      This contractor was hired by me to do a circular driveway with asphalt. The owner was notified through various phone and email contacts that the work that was done in June 2023 had severe craking going on throughout the asphalt. The contractor charged $9,000.00 to do the job and was paid in fiull and has failed to provide a reciept as promised nor has this contractor corrected or repaired his shabby work. The contractor was also notified that there was water seeping into the garage because of how he laid the asphalt near the garage doors that had NO prior leaks with water coming into garage when it rained. The job location was ***************************************************** **

      Cracking - Customer had us paver over top of an existing concrete driveway.  The cracks he is referring to are called reflective cracking.  It's when the concrete slabs shift very slightly and cracks appear in the the surface of the asphalt that mimic the concrete joints.  If you look at the crack they form a grid, lining up with the concrete joins.  This is not under warranty.  

      Water Seeping - We did go back to the customer's property and corrected this.  The customer was onsite when this warranty work was performed.

      I am rejecting this response because:

      the business has to this date failed to provide a receipt for the work completed or a paper contract other than text history with pricing and warranty info. The business now all of a sudden claims the large cracks are not under warranty which is a false statement. The whole paving job had a one year warranty according to the owner who made that statement in front of numerous witnesses more than once. Second, the company attempted to correct the water problem coming under garage doors but has not corrected the problem as he stated once again misleading this agency. My company is a federal contractor who does compliance review in multiple areas and would not mislead your agency.

      The companys response is misleading and false. We are currently in process of considering civil litigation against the company who has provided a false response to this agency.  Then this will allow us to subpoena his phone text during that period and other records as well as subpoena the owner for deposition. The business never had any intent on standing by its warranty.

      Our warranty policy, as stated on the contract, is:

      All material is guaranteed to be as specified.  All work is to be completed in a workmanlike manner according to standard practices. Any alteration or deviation from the above specifications involving extra costs, will be executed only upon written orders, and will become an extra charge over and above the estimate.  

      Asphalt paved was from Ajax asphalt plant and is tested daily to meet specifications.  So materials are not an issue.  Workmanship was also completed in a justly manner.  We did go back to ******************** propery and correct this issue with water flowing into his garage, so this was corrected.

      **************** has consistantly harrassed me and my company with idle threats to get work performed that is not warranty work.  I've been in business for over 15 years and have never had one complaint.

      I would like for the company to provide you a copy of the contract that was accepted and sign by me. I bet he cannot and will not provide you a signed copy. Second, the company failed to provide a receipt for the money received for payment. Third, we are not harassing this company nor giving idle threats. I am attempting to give this company every option to resolve this issue. Fourth, I have an extensive background in construction and expect the contractor to stand by his word. Fifth, the contractor has not corrected the water leaking into the garage area this is out right false information being given to the BBB. ******** am not in the business of reporting businesses for no reason. It just so happens this company happen to do work for a certified federal contractor that protects consumers by conducting compliance reviews. This company consistently is providing false information to this agency there are numerous witnesses to statements made by this company prior to the work being performed. It was our mistake not getting more than a phone text and verbal communication regarding the work and contract. However, in ******* a verbal contract is binding. 

      Finally, this company is authorized to provide the BBB a signed copy of the contract this company mentions that applies to this project. BBB will then find out the shady company they are who do not provide written contracts or money receipts as promised. Then they deny warranty repairs by trying to NOW STATE they are all of a sudden not covered. Our consumer protection division has been around a lot longer than this company has been listed with the state. Also, no license can be found on this company. So the company is not being harassed they are being exposed based upon their own work and materials, otherwise I would not be filing this complaint. Once again tell the company to provide to the BBB a copy of the signed contract and a copy of the receipt for payment that was promised and never received. If your company is not shady you would have no problem providing those documents. I authorize you to provide the signed contract  to the BBB who  an scan and share to me by email for verify of my signature.
