      Good morning,

      I have attached all communication/prior responses for the previous failed attempts that **************** has made with the county and state as well as his signed contract, which is the only thing that he signed, so as to not continue to give my sanity in this matter. This should cover any questions or concerns that **************** stated in this complaint although he is also adding more on to his story with every complaint that he makes, I'm assuming to make his process more complete.  Also, to make note of my "final response" regarding my crew not using the pressure pump, which they did, **************** was informed that if he could produce the video that he swore that he had of them doing the job from start to finish without using the pump that I would issue him a refund but he was unable to do so and neither the county or I ever received a response after that was requested. I also have text messages between **************** and I but it goes above the maximum amount allowed so I did not attach them but can send them if required.

      I also want to inform you that **************** was sent a cease-and-desist letter by my attorney in May so this will be forwarded to them as well so that we can put an end to this.

      I am rejecting this response because: David is simply lying about this as a pump was never used. This is a flat out lie and I will pursue this until I get a full refund. I did not sign an agreement for a dry-hole charge I was tricked into signing a terms of agreement.

      I will no longer be responding to ****************, anything further will be forwarded to my attorney. His slander, baseless accusations and inability to have a educated conversation are proving that this will just keep going. I will not keep repeating the same thing to every  resource that he goes through because he is not accepting of the fact that his ***** simply did not work. I had hours and overhead put into his job which is the purpose of the dry hole charge, that was not only in the terms and conditions that he signed but also mentioned verbally multiple times through our over extended original encounter when the bid for the job was given.       I am rejecting this response because: His response are lies, I did not sign an a agreement to any dry hole charge and it was never discussed. He tricked me by having me sign a terms of agreement only not an invoice with any dry hole charge. David added in the invoice at a later date. Also David is lying about his workers using a pump as his workers did not. David was not here on the job site at all other then to ask me for $****** for a deep well. I never received the service I paid for. The attempts by his lazy and incompetent workers to dig me a shallow well are not valid and the proper equipment was not used. This was a scam from the start to hit me up with a ******. deep well.  Other homes in my area have shallow *****. Davids own parents and his own brother (who are well drillers) were contacted to help me and David sent them a  "Cease And Desist Letter" to prevent them from helping me.

      In March I hired David Pruitt Well and Pump to put in a well/pump system to run my irrigation. I paid the first half due to schedule for March 31 9/9:30 am. March 31, I called David about 11a as they had not arrived. He stated he was at an emergency and hadn't been able to call. He stated he'd call the next morning. April 1, I called David about 1p as I had not heard from him. He stated that his wife went into labor early in the morning and he hadn't been able to call. He stated they would be here Monday, April 4. They arrived in the afternoon and spent three days drilling wells. When they hooked up my irrigation and ran it for about 30 seconds each zone, one of the zones wouldn't turn off. His team stated to let it run to get the air out and it would shut off. After 2 hours I called and they came back and got it shut off. This occurred the next day as well. David and team came back again, got them to shut off and informed me that I should replace the diaphragms. I paid the second payment for the well/pump. 19 days later while the system was running water stopped and the pump sounded distressed. The timeline is in the attached email. I still don't have a functioning well to run my irrigation system. I disputed the second half of payment since David had multiple no show/no calls to repair. June 17 he called me to question the dispute. I let him know that he left me no alternative since he does not show when he states he will, and that water for less than three weeks is not ok. He stated he would arrive June 21 to check my system. June 21 he apologized and stated it was an issue with the well. He/team were not able to stay to work on them. June 28 he stated I needed a deep well. Yet there are shallow wells throughout my neighborhood. July 5 I received a call from a Sheriff's Deputy Lostraglio stating my CC dispute is a felony but my CC company states it is not a felony to dispute the charge & they are waiting for David Pruitt to respond to their inquiry.

      Business Response /* (1000, 6, 2022/07/11) */ Unfortunately, only a portion of the customers statement is true. The wells and pump that were drilled and installed worked perfectly fine when installed, it was the customers irrigation system that was causing issues. I also worked a full day helping to repair the parts of her irrigation system that I can without charging her and did tell her that she needed to have a professional irrigation specialist come out and fix what I was unable to. The customer did not do so and continued to try to fix them with the help of her neighbor. My crew was sent out on a day that I told her we would be there and she was not home, when they came by her irrigation system was running without issue. Shortly after she reached out again to state she was having issues, I did tell her that we were 4-6 weeks out on repairs and jobs but that I would get to her as soon as possible never giving her a date as I had other customers waiting prior. A week after that conversation I received the credit card dispute and I reached out to her where she admitted she did not ever call another well company or irrigation company to come out and instead continued to try to repair things on her own for her irrigation system. Regardless of that when she made her final payment the system was up and running and the well was pumping beautifully with ample water, the only issue was her existing irrigation system, that is why she submitted her final payment. The customer admitted that she continued to run her irrigation system with the flaws which was causing the pump to not shut off and draining water from the well and not giving it time to replenish, that is the only issue with the well that I told her there was when I came back to inspect after her fraudulent credit card dispute. During that visit she had a neighbor at her home brandishing a fire arm and threatening myself and my crew and refusing to inform us of who she is even though she had a badge on as well. Customer called SWFWM to have them come inspect my work and they have not been by to do so as of yet but after I spoke to them as well and they reiterated that by Florida state law I am not legally allowed to guarantee quality or quantity of water and there was an above average amount needed to run her irrigation system when the well was installed. I did tell her that if she was going to continue to run her system in that manner without giving the aquifer time to replenish instead of fixing her irrigation that she would need to drill a deep well unfortunately I am not willing to continue to work for her after being berated, lied to, lied about, stolen from and threatened multiple times. Yes, there was water from the wells but everything did not work perfectly from the beginning. When my sprinklers would not shut off and they worked on them, I thought there was a problem with the installation as I'd not had any issues with my irrigation system prior to their installation. It was after they worked on them (less than 2 hrs) that he informed me that it was irrigation issues. He could have informed me before working on the system that he did not install rather than after. My neighbor that replaced the solenoids is a professional electrician. Perfectly capable of replacing the electrical component without issue. However, that did not correct the issue and an irrigation specialist did come out to replace the entire valves. I was provided three separate dates they would arrive and made sure to be home all day only to have a no show and no call. If his team stopped by when I was not at home, then it was not one of those three days. I did not receive a call to state they were there and could not check anything since I wasn't home. David never stated he was 4-6 weeks out for repairs. At one point he stated he was 3 weeks out but he provided three dates and didn't show on those dates. After the third no show, no call on June 7th, I disputed the credit card charge as is within my consumer rights for contractor's subpar work. I'd been waiting since April 28th for work on my wells, it'd been long enough for him to make time in his schedule to see what he could do about getting water running. A reputable contractor would not feel good about having a job not last three weeks. My neighbor who was present at the inspection on June 21st was here as I'd informed David I did not feel safe in his presence. She was dressed for work, which includes her badge and firearm. At no point did she brandish her firearm, it remained holstered the entire time. She did not identify her employer as she was not at my house in an official work capacity. She was there to make me feel safe while David was present and to witness his inspection and the results in which David stated was an issue with the lines and that he would return to work on them. If at this time he determined it to be an irrigation issue, why would he schedule another appointment for June 28th to work on my wells? SWFWM did come by to inspect the work. They can only do a visual of the connections above ground so they could not see the actual wells drilled and the completion report had not been submitted, more than two months after completion. Nikki at SWFWM recommended drilling five foot deeper. David is correct in that he will not be at my property again. He was condescending and has lied in his response. Never have I stolen or threatened him in any way. David, on the other hand had his sheriff deputy friend call me to intimidate me further.

      Initial contact with this proprietor was in March 2020. On April 24, 2020, David sent me an invoice (#108) for a Well installation, total $2878.30. The Pandemic hit & David did not respond to me even after several attempts on my part. I actually thought he had succumbed to COVID disease. In May 2021, we connected again & also discovered that I needed a Deep Well. David sent me an invoice for $7350.00 with 1/2 deposit due. I sent him a check dated 4 May 2021 for $3675.00 & work was to begin w/in 90 days. David has sent me multiple excuses why he could not start the installation. In October 2021, I sent a request to stop & return my deposit as my mother was ill & I had to make arrangements for her. David did not respond in a timely matter; I managed to work something out for my mother, fortunately. Work has still not begun as of March 2022. I sent an email to David to cease the work order & requested my deposit money ($3675.00). I gave him 2 weeks to respond but he hasn't. I'm on a pension; I am a retired Army soldier. I cannot afford to lose money based on David's mismanagement of his business.

      Business Response /* (1000, 7, 2022/05/09) */ Unfortunately due to multiple machine breakdowns beyond my control and the inability to get parts in a timely manner due to Covid, as many businesses are struggling with the same problem, I am behind on my deep well jobs and trying my best to get caught up and keep customers informed as much as I'm able. After not hearing back from the only parts company that can provide parts for my deep well rig for 3 months it has put myself and my customers in an unfortunate position that I am trying to make up for. In this particular instance not only have I had to reschedule because of that but the customer has also had to reschedule because of personal reasons multiple times and our combined timing put us in an unfortunate position. The customer has been refunded as I informed her I would upon her final response. Unfortunately our communication was lacking as the customer did not contact me by telephone but strictly through email and I rarely use email as all my business communication is done by phone and in person so my responses aren't as timely as we would have liked to get this matter resolved in a better and more efficient manner. I understand the frustration and have apologized for the timing and inconvenience as well as returning the customers deposit.
