In 2014 my son filed for a lawsuit against Xarelto. This medication caused me to become paralysed in 2013 after a blood vessel burst in my spine. I constantly was told I had to send my medical records etc for the lawsuit. In 2022 I was told that the suit was settled. I was also informed that I would have to reimburse Medicare and Tricare the military insurance with my portion of the reward. The check I received was very minimal not even even enough to cover my caregivers that I have to pay for myself. This law firm got a huge settlement from the pharmaceutical company and I got peanuts. ( minimal money ) I feel that I was taken advantage of and the lawyers got rich on my behalf. I’m 86 years old and in poor health and feel totally ripped off.Initial Complaint

I hired AWKO to represent me in a class action lawsuit against 3M. They have targeted and taken advantage of hundreds of veterans, myself included. They received the settlement money on 15 July. They are now telling me that they will not release the funds for an additional 60-90 days. I spoke with them in May and they told me the money would be released 60 days after that day. Now that the funds have been released they are just sitting in their account collecting interest off the backs of Combat Veterans. To me, this is absolutely disgusting and poor taste.Initial Complaint

Aylstock, Witkin, Kreis & Overholtz, PLLC were put on a retainer for the 3m earplug case. I have been downgraded more then one time. They have been giving me different story's about that if in fact I can get a hold of them. My settlement should be at least at the 17k mark. I have provided all documentation that they asked for. They gave me 5k Of that I got 1932.53 they held back 500.00 plus charged me for co pat. What I signed was they get 40%. I asked for a copy of the contract. They say they sent it. I informed them that I should have got 17 some odd k. They asked stridently where I saw that. Is there any way to check what I actually have been awarded. At this point they have said so many things. I don't know if they work for me. Or the 3m company. I brought up my concerns up every time that I could actually get a hold of some one.they asked If I wanted to appeal I said yes. My husband has been waiting for his 3m settlement for a long time now. While most have been paid, they have yet to pay my husband. They are near impossible to get ahold of and have been making tons of excuses and delays as to why he has yet to be paid. After doing more research on various reviews as well as a Reddit forum about this law firm, I am very disappointed and angry that many other veterans represented by this Law Firm has yet to be paid as well. Our veterans have endured so much fighting for this country. Many have been suffering from both psychological and physical damage. What is shocking is that 98% of settlement money has been paid as of July 12, 2024 while many of the veterans represented by this Aylstock, Witkin, Kreis & Overholtz, PLLC have not received their money. On their website, they state PLLC fights for the rights of people throughout the United States who are seriously injured by the carelessness of others and/or by defective products, drugs and medical devices. So why are they not paying out these veterans that have been seriously injured from the defective 3m earplugs? Why is there carelessness on their part? The money is there. Why is it not distributed? Why is that 98% of veterans have been paid out from the 3m settlement and many like my husband have not been paid out by this law firm. What is the hold up? Where is the money? Many of these veterans rely on this money. They are not rich like these lawyers. They have given up so much. When many of these veterans come back from war, they are not the same. My husband had many friends die from suicide being unable to cope from their tours. My husband has been suffering from tinnitus and having hearing loss like many other veterans. I hope they will do what is right and pay the remaining 2% of to the veterans that they represent as there is a lot of complaints already about how they are handling this.Initial Complaint

This business is responsible for distributing money awarded through the 3M earplug lawsuit. After waiting months and months for my money, I get a document in my email showing the awarded amount and about 75% of the amount deducted for various reasons with no explanation. I tried multiple times to contact this business, but I never get a response. I cannot agree to accept a check that has money deducted without any explanation.Initial Complaint

I have hired another law firm to represent me in the talcum powder suit against Johnson &Johnson. I have never signed any agreements or other documents with the Aystock firm. Nevertheless, for the last year they have pretended that I am a client and have bombarded me with correspondence, emails and telephone calls requesting that I sign over my medical records to them. I told one lawyer on the phone that I considered this behavior unethical, and he agreed. I would like to file a complaint against them with the Bar Association but haven't been able to do so. I have deleted their emails, thrown away the letters I receive from them in the mail and don't answer their phone calls. Today I received a letter from them dated June 20, 2024, asking for support of the present settlement agreement and refuting accusations made by other law firms that they are accepting third-party money. I am involved in a MDL that has been settled. I have been in contact and funds have been released from Brown and Greer. One moment I am told DISTRIBUTION STATEMENT will come 60 days after filling out Final Award Notice. I have been told it will be 60-90Days after Funds were sent to the Attorney. Funds have been sent. I have been told Lein check has been completed and my info is in Accounting. In a little over a Month the next group will be receiving funds. There is someone 30,000 or so numbers after me who has been paid. I feel the Lawfirm was trying to Save money by not ledgering and doing it themselves. I was my DISTRIBUTION STATEMENT comprised and Sent to me as soon as possible. I have left a review and I am willing to remove. However, service by people and email has been okay. I hired AWKO to represent me in the 3M lawsuit. The judge said we would be paid FIFO. My FIFO number is 33,xxx and I have not received a distribution statement. This law firm opted out of ledgering by the settlement administrator. Initially they said we would get DS 30-60 days from us signing a supplemental form. Now it is 60-90 days. I have been expecting this settlement since I need some medical work done that my insurance doesn’t cover at 100%. Also according to the combat arms settlement website I should have been paid 4/15 which was the wave 2. We are approaching wave 3. Many people with higher FIFO numbers have been paid who ledgered with Brown and Greer, the settlement administrator.Initial Complaint

Signed up with AWKO for a case against 3m for faulty earplugs resulting in the injuries of several military veterans. They were great initially, they call and email daily when you first show interest in using their firm, then the communication slows down to almost nothing and when they do communicate it’s nothing but lies. They recently emailed a FAQ video out to their clients on May 14th or 15th where they claim that they send distribution statements within 2 weeks tops of receiving the settlement funds, and stated they had not received any funds from the settlement administrator from the April 15th deposit yet, but the settlement administrator has confirmed with me that my funds were sent to AWKO on May 1st, it’s been 30 days and still no distribution statement. AWKO also claimed on the video that the process for getting funds to clients took roughly 4 weeks, possibly and hopefully less once the funds arrived, but that is not the case either. AWKO needs to answer messages on their CaseLocker, reply to emails and distribute more accurate information instead of an email full of lies.Initial Complaint

After completing all the required forms and documents for the 3M settlement with AWKO I have been given quite a bit of run around. The communication with the firm is very poor and should be a little better than what they are providing to myself as well as other veterans. The information they provide to you is different from what you can research and definitely different from what is listed within your account on the Combat Arms Earplugs Settlement website. The website provides all things that you may need to know in reference to your claim/case but then you login to your Caselocker account and information is misleading. According to BrownGreer funds were paid to AWKO EPP Initial payment issued 5/8/2024 in the amount of $14,560.00, Common Benefit Fund issued 5/8/2024 in the amount of $1440.00. Also states that the earliest payment date is 4/15/2024. I have not received anything from AWKO. When I messaged them asking for an update I am provided with a generic response. I was told I would receive my distribution statement 30 - 60 days after signing the Medicaid forms, I did that on 4/5/2024. I certainly understand patience is needed however this is a bit absurd and veterans like myself can certainly utilize the funds and honestly the communication could be a bit better. There are groups in all social media stating negative things such as the firms are holding onto the monies to gain interest and etc. Please assist, because how long does it really take to create and email/upload a document for one to complete and sign.
