This creditor bought an account after the original account was disputed. . They received a judgement while the defendant dealt w serious health issues. That judgement later transitioned into a "garnishment." However, the disabled adult (the original and ONLY account holder of the creditor) filed for an exemption under the qualification that he is in fact disabled. It was granted and signed off to dissolve said exemption by the local clerk of courts 26 October 2022 (Certificate of Clerk Dissolving Writ of Garnishment pursuant to Section ****** (3) F.S. On 17 June 2024. "I" received (again, I am not an account holder and it is NOT my debt) notice from my financial institution that monies from my payroll in those accounts is flagged to be garnished by the creditor. It appears since the disabled adult qualified for exemption, they filled out more (misleading) paperwork in the SAME case requesting it reopened and for garnishment. They have full knowledge the credit account holder is exempt, as they listed MY name- and the 2 accounts that MY payroll goes into (again....NOT my debt)- AND broke the debt up with a ratio that corresponds similarly with my payroll disbursement ratio (this can literally be seen on the paperwork they filed on the ORIGINAL case- that the original garnishment was legally dissolved on (filed)....UNDER SEAL...leading one to surmise they knew what they were doing was inappropriate, incorrect, illegal, unethical, whichever way they choose to view it. But that is okay...I already have it in motion to not only stop this prior to the deadline- but I also spoke to several attorney's who handle these type of attorney debt collectors and they have received all of the paperwork showing it all as true as I stated- and the representative from O&L telling me they can do this to me for 20 years is going to find out I knew better, JUST as I explained to her via telephone (make sure you archive that call for legality purposes as I requested NUMEROUS times.

The complainant on this review is a co-account holder with a consumer who our client holds a valid judgment against. Prior to filing the most recent garnishment our office attempted to ascertain the familial and economic circumstances of the consumer by sending out a Fact Information Sheet in November 2023, to which we received no response. We then filed a Motion to Compel Fact Information Sheet in January 2024, once again the consumer failed to respond. Based on the consumer's failure to comply with the law, the Judge entered an Order to Compel Fact Information Sheet on January 25, 2024. The consumer once again never responded. Only then were we forced to proceed with the instant  lawful collection activity.
