Modus Builders was hired by a tenant to remodel a commercial office space at my building, Gulf **** Professional Building , **** **** **** ****** ********* ** XXXXX. Unfortunately, the General Contractor, Mr. RJ D. began demolition of the premises prior to getting proper Permitting from the county and without notifying me, the owner. On 3/17/21, the Sarasota County Building Department cited and terminated the project for lack of permit. Now, for the last 6 months, the demolished unit has laid idle, decaying, and in disarray with no ventilation/ AC, and now has mold. Thus far, Modus Builders has not contacted me to resolve the issues or succeeded in obtain approved permits. I have had to hire another contractor to review and propose possible solutions.Business response

Business Response /* (1000, 5, 2021/08/09) */ Mr. ***** is correct that Modus Builders was hired to complete a tenant improvement at the referenced location. Due to the ambitious completion schedule we were given approval by Mr. ***** and his daughter who hired Modus to proceed with site preparation. As previously documented we noticed that the concrete slab had stress cracks and removed a partition in order to have the condition evaluated by a structural engineer. We disagree that Mr. ***** was not notified of our intention to perform this work. We also notified Mr. ***** of a roof leak that became visible once we performed the removals approved by Mr. ***** and his daughter, our client. We do not dispute that the creation of permit drawings by the drafting company hired was not done. However, our contract was terminated in writing by our client and we have not been given any notice to remediate or resolve any issues caused by our work. AFter terminating our contract we connected Mr. ***** with the drafting architect to complete the permit approval process. To our knowledge there was no further request to assist with this matter. Consumer Response /* (3000, 7, 2021/08/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) Modus Builders began their work on this project, 12/28/2020. Mr D. began the demolition on 3/15/2021 without permit approval. The County mandated a Stop Work Order on 3/17/21. The Sarasota Country Fire Department had come twice during that demolition period because of inadequate preparation of the unit. I dispute the claim that I, the buidling owner approved any commencement of this project without Modus' obtaining a permit of demolition and construction. With respect to his claim of roof leak and slab cracks, we have never received any documentation of such from his structural engineer who inspected the property. His architect never "connected" with me, the building owner. It is very clear from the county's Stop Work Order and the 4 month lack of remedy thereafter, as the unit decayed, that Mr. D. and Modus Builders had abandoned their responsibility to this project. As a result, we were forced to terminate Modus Builders and then engage a new contractor. Unfortunately, because of Mr. D.' negligence and delays, the permit application expired and has had to be resubmitted, thus further delaying completion of this project by the new contractor.
