ERS was assigned to us by our insurance policy as we went into a contract under a "managed repair program" Our kitchen was fully removed down to the studs on all 4 walls due to a leak and ERS was our rescue team to rebuild. After 4 months of unanswered emails and neglected phone calls we realized they were never going to help us. Once our Insurance agent and Public Adjuster got involved we saw 2 new people who showed up to assess the scope of work. At month 5 they pulled some permits, half were denied because they were not filed properly. We had no walls, uneven floors, wires hanging from the ceiling everywhere, it was in a demolition state that was dangerous. At this point we fired ERS and asked our Insurance agent to provide us with a new GC to get the kitchen work done. *********************** one of the leads at ERS kept our $2,500 deposit and refused to pay it back. We hope justice will be served soon, they took a huge problem we incurred and made it a million times worse.The involvement with ERS was from November 2021 to April 2022. We have been asking for a refund of our paid deposit since after we exited the managed repair program with them in April of 2022.Business response

Please note that this contractor did not perform demolition or construction in the ********* residence. This is an insurance claim. As a Certified General Contractor in *******, we are required to apply for and receive a permit for work of the nature of this project. Once we received a signed work authorization and the insured's deductible in the amount of $2,500.00, we contacted our architect to inspect residence and draw necessary plans or permitting. While waiting for the plans, insured let us know that she was interested in remodeling and completed the insurance company estimate of repair as it was written. Once she relayed this information, we sent one of our project managers and our electrician to meet with insured so she could let them both know what she would like to do. We were preparing the paperwork that would include her wishes along with the pricing for same. Before we completed that task, the adjuster let us know that the insured no longer wanted to work with us. As you can see in the attachments, we sent our expenses to date to Citizens, let them know that we applied the insured's deductible to the outstanding balance, and requested that they pay the balance. Citizens sent us a check for the remaining balance and we closed our file. The insured, in the complaint intimates that we demoed her kitchen and left her in a state of disrepair. This is NOT the case. Our role until fired was to involve architect and building department, nothing more. I have attached all pertinent information, correspondence, invoices, and more for your review.
