We contracted with *************************** of Absolute Flooring and Kitchen Design in ******** on 6/20/22 to do a kitchen remodeling in our condo. The work was scheduled for May 2023 and we gave him a down payment of $2,102 to secure the date. In October 2022, we had to sell the condo. When we first called **** to let him know that we were not able to proceed with the work, he didnt take our calls or respond to our voicemail messages for a month. When he finally did take our call, he said that his nephew was possibly interested in purchasing our condo so we kept it off the market to allow him to view it first. He promised repeatedly that he would give us our full $2102 deposit back and his contract indicates nothing about losing your deposit due to cancellations (plus we gave him 8 months in advance to secure another job). He promised that his accountant would send us the check within two weeks but the check never came. We flew to ******** in October to close down the condo and while there, we went to his office to find out about our deposit. He dodged meeting with us for two days and when we finally tracked him down, he changed his story and said that he couldnt give us our money back because he had already received the cabinets for our job. In speaking with others who had this same work done in our complex, we learned that the cabinets are the last thing to be ordered since you dont know the exact size to order until the old walls are down. We asked to see our cabinets and he refused, becoming belligerent and threatening us with his attorney. He finally agreed to give us $1,000. We only accepted it because we felt threatened by him and knew that we could get nothing more from him. We would like the BBB to help us to get the remaining $1102 of our deposit back from this company.Business response

Good afternoon,
In respond to the complaint about a refund from Mr and **********, they were thrilled to get part of their deposit back when we explained that the cabinets were non returnable, they wanted their cabinets but they were over $4000 I told them that they needed to pay the difference in order to get them, but they agreed to get the $1000 back, as far as dodging the calls, that is not true, I am a very busy at the moment, she contacted the office and left a message, which I usually get the next day, so she was able to talk to people at the office, she was able to get in touch with someone, I was not avoiding her, I just couldn't return her call as soon as she expected me, there was never a threat, everything was arranged politely, the word attorney never came up in our conversations, I never expected them to end up writing a complaint to BBB because they were happy when they left the showroom with their check, I will definitely get an attorney if she refuses to take this complaint down, when I thought we ended everything in good terms.
