      ************************* the owner of the company fraudulently represented himself as a licensed contractor with experience in remodeling homes. We hired him to do stone masonry on our home and gave him a large deposit. The work performed was extremely poor and had to be removed and redone by a qualified company. He promised to return our deposit to us after we discovered he lied about who he was and sent us fake photos of his work. We had to pay tripple the amount to have everything fixed. To this date he has not refunded us any of the money after promising to do so in writing.

      I am commenting on behalf of ************************* regarding the case filed against Afford to Renovate. ******************** requested I provide the following response on his behalf:

      Mr. and Mrs. ******* hired Afford to Renovate, LLC to install a rock wall on the exterior front facing wall of their home. They provided a deposit of $1000.00 which was used to purchase some materials and tools necessary for the resulted work. Sometime shortly after the work was completed, Mr. and Mrs. ******* advised they were unhappy with the final product and requested a refund. ******************** did acknowledge that the clients were unhappy with the work he was hired for and had agreed to not charge the final cost. Further, he agreed to return the full deposit of $1,000.00 to the clients, even though the work had been completed and materials lost. Due to recent unforeseen circumstances, ******************** is currently restricted from public communication and unable to provide a refund at this time. The refund request is not being dismissed or ignored. While Afford to Renovate does sympathize with the situation, patience is asked from the clients until which the deposit can be returned.

      I am rejecting this response because:

      This response contains numerous false statements.  Firstly, the $1,000 deposit was not used at all for materials.  The materials were solely provided by Mr. and *****************, the homeowners. The homeowners paid for all of the stone, mortar and the truck rental used to bring the material to the home. The homeowners have proof of purchase for all the materials used.  ******************** did not have to pay for anything out of pocket.  Secondly, the work was never completed, as the homeowners realized the work was extremely shoddy, unprofessional and unacceptable after the first day of work performed. The homeowners discovered ******************** was not qualified to do masonry work, was not licensed or insured, and had deceptively sent false photos pretending to be a previous customer.  Upon confronting ******************** with this, he agreed in writing to return the deposit in full within 30 days. In addition to the written letter by ********************, the homeowners have numerous text messages by ******************** promising to refund the deposit funds.  It has been over 4 months and to this date the homeowners have not received the promised refund.  The homeowners have no other choice but to file a lawsuit seeking damages, including but not limited to, the materials lost, and cost of remedial work performed to correct the errors made by ********************. Since the filing of this complaint, the homeowners have been made privy to several other customers who were also defrauded by ********************. The homeowners are willing to settle this complaint within 30 days of this writing, before continuing with further legal remedies.
