Im filing a complaint against RSC Construction and Painting, LLC. Ive paid *********************, the owner of RSC Construction and Painting, LLC a total amount of $99,815. I was tricked by his company stating that they received the permit and they needed more money to continue to the next step of the project. My initial deposit was $15,000 and based on our contract I would pay more when the permit for the small prefabricated steel building was obtained. No proper permit was ever obtained. I was given the run-around for over 3 year. All while hes telling me hes paid all these subcontractors for concrete and plumbing and the steel building, Ive found by asking the companies if theyve ever received money from RSC Construction and Painting, LLC (******) theyve never received funds. *********************, has stolen my money and have not even put a shovel into the ground. Hes been fraudulent, and is a threat to other future consumers looking for honest licensed contractors. I need my hard earned money back, and this company needs to be closed down to prevent future fraud.Business response

This case will apparently be going to trial, as the Owner has hired a lawyer, and so have I. There are several issues in play. We were hired to build a building. We filed for permits. Permit was issued. Apparently the wrong permit was issued, because when we called our first inspection after getting the building formed up, we were notified that the wrong permit was issue, and we needed to obtain a different type of permit. The new type required that we have a site plan for the constuction. Owner agreed to allow us to use funds from the deposit for the site plan. The site plan took about 16 months to get to the point of almost being complete. The city had a couple minor things that needed to be addressed, but one major one. The property the Owner has is zoned in 2 different ways. This makes it impossible to build on as it currently is. The zoning issue was never relayed to the contractor from the owner. When it was brought to the contractors attention, the option to hire the engineer to get it rezoned was presented. The owner declined, saying his new business partner could handle that. Nothing has been done on the zoning issue to date. The owner also had the lot paved without the contractors knowledge during the permit application period which complicated the matter on the site plan. The owner also had trees cut down without proper permitting, which complicated the site plan. The owner has been sent a refund check for a little over 21 grand. There were deposits placed with concrete company, plumbing company, survey paid for, and various other things needed on the job. I am happy to find a reasonable number to end this, but it isnt a full refund. As money that has been spent on deposits was non refundable. The owner also tried to slander the company and contractor on social media, which may lead to other legal issues on his end. I have no issues providing the accounting of the true funds spent, and come to an amounth that closes this out. At the end of the day, the owner never telling the contractor about the split zoning is the biggest issue we have, along with his paving with no permit and cutting trees down with no permit.Customer response

I am rejecting this response because:
*********************, the owner of RSC Construction had someone work under his license named ***********************. *********************** created a deal with ****** to take in this construction deal with me. It was stated to me, that they were partners and a $15,000 deposit would be needed to accept the contract and more funds would not be needed until theyve received the permits.
Everything about the property was revealed to RSC Construction, including that the property had a residential mixed usage zoning in the rear of the property. I was told that it wouldnt be a problem and the whole job start to finish should take between 6-8 months at the latest.
Every moment I was asked to pay for something, I did, totaling in amount of:
$99,815
Break down
$75,000 totaling in Cashier's check
$1000 check?$165 check?$4150 check?$15,000 check?$4500 online QuickBooks invoice
I was given the run around for 3 years about the progress of the project.
I asked ********************* for a transaction report on everythings hes spent money on. I then took it upon my self to call these companies thats hes allegedly paid.
$10,000 of a deposit on a steel building to ******************* in ********* *******, was never paid.
After this inquiry, I proceeded to call the concrete and plumbing company regarding the alleged deposits paid, it was stated the invoices the companies provided were never paid for as well.
Once I learned this information it was clear that Ive been defrauded, and any work needed wouldnt be done.
Its pretty simple, im a very easy going young entrepreneur. I just want what is right. A full refund, which is the least of what should happen especially since the deposits that were stated were paid were never truly processed. I will never get back the time I lost waiting for this project to be completed.

I have no problem providing the cancelled checks that were indeed cashed by the companies. RSC was also NEVER notified of the zoning issue, or we would have NEVE taken on the job. Zoning is important, and the *****S responsibility. Not the contractors. There is zero proof that the ***** ever notified RSC of the zoning issue. Also, It was never stated that RSC and **** were partners. **** and the ***** are friends,and they wanted to use my license to build the building, and RSC would be compensated 10 percent of the total job price for that. I have no issues refunding the balance of the money left after the deposits were paid. But there is no way the ***** gets a full refund. As things were paid, and I have cancelled checks to prove that.
