      Complaint: 20711689

      Background: In March of 2023 we met with JP(*****************) LeBel and hired him to perform work on our new home that was in the final stages of being built at ***********************************************************************. It was to be a 3-phased project to include: Landscaping; Gutters and Downspouts; Pavers. The total amount of the project was in excess of thirty one thousand dollars. Payments were made immediately as invoices were presented. This dispute is for damage that was done during the paver installation phase.

      Paver installation began on June 5 and was completed June 7, 2023. During this phase of the project 4 skids of pavers were moved and stored in our driveway.

      Damage-Avocado: The first email regarding damage done by the paver crew was sent to JP on June 7, 2023. Our newly installed Avocado tree ($240 - from the Landscape phase) was damaged and we requested JP advise us on how to give it the best chance to survive. The tree sustained damage to the trunk and 5 branches were completely broken off. JP LeBel stated that he would come by, check the health of the tree, and advise next steps (please refer to the AvocadoCorrespondence.pdf). Despite repeated requests for a meeting time, that did not occur. We were forced to consult another gardener for recommendations on how to save the tree. We remain hopeful it will survive.

      Additional Damage: Since JP LeBel never met with us after the installation was complete, we emailed him on June 26, 2023 to described the additional damage that was done by his crew (please review the LeBel-Correspondence.pdf). None of this damage was reported by LeBel Landscaping LLC. His crews certainly would have known damage occurred but it was left for us to discover. Besides the Avocado tree, our driveway was gouged by the fork truck, our new fence was scuffed, and the lower panel on our garage door was dented in two places. We decided to leave the driveway as is, and tried to fix the fence ourselves.

      Damage-Garage: As seen in the picture from the LeBel-Correspondence.pdf, the center damage to the garage door was only a few inches off the ground. The damage appears to have been made by either the fork truck blade or the pallet itself being pushed into the door. We had ***** (original door installer) come out and provide us a quote which was $672. We initially thought/hoped they would be able to repair and hadnt expected that the cost would be more than a nominal amount.

      JP LeBel didnt respond to our original email, so a follow-up was sent on June 29, 2023. Again, no response was received, so we initiated a dispute with Discover Card (Original form of payment). We attempted to dispute only the $672 for the door panel of the over $7k paver installation invoice. JP LeBel did finally contact us on July 13, 2023. His email communication at 5:34PM in the LeBel-Correspondence.pdf states he is willing to pay for the door panel. Discover Card ultimately told us they could not partially dispute that transaction and directed us to have LeBel Landscaping LLC credit us the amount. We communicated this to JP LeBel multiple times, but all communication was ignored.

      After having the panel replaced, we contacted accounting at LeBel Landscaping. We were told after receipt of a copy of the invoice, we would be issued a check. Then, in an email on October 3, 2023 JP LeBel stated he is now refusing to pay for the damage.

      Dispute: This dispute is specifically to the damage done to our garage.

      On Nov.29 2021 I received a landscaping proposal from Lebel Landscaping through Darren. We were working together on my front yard design. He responded to my emails quickly and gave me lots of ideas in the design. He even changed things around so that he kept in our budget. I was very happy with him. We went along with the process and everything was done in a day on Dec. 7, 2021, for $4,793.90 which we paid in full on Dec. 11 2021. They did a beautiful job and I had every intention of having them install more lighting later on. On March 1st, 2022 I sent an email to Darren showing him pictures of some of the plants that didn't make it through the winter. He responded quickly and replaced the plants. There was one plant, in particular, this is the one I have the complaint on, the Camellia was dying. They tried to revive it by cutting it back but it just died. This was around April. In June I reached out to Darren again because I didn't hear anything and I was informed that he couldn't find the right color plant and if I wanted a different color or just a refund. I responded quickly asking which colors. No response. A month later in July, I emailed him again asking about the colors. No response. I keep calling and getting the run around. At this point, I do not think they will replace the Camellia so I will take the refund.
