      This company has called multiple times to set up a meeting about receiving information on tax savings for the business over the last year. I have declined every call. I asked on 8/30/23 to be removed from any future calls. I was called on 10/31/23 again by the same person who calls every time from their cell phone. They claimed that I have never asked to be removed. I informed them that I previously asked to not be contacted and they hung up on me. They claimed to be a supervisor. The number calling me is a local cell phone. I tried to call the ******* number. They do not answer and the voice mail is full.

      We do not know who *************** is. They are not clients of ours. We do not do any telemarketing as we branch out those services to a company that we pay for there services. So *************** needs to contact them and his complaint is against them, not our company. We have no control over this.

      Profit Management Solutions has not met any of the bench marks they clamed. They stated they would be able to present savings for our business. After spending ****** dollars with this company all we received was old data that we had. Owner seems to have more complaints than actual real customers that can vouch for their work.

      I am rejecting this response because:

       

      I received the notification that the matter had been closed,in case ********, but I did not see that Profit Management Solution, LLC responded until this notice. This matter still needs to be resolved. I hope it can be reopened, as I was looking into contacting the Attorney General of the ************************ on this matter. I believe that we experienced fraud. To follow up on the letter from the owner, we asked for business references. Something that seems standard for the fees they were charging and the area of work they say they are in.  Profit Management Solution, LLC made many claims about being tax professionals for 20 years and the capabilities of work they cover. However, when asked to provide bona fide proof of the customers success for the plan that they were charging $275.00 an hour for. They could not provide one real customer. Just refer us to their website for references and that we have to finish the process first  The owner responded that we requested his business license, if we had, that should have been something easy to provide to clear this matter up, yet he would not do. We have asked for actual live references once again and receive none.     

       

      I do have a e-mail from him that I can forward stating they would return, complete the work, and bill me upon completion. If we did this, our business would have been exposed to thousands of dollars of debt and no proof that anyone doing any so-called work had the actual experience or knowledge.  I am still confused if they have such quality work, why cant we have honest references like a normal business? They business seems to be setup, so you are not communicating with all the parties involved at once.  Our company ****************** is rated by the BBB as A+.   As such, we paid for all work completed, $18,000 worth per the contract. We felt after seeing was done and the information that was given, that it was essential that we have verified proof that the recommendations we were paying from were from actual people capable of delivering the results they were advertising.  

       

      I will also note that the changes they made in our accounting system were incorrect and should not have been made. They even solicited and received work from other local companies, based on dropping our company name. Without our consent. We understand that this company is now filing a complaint with the BBB against Profit Management Solutions.

       

      We feel the past and current public complaints against them warrant further investigation into the activities of Profit Management Solutions, LLC. We feel that the work was not being done by the consultant on sight but being transmitted offshore and then sent back for input.  They have abnormal sales tactics that seem to bring several complaints against them.  They seem to have many negative reports about them around the country.  

       

      As before I hope this case can be reopened and examined. Please let me know if you should need any further information from me or have questions.

      In response to Mr. ******** we wish to address the concerns sited in his complaint in hopes of putting this issue to rest.
      First and foremost there was nothing fraudulent or misleading in our actions or words during our interactions with ******************** or his company.  We do have a division of our company that is staffed by tax professionals, however, ******************** did not engage in this service so therefore his comments have no relevance to his complaint.  We were transparent with our hourly rate for managerial and business process consultation as well as the projected time frame of the proposed project and both clearly appear in our contract signed by *********************  We have client testimony on our website and advised ******************** to review the many reviews of complete satisfaction.  Our projects involve the financial wellbeing and profitability of our clients companies and are considered confidential. Therefore, we will never share the names of clients without their consent due to the sensitive nature of protecting their anonymity.   
      We did offer to return to complete the work and only upon the complete satisfaction of ******************** would he be obligated to pay his invoice.  The fact that he states that completing the project would put him in debt clearly indicates he underestimated his ability to pay the cost of the project going the full 200 hours even-though he entered into the contract. We suggested ******************** go to the ******* Secretary of ************** of Corporations website to confirm our legitimacy but he has not so attached is our annual filing confirmation.

      We also are on the BBB rated as A+.  As this is the forum ******************** has chosen to voice his complaint, it is interesting he didnt read the many glowing reviews on there about our company submitted by our clients.
      Mr. ********* insinuation that our company seems to be a set-up is not factual at all.  Our company is structured in layers consisting of Telemarketing, Sales, Analysts,Consultants.  We source our clients through telemarketing leads in regional areas. Our sales representatives visit clients based on appointments set by the telemarketers.  They give an introduction of our company and the services we provide. If the client is interested in learning more and having an analysis of their business operations, they sign a contract and an Analyst conducts a two-day review for $1500.00.  If the client agrees with the recommendations presented on day 2 they sign a consulting contract for an estimated number of hours and a consultant is assigned to the place of business to identify and rectify the deficiencies in the business operations both fiscally and in process. As ******************** claims that the changes to his accounting system were incorrect, we submit that the changes that were made to the accounting system were part of a bigger plan and would have proved beneficial had we been allowed to fully execute the project.  It was a means to an end; unfortunately, the end came 4 weeks too early.  Here is an excerpt from our consultant:

      During the week, I was supposed to be working and training a bookkeeper on how to improve the Quick Books. I did my normal data analysis on what the *** had presented in the previous years tax returns. I computed and identified my usually Deltas.I crafted a benchmark Chart of Accounts to use to reorganize the books to Managerial accounting and absorption. A recommendation was compiled showing some analysis findings in the last three years, and descriptions on the corner stone of how to set up a Profit and Loss statement with emphasis on productivity. Contrary to his comments of late, ******************** did not have this analysis or results of whats been going on. I started installing the new Chart on the Quick Books. I found the Quick Books was NOT balanced, checks had been written and not accounted for in the system, the inventory had a $ X** million error.I started trying to put together some manual checkbook balancing forms and working some of the statements. There was NO BOOKKEEPER to train. There was a cashier from the front, that inputs a few checks now and then. She was transferred to the downtown store, as she works there also. She offered to take some papers over there, and work on them. She did NOT ever indicate she was the bookkeeper or wanted that job.

      Finally, I wish to address the topic of solicitation.  This we do not do.  Our business thrives on our satisfied clients referring their family and friends who also own businesses in addition to our team of telemarketers.  The client ******************* references in his letter was obtained in the very same manner as he was.  As stated above our leads come from telemarketing campaigns in regional areas to reduce travel costs for our sales reps.  Therefore, it is understandable that we may also visit local companies known to ******************** but using his name would be a breach of confidentiality and is not done.
      I hope that this additional information adds some context surrounding the misleading allegations brought forth by *********************  At Profit Management Solutions, LLC we adhere to professional and ethical practices in all aspects of our business.  This is clearly a case of not being able to satisfy every client every time regardless of our attempts.

      I submitted a response on 2/22/23 via the BBB website. This matter is unresolved and the business as not made any good faith effort to provide what should be simple information.

      We do have a division of our company that is staffed by tax professionals; however, ******************** did not engage in this service so therefore, his comments have no relevance to his complaint. 

      It should be noted that ********************** now acknowledges that the term tax professionals is part of his business services offered. Where in prior communications, he has avoided acknowledgment. *** services are tactics that ********************** uses but cannot provide any legitime experience in. He cannot prove he is bonded, licensed, or experienced to offer such services.   None of the businesses that ********************** claims to own can be verified as legitimate companies with knowledge of success in those areas. Instead of providing actual references as requested to verify the claims, ********************* directs to the reviews on his website. Yet has no answers for the many complaints and lawsuits that seem to be filed against him on the internet. The complaints on the internet against ********************** seem to be very real from our experience. 

       

      ********************************* comment:

      When we inquired more into the plan by asking questions to the consultant ******, he would just give vague answers about the overall project. He stated he did not know the others who worked for Profit Management Solutions.  He seemed to know little about Profit Management Solutions and its operation.

      Profit Management Solutions has not been able to provide any examples of what will be at the end of 200 hours. The funds for the project were budgeted for. However, because of the lack of transparency of abilities, for years of experience, as Profit Management Solutions claims, this should be easy for them to complete.  We have requested this information many times. Mr. ********** only solution it that they must return to finish the work first.

       

      Per the contract, we would be responsible for the work done.  So yes, if the work did not add value to the company, it would leave it with debt. Once again, Profit Management had all paperwork and funds paid when requested. Their inability to provide simple business references past their unverifiable website claims is the problem.

       

      The lack of willingness to verify said claims coupled with the work provided by Profit Management Solutions only further reinforces that it was the proper decision to end the work. ********************** has been unwilling to provide proof of legitimacy to offer such services in any field they claim. The fact that Profit Management Solutions registered with the sate of ** this year provides no support to the claims they make.

       

      ********************************* comment:

      The consultant had incorrectly categorized entries into our system. This might have been part of their standard plan, but it should have been discussed before being done, as the work that was done and we paid for was incorrect. As before, ********************************* has no proof of concept of plan or being a ligament business to refute the claims on the internet that they are con artists.  We got vague answers when we started asking ****** simple questions about Profit Management Solutions. We developed a lack of confidence in the advice we received from them.  The changes that were made were based on some plan they had, but they were not able to disclose it to whom they were acting it upon. We find this is outside of normal business practices. The changes were unnecessary.

      The consultant, ******, was given all tax returns and profit loss statements for the last three years and all sales plans and marketing data as requested in a timely fashion. ****** was advised that some clerical was needed that was scheduled to be completed, as he was told. Yet, he wasted expensive billable hours on clerical work already scheduled to be completed.  His report was consistent with the exact information in the profit and loss reports given to him and other paperwork he asked for, and made available to him, yet he never reviewed that.

      Further, when the consultant was given the correction for the system inventory error, he mentioned; much time was spent looking for nothing. We explained it was a system error from the manufacturing software and would be resolved with the clerical work, a simple input error.  ****** did not understand how our manufacturing software operated and wasted hours of time looking for wrongdoing and discussing the matter with employees instead of understanding the system. We believe that Profit management Solutions looks for billable hours and does not actually have the experience it claims.

       

      As before, Profit Management Solutions has many complaints filed against the company. The complaints are all consistent with the experience that we have received.  It is challenging to work with this group as there is no accountability from person to person.

       

      ********************************* cannot offer actual variable results or actual customers. ********************** states confidently states agreements, but his website supposedly shows real reviews from real people. We contented these are fake reviews.

       

      ********************** and his consultants comments regarding marijuana in prior communications are further fabrications. Comments made by Profit Management Solutions regarding ************************* harvesting any marijuana in prior communications are fabrications. This further shows that Profit Management Solution seeks to distort the truth and does not have the experience in the services it seeks to advise in.

       

      As proof to dispute claims of marijuana cultivation, ************************* is a federally legal company; ************************* is registered with ***************** ********** of ************* USDA ), The ************* Food and *************************** as well as the **********************************.  Profit Management Solutions knows ************************* grows, manufactures, and retails federally legal CBD products. And not marijuana as it claims.

       

      Any comments the consultant has made about employees are without knowledge or understanding of roles within *************************. This further shows that Profit Management Solutions seeks to distort the truth for its benefit. This fabrication by the consultant is in direct violation of confidentiality agreements. 

       

      Based on the inability of Profit Management Solutions to show proof of concept or provide any creditable testimony of success, as well as the lack of transparency in the conversations we have had with is agents, and now the breaking of confidentiality agreements, we feel it would be best that Profit Management Solutions refund all of the funds that it received from us.

       

      We do not feel they are a company that operates in good faith per our experience and the complaints against them very well could be true from our experience.

       

      We feel that if we do not receive a refund, we may have no option but to seek legal action to recoup these funds and legal expenses, as we advised ********************** would happen.
