The eye of hurricane *** went over my house when the storm made landfall in *****************. Peoples *********************** contracted with Turnkey roofing out of ********* *******. After Turnkey Roofing removed the old shingles from my roof I had my own inspector go on the roof documenting area of rotted wood and nailing that did not meet the county code. I asked ******* to correct the problem before they re-shingled the roof. Turnkey roofing did not know I had taken many pictures with a tape measure documenting the roof. A contractor signed an affidavit stating he inspected the roof and it passed code. When I called Turnkey roofing the site manager said the roof had been inspected by the county and passed. My response was that No the county does not inspect the roof before the shingles are put on. The county requires the contractor to sign an affidavit under penalty of perjury that the Roof meets county code. I urge everybody to inquire what your county code is for roofing nails and then check a small part of your roof to make sure That Peoples Trust/ Turnkey Roofing has actually repaired the roof to county code. Then check their affidavit filed an affidavit with the county stating that the roof meets county code when it may not. I live in ************************.

Peoples *************** (PTI)appreciates the time and effort spent by *********************** (Insured) in raising his concerns to the Department. PTI thoroughly reviewed the claim in connection with the allegations raised in the Service Request and, at this time, denies any wrongdoing.

By way of background, PTI accepted coverage for the reported loss and invoked its election to repair through the use of its preferred contractor, Rapid Response Team, LLC (RRT). Subsequently, RRT engaged a subcontractor, Turnkey, for the roofing portion of the repairs. While in the process of replacing the roof,Turnkey was on the roof when the tenant went up on the roof and was asked to get off the roof in light of safety concerns. At that point, the tenant returned to the ground and let his dog out who then bit one of the roofers. For that reason, ******* covered the disputed portion of the roof in a hurry and pending return to the home contingent upon removal and/or securing of the dog.

In short, the photographs taken by the Insured depicting wood rot and spacing of the nails that is not up to code are of an area not replaced at the time of the initial dry in because Turnkey wanted to make sure the roof was sealed before they left due to the dog incident. Following the incident, the Insured was advised that all the wood that needed to be replaced during the repairs would be.

Recently,on 4/9/2024, PTI was advised by RRT that the roof was complete and inspections were passed. Nevertheless, in light of the Insureds concerns, RRT, Turnkey and the Insured are meeting today to open the roof in two areas and verify that it was completed up to code.

Regarding the status of the permit, RRT apologizes for any delays throughout the process, which are attributed to the vendor having changed their name while the permit was active which in turn put a hold on being able to close the permit. On 11/15/2023, Rapid Response Team Roofing was contacted the second time about my home rear lower roof leak that has impacted the kitchen area. After several days of calling and persistence, I finally got a how of *****************************, warranty manager, who wanted to denied warranty right over the phone. He eventually sent ******* on 11/27/2023, roofing to come out and inspect, however, this individual did not go on roof to inspect. Shortly after I received a phone call from ******* refusing to honor our 10 year warranty and basically stating"what would you do if they were out of business". He also stated that the previous repair should not have be done. I would like for them to repair ******* correctly once and for all. The roof was done in late December 2016. I have no warranty exclusions at the time of signing my roofing contract with Rapid Response Team Roofing.

We write to address the recent complaint filed by the Customer against ********************** (RRT) with regard to a warranty issue for roof repairs performed by RRT. We appreciate the Better Business Bureau's dedication to fostering fair resolutions between consumers and businesses.

Upon receiving the complaint from the Customer, RRT promptly initiated an investigation into the matter. The homeowner had expressed concerns regarding recent roof leaks affecting the kitchen area, and he sought resolution under the warranty from the repairs conducted by Rapid Response Team in 2016.

After careful review and discussion with a roofer that Rapid Response Team sent to the property to inspect the affected area of the roof, it was determined that the leak was originating from an area not previously addressed or worked on by RRTs team during the initial repair in 2016.Consequently, RRT asserted that the issue did not fall within the scope of the original warranty.

In light of the homeowner's dissatisfaction and with a commitment to customer satisfaction, ********************** conducted further discussions with the Customer, and after careful consideration, ********************** has made the decision to revisit the property and undertake the necessary repairs to address the roof leaks, despite the initial assessment that the issue was outside the warranty coverage.

We are pleased to inform you that the Customer has expressed satisfaction with this resolution. This resolution demonstrates the commitment of Rapid Response Team to customer service and their willingness to go above and beyond to address customer concerns.

We appreciate the Better Business Bureau's role in facilitating communication and resolution between consumers and businesses. If there are any additional steps required from our end or if further information is needed, please do not hesitate to contact us.

Thank you for your attention to this matter.

We hired RRT to provide mold remediation and to find and fix the source of water damage on our townhome at the recommendation of the *** management company. They were very responsive and sent someone out to do the preliminary testing. They provided an initial estimate of a little over $9,000. We provided an initial deposit of $5,943.57. After several weeks, they determined that the mold was more than they had initially suspected and expanded the project. We agreed to the expansion because we wanted to eliminate the mold and the water damage bThey sent two revised bills for over $37,000 to cover the mold remediation and rebuild. They said that there were two causes of the mold: a plumbing drip and the lack of insulation surrounding the A/C ductwork. They charged for removal of insulation, but did not replace the insulation . After the work was completed, RRT stopped returning my calls. I have made approximately 20 unanswered calls to ****, *******, ***** and *******, plus 14 on WhatsApp. Fortunately, *****, formerly from accounts payable returned one of my calls so I could get documentation for insurance. Obviously, we did not hire RRT for the final rebuild. Our new contractor found water in the ceilings of two of the rooms they allegedly fixed.

After receiving storm damage, on May 18, 2023, I accepted Rapid Response Team, LLC (RRT) as the preferred contractor for my insurance company. They told me then that all repairs would take about 6 weeks. On July 7, 2023, ******* was repaired, Then on July 26, 2023 they started demo on my privacy fence. To this day, it is still not completed, and they still have to replace my patio awning. I have spoken with 4 different individuals from the company, and when I ask how much longer before they finish all the work, their response is always "I'll check on that and find out what's going on" or "I'll get with the project manager and find out". No one ever contacts me with facts. I have no idea when the work that I paid for will be completed.

On September 24, 2021, our home was hit by lightning, and a fire occurred. People's Trust is our insurance company, and they work with Rapid Response Team, LLC. We had to move out of our home for nine months. My son is in a wheelchair, so they put part of the house together so we could bring him home. The back of the house needed walls, ceilings, a closet, a bathroom, floors, and everything; on Oct 8, 2022, over a year after the fire, Rapid Response Team LLC walked off the job without completing the job. They left a cement pit where a bathtub should be. It leaks and has roaches, fungus, and smells. I fell and hit my head on the cement. There was a lot of blood, and 911 was called. I was taken to the hospital. I suffered a concussion. The handicap ramp in the back of the house is missing. This is a fire hazard. Holes in the laundry room ceiling. Over 20 items were left undone, some dangerous. The house can't be inspected. I believe they walked off because I told them they had the wrong closet.

Peoples *************** (PTI) appreciates the time and effort spent by our Insured, *********************** (Insured), in raising her concerns to the Department. Worth mentioning, is that this is a second Complaint on this matter and was received two days after the initial Complaint. That said, PTI recently responded to the first Complaint last week and for that reason PTI re-iterates its assertions in that response and will simply provide a brief update as to what has transpired since.

Brief Update: As communicated in the prior response, RRTs counsel communicated a settlement offer to Insureds counsel in an effort to resolve the remaining repairs. As of earlier this afternoon, Insureds counsel has rejected the offer that was communicated and for that reason it is likely that the parties will need to continue to resolve by way of repairs. However, the parties will continue discussions on how best to move forward taking into consideration each respective parties positions.

Prior Response: The Insureds current policy,PFL139609-08, has effective dates of 11/28/2021 through 11/28/2022 and an annual policy premium totaling $5,690.00. As for the upcoming policy renewal term, PFL139609-09, with effective dates of 11/28/2022 through 11/28/2023, the total policy premium totals $9,613.00. As can be seen on the Policy Declarations page for the upcoming policy, the information regarding the reasons for the increase can be seen on the bottom of page 3.  In sum, the basis for the premium adjustment was attributable to premium increases due to a rate change and coverage change,as well as premium adjustments attributable to wind loss mitigation features and building code grades for the area. As it relates to the rate change, PTI advises that an Insureds premium can increase due to updated rates that are reviewed and approved by the state. PTI further advises that all filings are public record and can be viewed at the ************************************** website www.floir.com under Company Filing. The Insured is advised to contact her agent to review her policy limits and discuss potential options for lowering the premium.

As for the Insureds claim, Claim No.: CFL21577235,upon review of the allegations PTI reached out to counsel for its preferred contractor, Rapid Response Team, LLC (RRT), regarding the allegations and to obtain information on progression of the repair process and/or potential resolution.Earlier today, RRTs counsel had a telephone conference with the Insureds counsel regarding repair issues encountered such as disagreement(s) between the parties on materials, trouble obtaining access, etc., as well as the liability issues the Insured is raising. A settlement offer was extended, in lieu of completing repairs, in an effort to resolve the matter, and said offer included the remaining amount of repairs to be done and waiver of the applicable deductible. As for the liability issues, the Insureds Attorney advised he would obtain more information from the Insured in order to explore a potential resolution and/or action plan as to how to move forward on that front. Hopefully the parties are able to make some movement in the coming days and to the extent they are able to, PTI will update the department with these developments in the 2nd response that is pending filing.

I accept PTI regading the increase of price. It is not an issue.

I am rejecting this response from Rapid Response because I would like them to finish the job they were contracted to do. By the way, Rapid Response had access to my home 24/7 for 13 months. The materials in my home were chosen by me except the closet. I don't know where that came from. I think they have been doing a good job. I seem to have a problem with one of the project managers, He keeps saying don't worry about it and the next thing he is charging me for it.  I must admit I am frustrated over the length of time it was taking and in all this chaos I have an adult son who is a quadrapegia to care for. ************* to be repaired their are dangers in some of the room.

Updated Response to Case #******** filed on 11/22/2022: In discussing this claim with RRT, it is PTIs understanding that the remaining repairs to be performed total around $8K and can be performed within a three-week period with no interruptions and/or interference during the repair process. Complaint: 18375797

I am rejecting this response because it is my understanding PTI & ** wants us to move out of my home again with all the disability equipment, computers, dogs, etc. We had a hard time finding a place the first time. The number of people required to move Jakes equipment is a lot and costs a lot, both financially and emotionally. The last time the ***** lift broke in the move, it cost over $1,800.00 to replace, and PTI took no responsibility.

I spoke to my family, and here are the results:
**** (my son) is refusing to leave.
**** is autistic and requires adult supervision.
***** is very ill with COPD.

I will leave, but PTI will need to pick up the cost of nursing aid care for about ***** hours daily. Nursing care costs about $20-25/per hour ($2,450 per week). Hours: 7 pm 9 am  x 7 days. Those are the hours I usually care for ****. It is against the law to leave **** without a certified caregiver.
I may have to board the dogs, I don't know the cost but I can get back to you.

In addition, the ** deductible was reduced by the following: The air conditioner in the back burnt out from the lightning. The cost was over $650.00. PTI told me to take it off of the ** deductible as well as the $250.00 cleaning from the apartment.

If they accept these terms, how long will I be separated from my family?
I will need to stay at a hotel for as long as it takes.
      Sincerely,

Peoples *********************** (PTI) appreciates the time and effort spent by *******************************, (Complainant) in raising her concerns. PTI thoroughly reviewed the policy in connection with the allegations raised and,at this time, denies any wrongdoing.

This matter concerns a wind claim filed by the Complainant for which PTI afforded coverage.  The Complainants policy contains an endorsement which allows PTI to indemnify the Complainant by means of repair in lieu of issuing a loss payment for the covered damages.  At the conclusion of its investigation of the claim, PTI sent a detailed estimate and scope of repairs to the Complainant to place the Complainant on notice of the repairs to be completed by Rapid Response Team, LLC (RRT).  The Complainant signed and returned a work authorization form to PTI indicating her agreement with the scope of repairs. Shortly thereafter, RRT commenced repairs at the property.

Included in the scope of repairs was a complete replacement of the Complainants roof.  The home contains a tile roof.  The roof replacement has been finalized with an approved final inspection by the ************* Lakes.  During the project logistics meeting with the Complainant, RRT addressed each of the Complainants questions and concerns.  The Complainant took considerable time in selecting the tile for the roof replacement, which caused delay.  Punch list items were also addressed with the Complainant during several site visits thereafter.  The Complainant recently indicated she now wants a metal roof with complete replacement of sheathing, despite her prior agreement, in writing, of the approved scope of repairs.  To date, the Complainant has not paid her policy deductible which is required under the policy.  In good faith, RRT has offered to offset the Complainants deductible by crediting her interior repairs. However, the Complainant has not returned the signed documentation approving the credit.

The Complainants son also recently expressed disagreement with RRTs approved scope of repairs.  The Complainants recent demands far exceed the scope of repairs she previously agreed to.  However, RRT and PTI stand ready and willing to bring this claim to full resolution and have the property restored to pre-loss condition as soon as possible, and seek the Complainants cooperation, as well. Both PTI and RRT have maintained regular contact with the Complainant to ensure prompt resolution of the claim.

We trust that the foregoing fully addresses the concerns raised by the Complainant.  Should you have questions or need further information regarding this matter, please contact me directly.
      Sincerely,

      *************************, Esq.
