I started working with this company on 2/23/2003 at which time I was given a quote to paint my driveway. They insisted I give them a deposit of $385 before doing the work, which I paid on 4/1. They were supposed to paint the driveway between 4/21 and May 6th leaving enough time for it to dry completely while I was away on vacation. When I returned I was very disappointed that the work had not been done. I asked for a refund but they plead personal excuses and I agreed they could paint it the next week. At that time they painted with a completely wrong color, (bright red instead of brown). After complaining again, they sent a painter out again and again used the wrong color. Now the paint is peeling all the way down to the original color and looks terrible. I asked for my money on back on May 22, and again was refused. I advised I would report them to BBB and Small Claims Court and they then agreed to I would have my money back within 5 days, which would have been 5/27. On June 3rd they texted I would have my money by Thursday, 6/7, It is now 6/12 and I still have not received my money. I have pictures and all text correspondence if needed. Thank you for any help you can give me.

      Business response

      06/22/2023

On 2/23/23 ****************** contacted Paint Rescue about re-staining her concrete driveway. At that time we gave her some options of things we could do to help her.
The first option that was recommended to her was to apply stripper to the previous paint/stain, pressure wash the driveway, sand it, then apply a concrete cleaner, let it dry completely, apply paint/stain and then a concrete sealer.
This price was quoted at $2450.00
The second option, which was not recommended was to pressure wash the driveway, chip and sand any loose areas and simply reapply new paint/stain. This price was quoted at $800.00. We also advised her that this would be a temporary fix and we had no idea how long this would hold up. Hence, why we recommended the more expensive option to do the job correctly.
On 4/1/23 ******************** hired us to do the unrecommended option of $800. She requested we do it while she was on vacation at the end of the month which we scheduled. At no time she did give us a specific color to paint her driveway. She told us she wanted a similar color of her driveway as it was. The paint/ stain on her driveway was very old, hence needing to be redone. The previous color was faded in a lot of areas and darker in some. We matched it to the color sample we got from the driveway. We took samples of her driveway and went to ******************************* to have the paint color made.  At that time (4/1/23) she paid a deposit of $385.
During the time she was on vacation it rained. Unfortunately, our crew cannot go out and pressure wash a driveway and paint/stain it while it is wet or raining. We work on a schedule and everything got pushed back. While It was not our intention to push back scheduled jobs we had no choice but to do so with the weather. We were also unable to reach ****************** during the time she was gone because she was on a cruise. When ****************** arrived home from her vacation we spoke and I scheduled her for another date.
On Monday, May 15th we went to her home and performed the job. The color ******************************* made was wrong. We went back to ******* **************;and they acknowledged their mistake and we came back out the very next day, apologized profusely for the inconvenience and redid the driveway in the correct color. During our time there she asked us to fix her garbage disposal, and clean out her dryer vent. We normally do not do this but since the weather issues that were out of our control and color mishap we gladly did this to help ******************** out at no charge.
(For this area to have someone come out and clean your **** vent is about $125. To fix a garbage disposal is about $175.)  We did this completely free just to make sure she was a happy customer.
On the second day we were completely finished with the job. She had not even been sent the final invoice yet and she called and said she wanted her money back because it was the wrong color. Mind you, she never gave us an actual color. We took samples from her driveway and color matched it. It was an EXACT match of the sample we took from her driveway. We apologized and told her then, we do not give refunds but we will be happy to come out  yet again and redo it with an exact color of her choice. All she had to do was give us the color code.

      There was no reply.

Days later she messaged and demanded a refund on her deposit of $385 and if she didn't she would go to the BBB and the local news station. Still, we kept asking to come out and redo it to her liking. She demanded a refund and also said we were not allowed back on her property. Only then, did she say the paint was peeling from her driveway and looked awful? We have offered numerous times to come out and fix anything we need to. We have been denied. To this day, we have never even seen a picture of her driveway peeling? Nor are we allowed to go see it.

In short, we gave ******************** two options to paint/stain her driveway. She choose the unrecommend one at a lower cost. We have pressure washed her driveway and painted it twice. We have performed over $300 in free handyman fixes around her house.
We have kept her in loop with almost daily phone calls. She has REFUSED to let us fix the problem, or even go see what the problem is. To date, we have no proof there is an actual problem. She has refused to let us come by and view and fix it or send any photos to say otherwise.

Unfortunately. our field is littered with contractors who show up late, are messy, are always over budget, and never keep in contact. We have done none of that with ******************. We pride ourselves on having the best relationships with our customers,  We are a family/veteran/firefighter-owned and operated painting company. We have managed to build a name for ourselves in the Tampa Bay area by providing outstanding customer service to each and every one of our clients.
We have gone above and beyond for ****************** not only with product costs, time and labor but with trying to go above and beyond to make her happy. She has bad mouth our company to all the clients where she lives to the point that we have had to cancel jobs that were already set and scheduled, causing our company to loose out on further work. At this time, as sad as it is, we will not be giving ******************** her deposit of $385 back. As a company we have completed the work we were hired to do. Final payment is due upon completion. ******************** owes the remainder of her final bill of $415 and has owed it since May16th when the work we were hired to do was completed.

On 2/23/23, *********************** gave me two quotes to paint my driveway, one for $2450 and one for $800, I have in writing that he said he thought the $800 quote would work good. As a 70 yr old single, retired woman living on a fixed income, I chose the $800 quote. He proceeded to take chips from my driveway to take to ******************************* to match the color.
****************** is a fireman and I thought I could trust him.
Also, several other residents here in our development have had their driveways painted for $800 by other vendors and they have been very nicely done.
I hired Paint Rescue on 4/1/23, paid them a$385 deposit, and asked them to do the driveway between 4/21/23 and 5/6/23 in enough time to dry while I was on vacation. I made arrangements to park my car elsewhere so the job could be done.
I was very disappointed when I returned and the job was not done. I asked for my deposit back at that time and he refused. He said he would give me a discount, instead he had his painter do a couple of little repairs for me. I agreed as my garbage disposal was not working, all his painter did was use my ***** wrench to unlock the disposal which took less than two minutes and hooked up a shop vac to my dryer hose which only took another 5 minutes.
******* told you that the job was not done because of rainI checked with the lady who was watching my house while I was away and she checked her calendar and said it only rained twice, once on 4/26 - .7 of an inch and once on 4/30 - .2 of an inch. I have in writing that ****************** told me the reason the job was not done was because he lost a painter and his wife lost her job during that time, and things were just not going good for him,  he never mentioned the rain to me.
He also stated that he made daily phone calls which was a liewe corresponded by texts and I have copies with the dates and times of all of them. He also states that he was told he could not come back into our development, I never told him that. Our HOA president may have told him they could not do anymore work in here as she saw the terrible job they did on my driveway. He also stated that I threatened to go to the news channel.that was not me, that was another resident here that was also trying to get her money back. I did threaten to go to BBB, FB, Nextdoor Neighbor and SCC, but never to the news channel, although I did call them after I sent my letter to you.
At any rate, Paint Rescue LLC painted my driveway the wrong color twice, I stayed off the driveway for the amount of time I was told to, but within a week the paint was peeling and looked terrible. I had to hire another painter to repaint it. It is now the right color and looks great. I would never recommend Paint Rescue LLC to anyone.
