Seeing a posting for a property in ******* ***** for rent at **** ******* ****, my daughter and I called the number to confirm its availability. I spoke with **** ******* and he confirmed he would meet us at 2:00, approximately thirty minutes from the time then. We arrived early and viewed the property. Although, a bit dated, with superficial and cosmetic repairs and updates needed, we were agreed to move forward with the lease. He sent me the application, I provided my personal information, paid the application fee of $34.95, as requested and was approved. We discussed meeting to provide the $1500 security deposit. We communicated through email on a weekend. Once I was aware he responded and agreed to meet on a Sunday, I started the process of obtaining my funding from my bank. I explained my ATM has a limit and was unable to obtain the full amount on Saturday. I inquired, via email whether I could meet Monday and obtain the full amount of the deposit via cashier’s check, or whether we could meet and I pay a portion in cash. By the time he replied, “we can do that”; all my banks had closed. I replied, I did not understand his response. I was under the impression it was ok to meet Monday. He did not confirm or deny. I did not meet him Monday and by the time I realized he expected me to meet him still, which was that evening, he stated via email that he had promised the property to another tenant. I attempted to call him, but he would not answer. I continued to communicate with him the miscommunication, that night and the following morning. I explained and he was aware I had turned in my termination of lease, due to this agreement. He had sent the lease document already with the expected move in date as October 1st. That further confused me as to why he so readily moved to the next tenant and how they were approved so quickly.
