      I paid for services and wanted to cancel, they told me I couldnt cancel.They blocked me from getting in contact with them to reschedule and have kept my ******** I cant reschedule because they blocked me from everything and they kept thousands of dollars of my money.

      We understand your concerns and would like to clarify the situation. The surgery was canceled and rescheduled multiple times, and unfortunately, there were instances where appointments were not attended. As a result, a refund was issued to you for the payments made.

      We have also received communication from you that included threats and inappropriate language. In response, we informed you that we would handle further communications through your attorney and would no longer engage in direct discussions.

      If you have any further questions or need additional assistance, please direct them to your legal representative, who can communicate on your behalf.

      They did not issue me a refund I have bank statements to proof it and I never rescheduled any appointments because they blocked me from communicating with them. I never threatened them in anyway. I would like my money refunded.

      They have acted unprofessional and should not be allowed to keep my money that I paid them 

      I feel they will retaliate against me because of this complaint

      The doctor and staff at Tampa Bay Body Sculpting has completed a series of unethical practices in my case. The first one begins with the disclosure form that was not sent to me until May 31st although they collected my payment in March. This is unethical to collect my payment before providing their disclosure form. The disclosure form went over policies and non refundable payments that was not made aware to me. This form required a signature which I did not sign. This business is disputing that the document is the same as the payments form which is false because the forms have different information on them. The fact that the disclosure form was not discussed or presented to me made the payment form misleading as it convey that a signature is required for authorization of payment only. My second concern is the fact that this doctor is willing to perform surgeries on patients that he does not consult on phone or in person. I have attached confirmation the doctor did not provide a consult when I did alert the office that I had questions. They are trying to dispute that I did not schedule a consult when in fact it is the providers responsibility that the procedure is understood by the patient and there is nothing in writing saying I refused a consult. Instead they were going to have me sign a consent under duress based on the circumstances which violates the law. The third issue is the fact they locked me out my patient portal and will not allow me access to see my medical records. I have requested my records and they will not grant me access or send documentation. This is a federal violation. The doctor has prescribed medication, ordered labs, and assessed my medical history which makes me under his care but has declined to answer my questions. I have not received a written notice that this doctor is refusing me as a patient and they continue to withhold my funds despite their negligence and unethical practices to collect all your money and then say no refund

      Business Response /* (1000, 6, 2022/06/09) */ All patients receive the exact same information regarding disclosures and payment agreement as this patient and with that Tampa Bay Body Sculpting has over 600 public reviews maintaining a 4.7 star overall. This rating is based on the many patients who are happy with the processes we have in place for expedient communication, Q&A regarding the procedure, scheduling, payment, aftercare, results, etc. This review is solely based on a patient who did not clearly read nor communicate with us and did not show up to surgery on 2 separate dates which were scheduled and rescheduled to accommodate this patients requests. For the most part, consumers do not write to BBB if they are happy, they write to BBB if they want to slander of extort a company based on their own irresponsibility. The DocuSign receipt is a duplicate of the 3 Payment Agreements this patient signed prior to processing payment. The only difference of the DocuSign is a reminder of the surgery appointment on the second page, and an acknowledgment that patient has paid in full. This patient is an out of town patient who elected to have a virtual consultation and meet Dr. on surgery day as all patients do prior to surgery. The option to have a consultation with Dr. prior to surgery is offered in patients' original quote. Patient had not asked for an in person consultation since she is out of town or one would have been scheduled for her. Our Medical Team is available to all patients as they prepare for surgery to review what to expect with the procedure and to answer all questions they may have. Our patient portal is for patients as they prepare for their surgery. There are no medical records on this portal the patient is not already in receipt of. This patient did not show up to her surgery on 2 separate occasions as a "no show", so there are no medical records to release. We have been in contact via email to answer all of this patients questions and threats. All payments made towards surgery are non-refundable as Dr. and Medical staff are scheduled in addition to surgical supplies and anesthesia being ordered and in this case opened and disposed of because this patient did not show up for surgery. This is clearly stated in the payment agreement to which this patient acknowledged and signed three times. Patient did not show up to surgery on 2 separate occasions when the Dr. and all staff were waiting for patient with all surgical supplies and medications open and ready to be used for surgery. Patient was given all information regarding our scheduling and refund policy prior to us receiving payment just as all patients do. Patient tied up the surgery schedule 2 times as a "no show" and were fully aware with signed acknowledgment of our company policies. When patient was told this she threatened making accusations on social media and in multiple public forums which now is extortion. This business is making many untrue statements and I ask that they provide the proof that they are stating. I never opted for a virtual consultation and they did not make it clear how the consultations were handled. Their website states to fill out the form and they will be happy to schedule a consultation yet they never scheduled one for me. Please ask the office to provide the information where I stated that I opted for a virtual consultation. As they stated my first "consultation" would have been on the day of surgery where I would have heard information regarding my procedure for the first time. This opens the door to a patient signing a consent under duress which is illegal and will make void a consent. They also stated that I was told about their disclosure form but I will attach where they sent my disclosure form to me two days prior to the procedure. This is when I called to question things and I did not sign that document. They said that this form is the same as their payment form but I can assure you that their disclosure form and payment form has different information on them making them two separate documents. I will also attach those documents. The doctor ordered medication and labs therefore my lab work is part of my medical record and they refuse to release this information to me. Not once did they inform me that I am no longer a patient therefore I should have access to my portal to review my documents and prior conversations and also to show that I asked questions within the portal that went unanswered prior to surgery but they do not want me to access this information as it will point out to their liability. This office has kept over $7,000 dollars and will not return any of it back even though they did not perform the service and they never sent the disclosure form to me prior to the payments. This is not right and all patients should have the disclosure form presented to them and signed prior to the office accepting payments rather than collecting money in a deceitful manner and then telling the customer that there are no refunds. They're also claiming that I held up the schedule twice. The first appointment I missed was due to a storm that killed two people and from being under a tornado warning which I will attach. I sent the office the real time weather and a picture of my location. They will made me pay a $500 rescheduling fee. The second time is the one we are dealing with now when I realized how deceitful they were being be not sending me a disclosure form and making me feel uncomfortable about the procedure. I was on the way to the procedure but no longer felt comfortable with the staff and doctor performing a procedure where death is a risk after calling out what they were doing which is why I turned around and asked for a refund which is within my right. Attached you will see the discrepancies in two of their disclosure forms along with the payment form. All three are different documents and they are misleading to the customer which is why it should have been presented to the customer, signed, and dated which they do not have. The payment form is misleading because the only thing they make clear is that the deposit is non refundable but they use the same form for the deposit and the rest of the payments to make you sign that all payments are non refundable. If the disclosure form was presented like it should the customer would understand that fully and know what they're signing. The system they have shows how deceitful everything is set up.
