    I signed a contract with Custom Aluminum Boat Lifts on July 14, 2021. We agreed about the price and they requested a check for $750.00 to be held by their company for permit and engineering drawing that would be cashed when they started the job. On February 13, 2022 the requested to come to the site once again to review the site one more time. They that informed me 2/13/2022 they had to alter the drawing that will conflict with my needs for the boat lift. However on 2/15/2022 they obtained a permit to do the job according to the drawing I disagreed with and then sent me a certified letter with all the papers attached including the permit and stated that they can't do the job, after they deposited my $750 check and told me to "find someone else". Please note that Marine Products Inc. is doing business as Custom Aluminum Boat Lifts.

    After reviewing your correspondence and the comment from Mr. **** *****, Marine Products would request correction of facts surrounding Mr. *****'s complaint. Mr. ***** signed a contract with Marine Products for the construction of a dock and Boat lift with extra pilings. At the time that we contracted with Mr. ***** we told him there would be a significant wait for construction because the lag time for permitting in Pasco County was unpredictable and we requested and received a $750.00 check to cover permitting and engineering. We held his check until it was time to apply for a permit. Mr. ***** asked to remove two pilings from our estimate when we came to do a final review of the work to be done. We informed him it would not be a problem to remove the two pilins from the contract and at the same time told him we would have to build the dock and lift further out from the seawall because of new Rip-Rap that was now impeding drilling. This would mean his dock would require enlargement for which we would not charge him because he had waited patiently. He agreed and we left the site and applied for the permit. The permit was approved and then Mr. ***** stated he wanted us to build the dock closer to shore. In that we are physically unable to accommodate drilling where he requested it be changed to we moved on with our equipment from his neighborhood. We notified Mr. ***** that the permit was already engineered and paid for. In fairness to Mr. ***** we removed ourselves from the already paid for (non-refundable from Pasco County or the engineer) and forwarded the permit to him for his use in securing another contractor who may be able to drill in the current rip-rap situation he has close to his seawall. The situation is completely created by Mr. *****'s request to modify the job after agreeing to our design, permitting being undertaken and then demanding we perform work it is not possible for us to perform reasonably.
