I am writing to formally request the removal of an inaccurately reported charged-off account with **********************/ Career Path Account # *********** from my credit report. The account in question is being inaccurately reported in violation of the Internal Revenue Code and Fair Debt Collection Practices Act. According to the Internal Revenue Code, charged-off accounts are considered certificates of indebtedness and should be classified as income. As income can not be reported on a consumer report as a debt, the current reporting of this account constitutes inaccurate and misleading information on my credit report. The specific sections of law that support my claim include : Internal Revenue Code Section 61 ( a ) : This section defines gross income, including income from discharge of indebtedness. A charged-off debt should be reported as income, not as an outstanding debt. Fair Credit Reporting Act ( FCRA ) Section 1681s-2 ( a ) ( 1 ) ( B ) : This section mandates that furnishers of information, such as Roadmaster Drivers School/ Career Path Account # ***********, must not report information that they know or have reasonable cause to believe is inaccurate. Fair Debt Collection Practices Act ( FDCPA ) Section 1692e : This section prohibits false, deceptive, or misleading representations in connection with the collection of any debt. Additionally, I have not received the Form 1099-C, which is required for me to properly remit my taxes for the discharge of this debt. This oversight further emphasizes the inaccuracies in the reporting of this account. Due to these inaccuracies, I request that this charged-off account be promptly removed from my credit report. This adjustment will ensure the accuracy of my credit report and compliance with the applicable laws.

The outstanding obligation is currently due and owing for educational services provided by the Company to Complainant.  The obligation has not been "discharged" as such term is defined for purposes of 26 USC Section 61.  As such, no 1099-C is required to be issued.    *********** has "charged-off" the debt due to non-payment for accounting purposes, however, the obligation remains outstanding and due.    Validation of the account was previously provided to Complainant in January 2024.

Complainant does not have an account with Company.  Complainant was seeking admission to Company's commercial truck driver training program.  In connection with the application, Complainant was seeking tuition financing.  Complainant's credit report was pulled on December 6, 2022 pursuant to both written and verbal authorizations.   Complainant is likely referring to the credit inquiry from Company as opposed to an outstanding account, which inquiry was valid and authorized by Complainant.
