01/20/24 Me and my sister in law ******* went to Go karting at Route 7 entertainment. Immediately after getting there we signed a waiver for the go kart and the two deluxe attractions which totaled to 84 dollars for both. Staff said our race starts now so we went to the go kart line. After the staff secured our helmets making sure it was tight they put everyone in their assigned carts. The first thing was NO BUMPING OR RUNNING INTO ANYONE. soon as the race started the staff spotted an aggressive driver that hit multiple people. He had hit me twice and then flicked me off. Within minutes after he immediately spots me and hits me so hard my helmet FLEW OFF to the other side of the track and my head bounced off the wheel and my eye was busted and gushing blood. ******* ran over to me as soon as she saw it was me. She witnessed the crash. I immediately became disoriented and dizzy and traumatized by what just happened. The staff proceeded to set me in another corner so they can RESUME THE ***** As if nothing happened. Manager came and made me feel like it was my fault because I was in the left but its a race and no rules besides no bumping was communicated, why have helmets if they arent going to protect against impact? The manager then allowed the man that assaulted me leave and the manager didnt wanna refund me my money instead suggested I can come back after I just left traumatized from his faculty. ******* proceeded to remind him of his negligence and then he gave us 9 dollars from the total 84!. This wasnt an accident it was intentional after staffing witness who was at fault. I hey failed to do right by me. I lost days of work due to having a fracture nose and a busted eye. A day of fun turned traumatic and I feel defeated.Business response

***************** and her friend purchased our Adult Platinum package for each of them. This package includes one (1) Go Kart race and two (2) Deluxe Attractions at a price of $39.95 plus tax per person. They did enter the race and the ***************** was in an accident. However, the accident was not caused by another driver maliciously running into her go kart. As ***************** came around one of the turns, she did not negotiate the turn properly and ran into the barrier on the right side of the track. This caused her to bounce off the right barrier and run directly into the barrier on the left side of the track. The video footage also appears to show ***************** engaging in hand gestures with another driver which potentially caused her to be temporarily distracted which then may have caused the initial impact with the right side of the track. Upon ***************** making the claim of having been "assaulted" by another driver, management investigated the incident and concluded that the other driver did not initiate contact at the time of the accident.
***************** also claims that she only received a refund in the amount of $9 of the $84 purchase. This is also incorrect. ***************** and her friend were each refunded $18.19 cash for the unused attractions. This brought the total refund amount to $36.38.

I am rejecting this response because:
The guy hit my go cart I was not distracted and I was telling the person I was with that this guy kept hitting me.. and at the end of the day your FAULTY A** equipment flew off my head causing damage to my face nose and eyes so no I will not except a wack a** excuse and idc if I have to go stand outside there place of business and protest and stray people away from ******** management and faulty equipment and fact that its ok to play bumper carts

I am rejecting this response because:
The guy hit my go cart. I was not distracted; I told the attraction operator that the individual kept hitting me. I would also like to mention that the video shows my helmet flying off which indicates improper helmet handling for the consumer. To the very least I expect the helmet to protect my face and it failed to as you have clearly shown in the video. As much as I would like to continue pursuing a solution to my issues, I wish to avoid any unnecessary arguing as it is causing me severe anxiety. I should pursue full compensation for medical and other expenses in relation to the incident, but I will settle for just a full refund instead if the partial I received.
