I was very impressed with Legacy and the proposal and statement of work to replace my concrete paver roof. The install went well and everything was good.A couple years later I started noticing dampness in my master closet. For years I could not figure out why my closet was damp until the the drywall ceiling and walls collapsed. Above the collapsed ceiling was a tiny leak in the roof that Legacy Contracting Solutions replaced. I called Legacy for help and they refused any responsibility for the leak in my roof and wanted to charge me twice as much to fix the roof as the quote I got from ****************. This is just a heads up before you select them to replacer your roof.***** V

    Legacy Contracting Solutions, Inc. Response

    03/20/2024

Legacy Contracting Solutions has been accredited with the Better Business Bureau for over 16 years and has an A+ Better Business Bureau rating. Reason being, we take immense pride in the quality of our services, always go the extra mile to ensure every customer is satisfied, and we have a longstanding history of providing top notch work within the community.

That said, ************************************* review is at best, intentionally misleading, and at worst, malicious defamation for the sole purpose of coercing our company to pay him money he is not owed.

For context, ************************ intentionally omits a few key details:

The subject roof was installed over 14 years ago.

Legacys warranty on the subject roof expired over 10 years ago

Instead, ************************ claims he started noticing dampness in [his] master closet [a] couple years later, and that [f]or years [he]could not figure out why [his] closet was damp. Then he called Legacy for help and they refused any responsibility for the leak in [his] roof and wanted to charge [him] twice as much to fix the roof as the quote he got from [some other contractor a dozen years later].

The fact is ************************ called our company in June of 2018 for an estimate to replace his windows 8 years after we had installed his roof in 2009. At this time, absolutely no mention of dampness, leaks, or any other issue with the roof we previously installed was brought to our attention. In our opinion, Mr. *********** desire to utilize our company once again in ******************************************************************* 2009. Not to mention, had he believed issues existed with his roof, youd imagine he would have brought these up at that time. However, he did not.

Again, we installed Mr. *********** roof in 2009,which was fully approved and passed all applicable building department inspections. Fast-forward approximately 14 years, ************************ contacts us for the first time with his issue in November of 2023. After discussions over the phone, we emailed him with the applicable product detail information showing how the roof to wall flashing is supposed to be installed and wished him and his family a Happy Thanksgiving. After exchanging another round of emails, ************************ sent us the following on November 18, 2023:

"I can see this is not going to get resolved between you and me. I am forced to take this matter to small claims court where the consumer has a chance to state his case.  I think I have a good case to present to the judge and I can  win. My original plan was to get Legacy to just replace the damage portion of my roof, but since we will be going to court, I might as well include mold remediation and fixing the closet floor, walls and ceiling.

Im leaving for vacation this afternoon so I will start the process when I get back off vacation.
    "

From there on, ************************ attempted to bully us into paying him even more than he originally claimed was needed to repair the alleged issue, or else we go to court. We again advised him that a) the issue was not with our work and b) that this fell well outside of his warranty. His responses, however, were as follows, in pertinent part:

"I dont think you understand what small claims court is all about. It is a chance for an individual like me to present my case to a judge and have an equal chance against a corporation or business owner like yourself with your high profile lawyer. I believe I have the photos and knowledge to convince the judge I am right. I dont need to hire an attorney and It will only cost me a few hundred buck to present my case." [Nov.22, 2023].

"This is what small claims court is all about, give the consumer a chance to state his case. When I logged into small claims court, the first thing they suggested is for the 2 parties to try their best to resolve the disagreement. If you feel strongly that you are right, then we go to court. If not, I need you to reimburse me the cost of repairing my roof $4500.00 and I will drop this lawsuit and this issue will have been resolved.

If we go to court and I win, I will be asking for compensation for roof repair, mold remediation, closet repair and lost of clothing $8,000.00. Also if I win, I will be reporting back to all those in my neighborhood who are asking if Legacy took responsibility for fixing my roof. My report will not be favorable. I  also think it is my responsibility to alert all those in [my neighborhood] that if they had a roof installed by Legacy that they need to check for roof leaks and send them a picture of my leak so they know how serious this problem can be. If I lose, I will report to whom ever ask that you were right and the matter will be closed."
    [Dec. 12, 2023].

"I look forward to seeing you in court.I'm not just your ordinary home owner, I know a little bit about roofs myself.I have little at risk except my time and court cost if I lose and a lot to gain if I win and I feel very confident I will win. Why wouldn't I take advantage of the court system and state my case. On the other hand, you have a lot at risk if you lose so you better think long and hard about the consequences.

My offer still stands, Send me a check for $4500.00 (that is the price you quoted to fix my roof) and this matter is closed.
    " [Dec. 12, 2023].

Ultimately, we had to resort to hiring an attorney to request that ************************ cease and desist with his continued harassment of our company. Our attorney again advised ************************ that he was outside any applicable statute of limitations and well outside his warranty. Again, this roof was installed over 14 years ago. Mr. *********** response to this was to again reach out to our company and advise us that he would agree to drop this case, [t]ake down the current customer review on the ******************** website, post a new review with a 5 star rating, and promise not to go on social media if we just pay him $4,500. [March 15, 2024].

The most recent, and hopefully last, email we received from ************************ ended as follows:

"You have heard the old saying, you may win the battle but you are going to lose the war. You can take me to court and you may win. I don't think that will happen because my BBB customer review is 100% accurate. If I win or lose this suit in court, it is not over. I'm not sure what my next step will be but I will continue this disagreement from every angle. Please do what is right for your customer so we can move on." [March 14, 2024].

We absolutely love what we do and love the fact we are in a position to be able to help so many in our community on a day-to-day basis. However, once in a blue moon a company must put its foot down and refuse to bend the knee to people such as ************************. We simply cannot let this individual bully and extort us based on threats of further defamation. At this time, ************************ has not filed any lawsuit against our company;however, should he do so, our hope is that he stays true to his word per his December 12, 2023 email If I lose, I will report to whom ever ask that you were right and the matter will be closed.
