      In April 2024, I contacted St. Joe Fencing to request a quote on a fence for a house in Mexico Beach, FL. They told me they were 2 weeks out on installations. This was a lie. On May 21, 2024, I mailed the deposit check for $5,990.98 to St. Joe Fencing. Before the deposit was mailed, I was told by St. Joe Fencing in writing that the materials were in stock. This was a lie. On May 29, 2024, I was told via e-mail by St. Joe Fencing that the materials for the fence were not in stock but were actually on a 4-6 week backorder. I was also told that if I switched from 48” tall fencing to 54” tall fencing, the materials would be in stock and “we could have it delivered Wednesday next week and be completed by the end of the week.” This would put the job at the completion stage on Saturday, June 8, 2024. However, the job was not started, let alone finished, by June 8, 2024. I e-mailed St. Joe Fencing on June 12, 2024 to find out the status of the job, and was told via e-mail on June 13, 2024 that they were having difficulty with permitting. I have asked for a refund numerous times from St. Joe Fencing. On June 30, 2024, St. Joe Fencing told me in writing that they would process the refund. On July 17, 2024, St. Joe Fencing told me the refund was sent. Then, on July 29, 2024, St. Joe Fencing told me via e-mail that they had not mailed a check and that the check was coming from some unidentified “vendor”. On July 30 and August 6, 2024, I e-mailed St. Joe Fencing again asking for the status of the refund. These e-mails have not been answered as of the date of this posting. St. Joe Fencing made numerous material misrepresentations to me in order to secure my business, ranging from lead times, availability of materials, permitting, and ultimately the processing of a refund. To date, I am out $5,990.98, I have no fence, and there is no end in sight.

      To whom it may concern, 

      St. Joe Fencing denies the allegations set forth in this complaint. We have exchanged over 20 emails explaining the process of ordering, delivering, installing, and refunding their fence project. We did obtain the material deposit and processed it for material ordering. When we were at that point our vendor was out of stock as was explained in the email. As a fence installation company and not a material vendor we have no control over material availability. However, St. Joe Fencing and our vendor was willing to offer a better product at the same price for the inconvenience. They accepted and authorized the fence modifications so we proceeded to move forward.  The materials are only delivered to our area once a week which meant we were behind on getting the materials delivered than we had originally planned. We sent another email explaining the delay in progress and communication. We were not able to have the project completed as originally discussed due to the delivery and weather. At this point the customer requested a refund. We understood and explained that the vendor would refund their materials and we would issue their refund. The process tends to be lengthy so we also explained that it may take 60-90 days for them to receive it. We have processed it and anticipate they should receive it any day. We are sincerely apologetic for the misunderstanding and inconveniences that have taken place. There has been no misrepresentation on behalf of St. Joe Fencing as we have various emails from our vendor and between our client explaining the entire process and situations as they occurred.
