I had put an offer on a car at Drive Oz in *******. At the same time, they had a jewelry store in the dealership & had mentioned that I had a few loose stones that I had appraised and he said he said he would love to look at them to sell them. He also asked me if I had any gold to sell. I told him I was offered $3,700, he looked at them in a loop and told me he could get more for sure. He agreed to sell them for $250-$300. He said he would have an answer for me the next day he would take them to the dealer.The same day I put a refundable $1,000 on a 2023 Tesla model X plaid. I had already been approved for the loan. Once down payment was made, communication became difficult. I was unsure if there were other buyers or if I was buying the car because he had offered to split the difference if he was able to sell the car at a higher price. A lot happened that made me uncomfortable with the deal, but mostly that nothing was lining up. I was worried I had not yet received the money for the diamonds, he already said he had a deal from the dealer, but in the conversation he guaranteed me $4,000 and said he was sending them to a lab in *** to see if he could get even more. I gave him the diamonds June 1st. it's June 12th. He has made 5 different promises, each time stringing me along with an excuse. For that reason I made a point to put our agreement in text. I cancelled the order on the Tesla, due to health issues & not feeling comfortable. I was given several dates & then no communication and then excuses and more time. When I got upset after the 5th time being strung along, ******* blew up and told me to come pick up the diamonds, then that they weren't there yet and I could pick up tomorrow. He started changing the story making it seem like I was dishonest, which was completely out of left field. I want the $4,000 promised, I am not comfortable taking back loose diamonds that have been out of my hands for weeks & don't believe they are in ***.Business response

This person is requesting a refund. My question is a refund of what? her refund for her vehicle was refunded. Then she asked me for a favor and said can you sell my diamonds for me, I said sure. I think you can get around 4k. I will check with my friend and see how much he wants to pay. I take it to him and he says its a treated lab grown stone and is not worth that much. She then tells me theres no way. I said ok, the other option is to send it to NY to my other friend that has the machine to test it. I do that and he sends it back saying it is treated as well. I call her to tell her that they both said the same thing and she can come pick Up her stone. She then lashes out at me saying that I promised her 4k for the stones???? I dont buy diamonds. I am a car dealership. She simply asked me for help and I helped. In return she tries to use the BBB to strong arm me to purchase her treated stones. This is completely fraudulent.

I am rejecting this response because: His response is all false, he does not have a car dealership he is a broker similar to a **** shop who literally has a jewelry store inside his business. I had other offers and appraisals for the diamonds that same day, thats why I had them with me, he was charging me for the service to sell them. He was also begging me to please use him to wrap the car and also to sell my Porsche.
Right after I gave him the diamonds he texted me that he was at his diamond dealer and he could guarantee me $4,000, but he wanted to send the stones to his guy in *** because he thinks he can get even more (texted showing this). The color treated comment came out of left field the day I filed this complaint. He told me that he was waiting for them to pay him and he would zelle or wire me the money (also in text).
There has been some red flags and no receipts to show that he sent the diamonds to ***. Had he not guaranteed me at least $4,000, I would have never agreed to let him mail my diamonds out of state. There a multiple texts where I confirmed that he guaranteed me $4,000 and he agreed and until I demanded what he promised, there was not one issue. There are weeks of texts, not one until I filed this complaint about his claim that I failed to tell him they were color treated. For clarification, IF the diamonds are actually color treated, they are worth about $4,000, if they were not color treated, they would be worth even more, so that claim from him is misleading.
There are red flags all over the internet on this company including BBB. Everything from failed promises, falsified education, lashing out at customers, and lying about his company earnings. He has made constant excuses of why he didnt call for days when he said he would such as, we are closed on Sundays, my father is in the hospital and even now on this claim hes stating that he hasnt answered because he has been sick.
I am filing this complaint to protect myself from fraud, from switching my diamonds or from saying they were lost in shipping, or the chance that he doesnt my property. While it makes sense for him to make $300 and just Zelle me the money as promised, I am fine with this in writing and one of the options below.
I will accept one of these options:
1.) He mails the stones to me (insured with a tracking number) at his cost, I can take the stones back to one of the dealers that appraised the stones the day I gave them to him and verify that they are the same stones.
2.) He Zelles me $3,700 which is the $4,000 promised less his $300 broker fee quoted. Local jewelry stores with labs did appraisals and offered $3,800 or a trade-in value of $4,800, this is well within an acceptable solution and will end this amicably.Business response

First off. I am a licensed car dealer with a dealership. Like I mentioned time after time. I can send her back her stones and she can go and check to see that it is the same stones. I simply tried to do a favor. She can have back her stones. They will be sent to her tomorrow.Customer response

I’ve been bamboozled. I was told from ***** ****** (financial advisor) in order for the car deal to go through with ******** I would have to sell my 2019 Honda Accord to ******. Their company predicted once my vehicle would be sold to ****** the remaining cash refund will be $4400. That totals a cash down payment of $8000. I’ve requested of proof from Drive Oz of me having to sell my vehicle in writing from ******** and I haven’t received it as of yet. What they sent was a copy of trade-in information without my name nor ******** financial stating I have to sell/trade-in my vehicle. Back on December 29,2021 at approximately 10:30am ****** ********* (Sales person) DM’s me (instagram) pictures of an Audi Q5 Premium VIN:***************** this particular vehicle shows a moonroof along with a backup camera. He also send a copy of the CARFAX report. In the CARFAX report it stated the vehicle was last owned in Florida. I then asked him is this vehicle a basic model? He stated NO! Therefore, I proceeded to go on with the deal. ****** then sent me more pictures of the what I thought was the same vehicle that same evening. Never once I was told a different would be coming instead. There was no more information about the Audi Q5. On January 5, 2022 I received a call from ****** stating we have the car. My down CASH payment is $3600. I never agreed to a cash down payment of $3600. My agreement was $3000. Once again I wasn’t notified of my down payment has been changed. The monies was given because I trusted my little cousin. When the vehicle arrived on Jan. 13, 2022 I noticed it wasn’t the same vehicle based on the pictures and CARFAX report sent from Carson. ******** financial called to go over my information and I stated to them I put down $3600 down and the rest was coming from me selling me car. ***** text me stating I must call the lender back and say I put 8000 cash down and not 3600. I am requesting my down payment back and for Drive Oz to come for vehicle.Business response

Ms. ******* came into our dealership in December interested in an Audi Q5 that we had in inventory. Once we took the application for the vehicle based on her personal credit history we were not able to get it approved. We advised her that we could not get it approved on that vehicle, but that we would locate her another Q5. We purchased the vehicle from the Auction directly for her and sent her the same pictures of the vehicle that we received. We offered her 2 options - We could take her vehicle as a trade in, and she would need to pay for transport (approximately $550.00) to get her Honda back to Florida, or she could sell it on her own, and send us the difference. She chose the latter option, and we shipped the vehicle directly from the auction. Once the vehicle arrived she stated there was no gas and it had not been cleaned. I advised the customer that they can not transport the vehicle with gasoline in it, and to send me the receipts and we'll take care of it. Once it was washed, there were a couple of cosmetic issues that were not seen in the pictures, we advised her to get a quote and we would assist. The time comes that the customer is to sell her vehicle, and the prior dealership that finalised her loan had not finished the title paperwork, so the vehicle was not able to be sold. We advised the customer we would assist with getting the title transferred with the other dealership. I communicated with said dealership and got the title transferred into her name. Once the title was transferred instead of selling the vehicle, she traded it into another dealership for a 2019 BMW X3. After this she called us demanding us to fix the cosmetic issues. We advised the customer we would handle it and just to deduct the cost from the balance owed so she would not have to wait for a check. The customer then stated she wanted a refund and that we needed to come pick up the vehicle. In the State of Florida, there is no cooling off period for vehicle purchases. We advised her that the loan had been finalised, and that we would not be issuing any refunds. She stated she wanted proof that she needed to trade/sell her vehicle. We sent her 2 different internal documents from the lender that we are not required to show customers stating that she was not eligible for 2 auto loans. It was at this point we figured out that the reason she was refusing to pay us the balance owed was because she no longer had the Honda Accord in her possession. We've given the customer multiple opportunities to rectify the situation and make both parties happy, but she has refused to be comply. The customer purchased the vehicle and has had it in her possession for 45 days, no refund will be issued.Business response

Drive Oz Motors purchased the vehicle from the auction for the sole purpose of providing said customer with an Audi Q5 like she requested. In order to save the customer money on transportation we shipped it directly to her. The auction did inspect the vehicle for cosmetic and mechanical issues, but things such as manufacturer recommended services are not included in this inspection, since it is a USED vehicle. I've attached a copy of the report stating that the vehicle was in sound mechanical and physical condition. Also per Florida law Florida has no “cooling off” period or other specified time within which a buyer may voluntarily and unilaterally return the vehicle free of penalty and cancel the sales agreement in typical transactions. We have since cancelled the agreement with the lender for this transaction, and offered a remedy to the customer regarding surrendering the vehicle and refunding the customer her downpayment minus usage, miles, and transportation cost but the customer has refused to be reasonable in her demands.Customer response

I am rejecting this response because: As stated in my last comment on 3/3/2022 “Therefore, this account is also under investigation with the lender”. The auto loan account was very active until 3/8/2022 because Drive Oz Motors paid off the loan with ******** Financial due to the downpayment discrepancy. Drive Oz couldn’t produce any documents showing proof in regards about this writer having to sell/trade-in vehicle. At this time I, Tashana ******* is requesting my full refund of $3,600.00. I’ve attach proof of my downpayment along with the original contract. Once this writer receive full refund Drive Oz Motors is more then welcome to pick up the 2018 Audi Q5.
