed a very important step which was to put down cement board before the tiles were put down hence why they keep popping up and water is gathering underneath - have been told by the builder they will not be fixing this. I want to add they had fixed this 2 times before we actually moved in. 8. Oversized driveway put in without being asked about the upcharge/additional cost to us the owners - resulting in a $7000 fee. 9. Was given an upcharge of $3500 for a 2nd builder's risk policy because they did not finish the build during the first policy - I was never informed of the 2nd builder's risk policy charge to me. 10. Never delivered the doors that were ordered but told they are beautiful from the builder. 11. We as the owners put out over $20,000 in our own appliances, fixtures, toilets, tile, backsplash and never given any credit on such building supplies.

      The following is answers to BBB claim *********
      1. The running water situation had no bearing on the foundations. The company installing was ************* **** ********, and they did have a small area where the surface was rough by the garage porch, however, this has nothing to do with the foundation.
      2. The second statement is not accurate as well. The area mentioned was by the fascia area, and as explained to the homeowner, the fascia board was installed straight and level. The fascia board was short of truss ends, and as standard building principles, we installed 2x4s sistered to trusses and extended to the level fascia board, and refastened the fascia.
      3. The homeowner has an *** home, and all exterior walls are R-24 insulated. The underneath floors are sprayed with open-cell spray foam for sound deadening as per plans and inspected by County inspectors before drywall is installed. The roof is also sprayed with open-cell spray foam per plans. The insulation was also inspected by the Florida Green Building Coalition and approved.
      4. The drain pan on the shower developed a leak that allowed water to empty from the pan. The amount of water was minimal as the pan was not filled completely, it was there to warn us of a leak. The homeowners can do a mold test to verify. However, they were there daily and saw it for themselves.
      5. The elevator shaft was open to weather during the construction process, with nothing to do with the stated reasons. The shaft was dried and cleared after drying in the home as the normal building process.
      6. Water did indeed flood from the sub-wall on the second floor to the first floor. The leak came from around the flashing. The leak was repaired and held no further problem until the hurricane damaged the protective cap. The repair was done immediately after the hurricane and has not been an issue since.
      7. “Protecto Deck” waterproofing membrane was used according to their specifications (see attachment). Per their specifications, the fabric top coating makes an excellent bonding surface for latex-modified thin-set mortars and allows for immediate installation of the tile and stone.
      The homeowner was told to place the remaining $13,000 monies owed to Florida Green Construction into an escrow account, and the contractor would repair the tile.
      8. The driveway was priced and built per contract terms.
      9. Due to all building issues during this timeframe, such as COVID, material shortages, and labor shortages, construction ran longer than anticipated, resulting in extending the insurance policy. Florida Green Construction split the cost for Builders Risk Insurance with the owner.
      10. No response.
      11. The contract specification sheet clearly stated the allowances for appliances and other items. All applicable allowances are given in the attached signed addendum sheet. Upgrades to the contract are the homeowner's responsibility.
      The homeowner was in a serious situation with the bank regarding interest increases, and we worked very hard to meet the bank deadlines to avoid increased fees for them. We strived to make them happy, and until I told them to place the remaining money in escrow, we were working together.
      If homeowners are serious about a refund, we would be very interested in returning their money and FGC taking ownership of the home and property. We are well aware of the high standards followed in constructing this home, so please, let us know if this were how they would like to proceed.

      I am rejecting this response because:

      1.  Florida Green Construction has not done their part to repair some of the shabby work that has continuously been happening over and over.  Such as the tiles on the 2 balconies.   No Cement board was placed under the tiles hence why this is the 3rd time they have popped up and holding water underneath the popped up one and the grout has popped out as well.  When you place tile on wood (even with a membrain) wood expands with the weather - hence why we have had this issue now for the 3rd time.

      2.  We were never consulted on the oversized driveway at any point prior to them pouring the cement and giving us the bill on the day of closing with the bank.  This project was delayed due to Florida Green Construction.  From the time we closed on the construciton loan it was just about 3.5 months before they cleared the land or applied for a permit - hence them being behind - hence them needing ANOTHER builder's risk insurance policy.

      3.  The day of closing with the bank converting our construction loan to a convential loan - we were DEMANDED TO PAY Florida Green Construction almost $10,000 or they would not give the bank our Certificste of Occupancy.   They even wrote the bank an email telling them to not close on our loan.  Just for the record - we sat with them many times asking if they would make the deadline - they assured us they would but not without complete stress on our part and us doing work in the midst of construction to ensure the CO was granted.  We have never had our home professionally cleaned, the stairs are popping out, tiles on the balconies are popped off, missing grout on the balconies, A/C has whats called "dirty sock" smell -= that covers the entire home with an awful smell that would make you puke.  I'm spending tons of money on air freshners to help mask the smell - it's embarassing to have anyone over to this brand new home due to the smell once you open the front doors.   Speaking of the front doors they are covered with overspray from the painters and just left that way even as much as I was told the front doors that I perferred where "beautiful" and how beautiful they are going to look on the house - still have yet to be given to us.  So now we are stuck with ALL DOORS in the home that we did not choose and to top it off their is blue house paint sprayed on them.  Once again no professioanl cleaning or walk through.  

      3.  My husband and I have been caulking and painting the balconies - due to the lack of interest in the painters who stated themselves to us - "good luck on getting your home completed by FGC".  There are so many spots that are just not painted for what reason?  

      4.  Why would I put $13,000 in escrow if they home is supposed to be under warranty.  So, they are not honoring their warranty with this home. 

      5. There is NO extra installation on the exterior walls of this home, yes there is spray foam in the attic but not on the exterior walls of this home or inbetween the walls/floors.

      5. I'm requesting a refund for the oversized driveway $7,000 and $3400 for the extra Builder's Risk Policy that was only due to them not working on our home in the 12-month timeframe that the 1st policy was to cover.

      6.  I requested a bench in the shower - NO bench

      7.  We had given FGC the measurements of my husband's truck many times over and - guess what:  Truck DOES NOT FIT IN THE GARAGE!

      With the funds I can hire a professional tile contractor, carpenter and painter to fix the balconies, stairs and finish the painting of this home.
