      The complaint is the cost estimated by a Freightliner(the manufacturer) repair facility to repair the pollution control system as well as associated parts and/or systems that can be damaged due to the nature of the modification(Egr Delete) of the system. I believe the dealer should be held responsible for being negligent, deceptive, and/or ill-knowledged about the repair which IS legally sensitive and central to the use factor of my trucking company as i had zero intention to purchase my first truck for my company for it to be Illegal to operate. I have invoices that document and date my company coming into the knowledge that I was sold this truck that is illegal to operate on any state roads per **************** Statutes Title XXIII, chapter 316, section ****. I, unfortunately have reason to believe that the dealer did not intend nor desire to disclose this condition of the truck to me being that never throughout the negotiation did dealer mention any such modification nor did dealer disclose the reason for me signing a "Vehicle air pollution Control Statement in any form or fashion which absolves the dealer from responsibility. I do have knowledge of this practice and in the search for my companies first truck objected to dealers that where selling these types of units. I hadn't entertained the idea IN THE LEAST! I was told by Freightliner and it seems logical that there is only two ways to get non emissions truck engines and those being to install an engine from a non emissions year or to delete it through evasive manipulation of the parts and wiring. THE DEALER of my truck would know these things and if not is negligent in my opinion. "Non Emissions" IS ONE THING BUT A EGR DELETE IS ANOTHER. nON EMISSIONS insinuates that the engine whether it be manufactured WITH the vehicle or from another vehicle, is not fitted BY THE MANUFACTURER with any pollution control parts or systems. THAT'S a non emissions vehicle. The engine in the vehicle I was sold has what WAS, and what is left, of the complete EGR outfitted low emissions controls. How can the dealer advertise the unit as a non emissions truck with the system visually sitting there on the engine. This is an obvious delete to a person who is claiming "non emissions" because as I said it would not have ANY emission parts. BUT as the buyer I would inspect it as a complete motor that is intact. What buyer has the equipment needed to check something like this. Deletes are designed to circumvent DOT AND FMCSA enforcement by engine if not from a non emission year appearing to be intact. IT works but it is illegal, i can't do anything but get it repaired. I've made attempts to resolve this issue with the dealer but was told not to call or visit the place of business in *****, ** after I rejected there mechanics whom has cost me thousands in repairs that they could have done, that I've HAD done, by Freightliner, and ******* Diesel whom said that the new repairs they've noticed are improper. And to add the owner ******* stated their assistance in repairs would be done at my expense. Improper workmanship at my expense? There is no way they could do this work if there work has been seen as improper. The estimated parts list is very long an ****** dollars to repair. There is also an injector problem that most deletes cause that is **** dollars. I am asking dealer to return, refund, ********* and keep the other ****** for a 30k truck on average that has 15k in repairs. sorry and thx.

      ***************************** owner of Nightingale Freight Expediters visited Broadway Chrome Saturday November 26th 2022 to inquire about a 2007 Freightliner Columbia Vin# ***************** on our lot for sale. **************** showed high interest in this unit and was given information on purchasing options. At that time he was given the opportunity to look at the vehicle and have his own mechanic inspect the vehicle as well. The vehicle was being repaired at that time, so he was unable to test drive the vehicle but was given the option to test drive at a later time before he gave any down payment. 

      On November 29th, 2022 a deposit (down payment) was received via wire transfer from **************** for the purchase of said vehicle. **************** was aware of all the work that had already been done to the vehicle and was informed that the vehicle had been completely restored(complete paint on body, new tires, ecu (computer), new air cooler, hood brackets, complete PM service, brakes, new flooring, new seats, and list goes on) see all receipts attached. 

      We continued to work on the vehicle for several more days and repaired other things **************** requested and did not request for us to repair or replace. Cab air bags, rear air bags, bushings, and cleaned out the fuel tanks was some of the other repairs completed. We also replace the turbo valve and replaced the air conditioning system. At this time he took the vehicle out on a test drive and vehicle was driving fine but did notice that one brake chamber did need to be replaced. Instead of replacing one brake chamber as requested by the purchaser, we went ahead and replace 2 brake ******** at no additional cost to the customer. 

      After all repairs were completed customer took possession of the vehicle. Several days after taking possession he called and stated Freightliner dealer told him all injectors were bad on the truck. I explained to **************** that the repairs could be done at our place of business at a fraction of the cost for the injectors. We would cover all labor cost and the two injectors that were under warranty. Other injectors would not be covered under warranty as its a wear and tear item. The customer stated he would call me back with further decision. When he did call back, several days later, he stated he called ******* Detroit and explained the situation to them and was informed that the injectors were not the problem with the vehicle it was something else. Again, I offered the same remedy as previous, bring the vehicle in for further diagnosing and we can come to an agreement on repairs. He then stated he would contact us with a decision at a later time. 

      On January 20, 2023 **************** called and stated the *** had been deleted. I stated, if the *** was altered, we would go ahead and repair it at no cost. **************** proceeded to threaten with legal alternatives, which I then told him to go right ahead and I would also seek legal advise if necessary.  Broadway Chrome is not aware that the *** system has been altered since we acquired the vehicle with the *** system visible and the vehicle left our lot with the *** system. We did not delete the system but we would definitely diagnose the vehicle and repair the *** if that is what is truly wrong with the vehicle.

      From my experience and the conversations Ive had with ****************, he is unaware of what exactly is wrong with the vehicle. He was first informed that the injectors were the problem but now he states the problem is the ***. Broadway Chrome is willing to diagnose and repair specified parts and labor for any problem the vehicle is having with the ***. The vehicle has to be at our location in order to complete any diagnosing and repairs.

      Broadway Chrome takes pride in all our work and sales. We have never defrauded any customer and dont intend to now. We have a very good reputation in the trucking industry. We completed so much work on this vehicle and other vehicles on our lot as necessary to get them in a great manner for sale and we help all our customers regardless of AS IS purchase.

      On or about June 16, 2022, my client, ******************, purchased a 2015 Cascadia 125 Freightliner listed on ***************. The contact listed was Broadway Chrome & Parts LLC. My client paid $35,303.00 for said Freightliner. The advertisement, however, contained numerous critical inaccuracies. Firstly, the listing states that said ************ was being sold with a DD15. However, said ************ was actually sold with a DD13. Further, said listing states that said ************ was sold with an *************** Unit, however, this was not true. Said Freightliner did not contain an *************** Unit. Next, the listing states that said Frieghtliner is located in *****, *******. However, after sending over the wire and paying for said Freightliner, my client was told said ************ was in ******* *******. When my client's agent went to ******* ******* to pick up said Freightliner he noticed that it was inoperable. It would not even turn on. After said Freightliner was jumped, all the lights turned on but it did not travel at a speed higher than 5 mph. My client's agent took said Freightliner to *********** Truck Centers. After *********** Truck Centers ran a diagnostic my client was informed that said Freightliner was missing its DEF and DPF Systems. It is actually a crime to operate a Freightliner without said systems. Said systems are worth around $38,000.00, which is worth more than the Frieghtliner itself. Clearly, said systems were intentionally removed from the Freightliner. Now, my client has paid $35,303.00 for an inoperable Freightliner and he is not even in possession of the Freightliner. My client demands to be reimbursed the $35,303.00, or, in the alternative, to be provided with the Freightliner in an operable and working condition.
