On January 11,2023. I made a vehicle purchase with the luxury Automall here in Hillsboro county on **************. At first the business cannot get me approved for a vehicle a couple days later the company calls back and pretty much forced me into a 2018 blue ******* sonata limited told me the car was a really great car very dependable and reliable. The car had ******* miles and the engine light was on. I asked the sales agent about the concern of the vehicles issue. He assured me that there was no issues with the vehicle it had been serviced, and the light just never had time to go off. I was denied test driving the vehicle before I purchase. I also was denied the option to check out another vehicle that I may have like I was forced into the vehicle. The company had asked me for a personal bank statements where they base their judgment on selling me a lemon, and taking my money based on my deposit that was posted in my account. However, the car is now broke on January 19, 2023. I contacted the dealership management **** first thing this morning since the car had cut off for me the night before, and the brakes hat went out. I contacted him the previous morning in regards to the issue where he replied, you didnt have good credit anyhow and you only put down $1000. I feel you got a **** good car based on your credit history and we already got our money for the loan so you figure out how to get the car fixed hung up in my face and blocked me. When I try to reach out to the other GM of the company, no one will answer or return my calls. The company is a fraud. They had me tell the finance company I gave them $2500 down when in actuality, I only gave them $1000 down.

I am rejecting this response because: They are lying about explaining how it everything works. They did not explain anything about the car. I told them I do not want the car.

I only signed the deposit paperwork because they made me. I did not sign the final paperwork on the 19th, the car is not mine, and told them I needed to think about it. I have a right to decide against purchasing the car.  On the 20th I told them I do not want the car and now they are trying to force me into a position to close on a bad deal to keep my money if I do not take the car.

      Sincerely,

      ***** Caricaber

On 5/21/22 I traded a 2014 Mercedes S 550 vin WDDIG8CB1EAXXXXXX to Luxury Auto Mall for a 2019 Dodge Ram 1500 crew cab vin 1C6SRFFT8KNXXXXXX. I was told that my deal was approved with Anchored financial. No proof of income was required, however, I provided 3 paycheck stubs and proof of insurance and residency. Luxury Auto Mall promptly sold my trade in vehicle on 5/22/22 and are now demanding I return the 2019 Dodge Ram due to know financing. They don't have my trade in vehicle and do not intend to compensate me the money they received from the sale of my trade in. My first car payment isn't due until 7/5/22 and they're demanding the truck be returned saying it's being repossessed. The temporary tag was ripped away from the truck by the sales manager Matt. They have baited and switched. The demeanor of Matt and a unnamed employee who only identified himself as "the owner" has been both aggressive and intimidating now that they have sold my trade vehicle.

Business Response /* (1000, 10, 2022/06/30) */ Good Afternoon, we apologize for any miscommunication that could have been between the dealership and Mr. ********. We had the customer approved through one of our financial institutions and he gave us his vehicle as trade in. However, the financial institution needed more stipulations from our customer (Mr. ********), and he will not provide those to us, unfortunately, we had to reposes the vehicle being that we could not finalize the deal with the bank for missing stipulations. Consumer Response /* (3000, 12, 2022/07/02) */ (The consumer indicated he/she DID NOT accept the response from the business.) There was no "miscommunication" between myself and this dealership. It was deliberate deception. They claimed to have had an approval with Anchored Financial on 5/21/22, I was instructed to add Anchored Finance as lien holder with my insurance company which I did. I provided proof of income in spite of being told it was required. They're claiming the lender requested additional "stipulations", however, I have been in direct contact with Anchored Finance and they have assured me that No application for financing was filed with them on 5/21/22, they did not receive an application until 6/7/22 which was denied. There was no approval pending "additional stipulations", that is 100% false. Furthermore, Luxury Auto Mall informed me that my current Lien Holder Pen Fed also denied my request for financing when they in fact approved me for $42,621.34. This dealership maliciously misled me from start to finish of this transaction and robbed me of my vehicle. Luxury Auto Mall sold my trade in vehicle 30 days before satisfying lien which violated the 10 day time period required by Florida Highway Safety And Motor Vehicles. Consumer Response /* (2000, 15, 2022/07/13) */ Luxury Auto Mall and I have reached a satisfactory settlement agreement.

While he was yet screaming at me I was still on the phone with the finance Company, the representative then instructed to call the police. I did so and while waiting on police to arrive they hurried up and locked the business and left. on 1/5 ******** ***** 5/3/2003 SSN ending **** purchase a car from Luxury Auto Mall 7414 N. Florida Ave. Tampa FL, (XXX)XXX-XXXX. The first car that he was to purchase failed inspection VIN ***************** with 64,000 miles and they put him in a second car 2015 Mercedes Benz C300 VIN ***************** with 116,000 miles. How is that without seeing what he qualifies for to establish credit. Financed in one day $21,347.09, down payment $5,000 and monthly payments $573.19, his take home pay is not even that much! The bumper left side is not connected, engine light is on, tires bald and have over 20 service codes errors. Three of the codes was Internal combustion engine, electrical and misfiring. He wasn't given an Carfax or vehicle history. Spoke with Julio from Westlake and he stated it wasn't noted and the company wasn't aware of the pre existing contract issues of the car, the wrong mileage and he can cancel the contract. I called the manager at Luxury Auto Mall, he stated they wasn't aware of the issues of the car and set a appointment so they mechanic can look at it. I stated that ******** would like to cancel the contract and why should he have to make an appointment for pre existing issues that they knew of and the car left the lot with defective problems and do I need to get a lawyer! He stated since you said that I'm disconnecting the call and he hung up! The salesman/dealer have lied and selling a 'lemon car' by not disclosing any pre existing issues of the car.
