      Due to a garnishment, somehow this firm was allowed to completely empty my bank account leaving me with no money to survive. I can't pay my mortgage, have no money for gas, and not even for food. I have attached a screen shot showing my account -59k and now it's completely empty. I feel this is illegal somehow, to leave me with no way to survive

      To whom it may concern,

      We have reviewed the complaint made against our law firm by ************.  While we sympathize with ************** situation, Modlin Slinsky,P.A. did nothing illegal or improper in handling the collection of the judgment owed by ************ to our client.

      Our law firm represents ****************************** in a matter to collect a debt owed by ************ to ******************************.  A lawsuit was filed against ************ in Miami-Dade County Court.  On March 18, 2024, a judgment was entered against ************.

      Under Florida law, garnishment of a back account(s) is a remedy that is available to our client in order to attempt to locate funds to satisfy the judgment.  Accordingly, our office filed the garnishment.  Our office does not have control of how much money that the bank held pursuant to the garnishment.  While ************ may feel that the garnishment is illegal, I can ensure you that our office followed all Florida laws regarding the filing of the garnishment.

      Per USC **** and ****, this company does not own the debt and has refused to provide proof otherwise. I do not have a contract with Modlin Slinsky. I have asked them to validate the debt. Account is a third party account. Thank you for your assistance.

      **************** has retained our firm to collect upon an unpaid debt. CM is correct in stating we do not own the debt, as **************** still owns the debt.  However, since **************** has retained us to represent them in this matter we do have the standing to collect on the debt.  Also, as requested by the CM the firm did mail Debt Validation as requested by CM on 12-13-2022.  Please let us know if you need any additional information from us.    Thank you

      We just received CMs response that we have not proved we represent ****************.  If CM is unsure if we represent **************** we would advise they contact **************** directly to confirm our representation.  The Demand letter sent on our law firms letterhead should be an adequate representation of who we are.       In the latest message, Modlin suggests I need to get in touch with **************** to seek proof of the relationship between Modlin and ****************. 

      1, That onus is not on me. It's on Modlin to prove this, per consumer law I referenced. 
      2, **************** will not give me Modlin's information. The only party that claims this relationship is Modlin.

      Complainant is a Judgment debtor in a legal action where our firm represents **************** National Bank.  We beleive CM is upset because we garnished $1926.99 from the CM's bank account due to their failure to pay our clients outstanding judgment awarded 04-02-2021. Firm has acted appropriately and within judgment execution rules within the sate of **. We have attached a copy of the Final Judgment in Ganrishment as to CM's ********** account.
