We signed the contract with Alex with point construction on May 25, 2021. We told him we needed a complete package (pool, pavers, infinity lanai, and plumbing and gas for an outdoor kitchen). He gave us an estimate and we gave him the deposit. He ordinally stated the pool would have an estimated completion date of September or October 2021. Alex stated the pool would be completed 30 days after the shell. We were under the impression Point Construction had a permit in Manatee County to build pools. However, we found out through emails between the county and point construction that that was not the case. From the beginning had we known there was not an active license to build in Manatee County we would have never signed the contract. Alex assured us this would not affect our pool construction. On July 19, 2021, the yard was cleared for pool construction. On September 15, 2021, the shell was completed. After the shell was completed there were many issues. The hole for the light was in the wrong place, the spa jets were also not in the right place, and the top of the pool had to be releveled. On October 16, 2021, the tile was finally completed for the pool. There is broken coping along the pool which we informed Alex that needed to be fixed. Alex stated he would have his crew fix it. To this day, they are still not fixed. On October 18, 2021, Alex stated the home run was completed and wanted the money for the cost of the home run. We were unaware he was doing the home run. Alex stated he doesn't want other people doing the home run. We told him that should have been our decision since he is requiring us to have a home run. We told Alex the home run was not even completed. The home run was just a group of wires attached to our home. On November 23, pavers were delivered. As is today, the company's website has been taken down and he is not returning our calls. We have lost about $40,000 and our pool is only 75% complete.

Consumer Response /* (3000, 13, 2022/03/09) */ There was no solution made by point construction. They told us to remove the complaint from BBB. They refuse to issue a refund stating the money was already spend and there is no guarantee they would finish our pool. Consumer Response /* (3000, 14, 2022/03/08) */ No solution was made by point construction. Consumer Response /* (3000, 15, 2022/03/08) */ No resolution from Point Construction regarding pool status and money given to Alex K. They stated the money was already spent by Point Construction and there was nothing to refund even though the pool is incomplete. Business Response /* (4000, 17, 2022/03/10) */ Owner asked us in writing to terminate the notice of commencement with the city as they did not want to wait for us to complete the work. They decided to move on from our company to pursue another contractor. this is all in writing and they demanded to move on and we agreed to terminate the NOC per the owner request so that they can find another contractor that can finish the job faster than we were able to do. They also agreed to remove the complaints as this is their choice to not wait, but we see that now they have decided to not honor their agreement after we did our part to terminate the NOC to allow them to move their permit to another contractor Consumer Response /* (4200, 19, 2022/03/10) */ (The consumer indicated he/she DID NOT accept the response from the business.) We have recorded conversations stating there was no guarantee they would be finishing our pool. We have other evidence that supports our facts. We also were coerced into agreeing to drop a citizens complaint with only the county. Which per our agreement we did. We made the agreement with Point Construction to sign the NOC to allow us to refinance the home to finish the pool in which we already paid them for. We were told by point construction to file a complaint with their bond complaint to allow us to get our money back. Their bond was only $5000 which is no where close to the cost to finish the pool. To this day we still have not received any resolution for the pool or the money we already paid them. The contract was for approx $67000 and we have them approx 60,000. The pool still needs approx $30,000 worth of work.

In June of 2021 we contracted with Point Construction to build our in ground pool and complete our yard with pavers and K9 grass for our dogs. We have had nothing but delays including them failing plumbing inspection 5 times. After they finally past inspect and we thought the project was moving forward our pool popped out of the ground. An issue they claimed happens from time to time. They said no worries, we will submit a claim with their insurance company for our project. This happened on or about Nov 11th. the claim was denied on Nov 22.Since denial Point Construct has done nothing to resolve our pool issue. Our pool is still popped up on one end. out backyard is unusable for anything. The refuse to continue the project, remove and replace the damaged pool. They continued to ask us to sue them. We want them to correct the current issue and complete the work as contracted without us have more expenses. We have paid them $50,442.80 with 2 remaining draws of $6180.35. Please help us get this resolved, we don't want to get stuck like the people who hired Olympus Pools.
