Seeking $750.00 deposit refund due to complete non-performance 110 days after signing contract on May 12, 2021. I invited P***** Builders to my home for an estimate to replace the screens on my back porch with glass windows and doors. My wife and I agreed with Bryan D*****'s ( P***** Builders estimator) proposal, $16850.00, signed a contract, and wrote a $750.00 deposit check. Work would begin in approximately eight weeks, August 30, nothing started or scheduled, I called Bryan D*****, no reply after 24 hours. August 31, I called for Kent P***** and left detailed message with the receptionist explaining my concerns. Twenty minutes laterr Bryan D***** called me. I told him I had been treated poorly and cancelled the contract based on P***** Builders complete lack of performance. I requested a deposit refund in full. Bryan finally agreed at the end of that call. Kent P***** never did respond. October 30, 2021 No refund, , Called, Bryan is responsible. No other replies.Business response

Business Response /* (1000, 5, 2021/10/26) */ RE: ********* complaint Mr. ********* signed a contract (see attached) in May 12th, 2021, and we estimated a start date within 2 to 3 months. Engineering was acquired and drawings were submitted to the building department. It took longer than anticipated to obtain the building permit from the City of DeBary. Permit was issued 8-11-2021 by the city. After the permit was granted, we notified the customer that we would be in touch with a start date. Two weeks later, the customer cancelled the job. Our deposits are non-refundable and it is clearly noted on our contract. (See attached) "Non-refundable" is printed at bottom below deposit amount. We require a non refundable deposit specifically to prevent a customer from canceling after we have incurred the cost of engineering and permit fees. In summary, this customer is frustrated because he wants a refund of a non-refundable deposit. As a side note, the customer asked if we accepted credit cards for subsequent payments. We do. His explanation was that he would acquire a "charge back" from his credit card company if we took too long to complete the job. This would then leave us with special order windows and no payment. We would have had to pursue him for payment on custom made windows that would be unusable on any other job. We have never experienced a homeowner that told us in advance he would be requesting a charge back if not satisfied with the pace of construction. During this time of Covid19 disruption, patience is in very short supply. Bryan D***** 407-324-9960 Prager Builders Inc ********** Consumer Response /* (3000, 7, 2021/10/27) */ (The consumer indicated he/she DID NOT accept the response from the business.) !. The original start estimate was 6 to 8 weeks. 2. If Prager Builders does not have the confidence in themselves to satisfy a customer then they should not accept credit card payment. It seems my project was never started due to lack of confidence of a successful completion. Therefore I request my deposit to be refunded in full. Business Response /* (4000, 9, 2021/11/03) */ The estimate the customer has provided for the start date is inaccurate. We estimated a minimum of two months to start and although the job took longer to begin than anticipated, this is the current state of affairs during the Covid disruption. Our deposits are non-refundable and it is clearly stated on our contract next to the signature line. We have a non-refundable clause SPECIFICALLY to prevent this situation. The money provided as a deposit has been spent on permit fees, drawings and engineering and will not be refunded. We do not wish to compel the customer to move forward with the project, only to explain why we will not refund the money already spent on obtaining the permit. Consumer Response /* (4200, 11, 2021/11/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) My error was contacting Prager Builders in the first place. For $750.00 I learned a valuable lesson in life. Buyer beware. I am not satisfied with Prager's response but I put the complaint to rest.
