      I purchase a Derby bat on March 20th, 2024, I received the bat on April 5th, 2024 , only used the bat 5 or 6 times and it broke. I notified this company and they said that I needed to contact a bat company that they bought the bat from because the bat had a defect. I believe that is their responsibility since I bought it from them. They were very rude and unprofessional and have no intention of trying to resolve this, they say they have no warranty, but are saying that the bat was a defect. I just think when you pay this kind of money that you should be able to use it more than 5 or 6 times. This bat was only used on Sunday afternoon's and not by any professional players, just neighbors and friends getting together for a fun day of baseball.

      Hello, attached is the email correspondence of the conversation with *****.  We were not rude and directed her to Spalding who is the manufacturer.  It is common knowledge in the bat industry that all warranty claims are to be made with the manufacture, not the place where you purchased the bat from.  It is also common knowledge any mens senior softball bat has NO WARRANTY.  You can look up any of these bats anywhere and everywhere single one, no matter the make, have no warranty or guarantee. 

      Below is a link directly from Spalding on how to handle a warranty claim.  You will notice her bat does not qualify

      We politely directed her to the manufacturer to see if they would make a exception, but she wasn't having it.  We do not guarantee anything we sell, no one does, nor does it say we do on our website anywhere.  Manufacturers guarantee their products.  We are not authorized dealers of Spalding and have no pull with them to assist her.  We purchase these bats from 3rd parties and modified them per the orders we receive.  In this customers case, the handle snapped in half which has nothing to do with the process or service we provided her.  All these bats are carbon fiber and can come with defects unseen to the eye inside the material.  We have had a few customers have this same issue and believe it is a manufacturing issue and directed them to the manufacturer.  This is certainly not our issue nor something we are obligated to replace.  *********** agreement she approved went over the terms of the sale.  We have her IP signature on file of the disclaimer she approved embedded in checkout.  And she has to approve the service agreement otherwise you cannot complete the sale.  See link below of our service agreement signed by *****

      Anywhere you look, it says the exact same thing.  We started off by apologizing for the issue and it is unfortunate, but it does not mean we are on the hook to replace the bat.  There is no telling how that bat broke either.  Maybe it was slammed on the ground, thrown against a fence.  Maybe she fouled a ball off the handle versus the barrel.  Who knows.  This is the risk of purchasing bats with no warranties vs a bat with a warranty.  We will not replace or refund this purchase.

      I am rejecting this response because:
      I do see that they have no warranty on the rolling and shaving of the bat. I have attached all documents from day one of purchasing the bat, your last response was the first I seen the disclaimer agreement and if I signed it *****, that would not be my signature. You are the one that said the bat had a defect and this has happened to others  so why would you keep using them as a 3rd party , which I had no idea that the bats are purchased from somewhere else. I  have also been in business and I have purchase vehicles before and never have seen anything like this, whoever sells the product, stands behind the product. If these bats have no warranty, the customer has a right to know this up front,  to me this sounds like passing the buck back and forth between your company and the bat company. Also I am 60 years old, I am not throwing the bat and hard on the bat at all. I am asking for a refund or a replacement bat.

      Unfortunately ***** this is not a car, this is a softball bat and it does not work the same.  If you are 60 years old and been playing softball you should know how this works when a bat breaks.  if you dont, then let this be a hard ****** learned.  This is not passing the buck as you say.  This is also not bad business in my opinion.  This is holding you accountable and not allowing someone to get over on us because they think they can by taking these steps.  Been in business almost 16yrs and this is the first negative complaint we have received.  Go ahead, look it up and see for yourself anywhere  

      You purchased a no warranty bat plain and simple.  it even says no guarantee on the product description itself.  i provided a link to another website who is an authorized spalding dealer and they have the same exact no warranty, no guarantee description.  lets use a car example since you are familiar.  you purchase a mustang thats sold as-is and out of warranty with Ford.  you are 5 days into a joy ride and motor blows.  what are you going to do?  stick it to ford?  stick it to the place you purchased the car from where you signed off on legal documents stating as-is no warranty?  or are you going to swallow it knowing what you did and should have possibly made a better buying decision?

      it is clear as day on the website and every other website selling this same bat there is no warranty.  we have not duped anyone, it is full transparency.  if you read the product description, if you read the disclaimer that you certainly did approve with your IP signature, it went over everything.  so because you are dissatisfied here we are to overlook all of this and just refund back your money because you say so in the spirit of "good" business?  whats the point then of disclosures, product descriptions and so on?  seems like a big waste of time doesnt it

      i will say it again, reach out to the manufacturer and see what they will do for you as we originally advised you to do.  you have been rude, condescending and demanding that we rectify your purchase because it is just what we are going to do.  well i am not nor will i willingly let myself get robbed.  for the record, all of this back and forth will be attached to your complaint and anyone who is bored enough to read it will see what the reality of it is.  I am not worried in the least and i will happily go round and round with you til you go away.

      I am rejecting this response because:First off I am still wanting to see the disclaimer agreement that I signed and also letting me know that the bat was from a 3rd party and their warranty, and yes I am 60 years old and never have had a bat brake on me . And if you want to use examples I did buy a **** F150 with no warranty and in 30 days a spring broke, they very much stood behind it. Another example I own a restaurant, I get a box of hamburgers from ******** Foods, they look good, smell good but I cook one up and serve to a customer but it taste bad, I don't give them Reinharts number and tell them to  call them, I make it good with the customer and I take it up with ******** Foods, that is good business .  I am still asking for a replacement or a refund and no I won't give up because ****** is alot of money only to use the bat 5 or 6 times. If these bats are made just for show then it should be told to the customer.
