Please read the description to the ** Atty ******* attached. This tells the facts in detail. This is an engine purchase that when the engine failed on the maiden run the owner, ***********************, came out of the gate with several false accusations to avoid upholding the 90-Day Warranty. We have sought information on handling this situation to stop this from happening to other unknowing, honest buyers. We are seeking a full refund since **************** refuses to do the right thing. If you need a further statement other than what has been sent to ** Atty **** please contact me immediately.

I appreciate the opportunity to address this matter and am committed to resolving any issues our customers may have experienced. After the sale, I understand that the motor was installed and initially running well, as reported shortly after the pickup. It has come to our attention that you experienced issues with the motor approximately a week and a half post-installation, leading to a situation on November 4, 2023, where the motor was reported as seized. It's important to note that engine seizure typically results from factors such as lack of oil, overheating, rust or corrosion, hydrolock, or inadequate maintenance. Generally, these issues are directly related to the vehicle's usage and maintenance post-purchase. In line with our warranty policy, conditions arising from the aforementioned causes, which are typically under the purview of the vehicle owner or driver, result in a voided warranty. Additionally, our warranty terms stipulate that any servicing or repairs should be conducted at a certified mechanic repair shop. Failure to adhere to this requirement also leads to the warranty being voided. We understand the inconvenience this situation may have caused and are available to discuss any further details or concerns you might have. Please feel free to reach out to us for any clarification or assistance. In response to this complaint, we have undertaken the following action: We have proactively contacted our customer to discuss the situation in detail. During this conversation, we thoroughly reviewed the outcome and addressed any concerns related to the matter. Should additional information be required to fully address this matter, please do not hesitate to inform me. I am eager to cooperate fully and ensure that the issue is resolved to the satisfaction of all parties involved. Thank you for bringing this matter to my attention. We are dedicated to providing excellent service and maintaining the highest standards of business practice. We look forward to resolving this matter amicably. Sincerely, *********************** Sales manager of M ********** Auto Parts.

I am rejecting this response because: The owner *********************** (listed himself as mgr) and his brother **** who wrote the response are not being honest at all. The only truth to their whole response was that we called them on 11/4/23 to report the defective engine. They are aware of selling us a defective engine and have no plan of making this right. Within their response basically say you cannot test drive the engine once installed or the warranty is VOID. Then they try to dictate where and how and by whom an engine is installed, or the warranty is VOID. The invoice provided has "90 day warranty" only. No details as to what they claim voids it. They are evading the truth to blatantly robbed us. Please post my full response to their reply to you. I want consumers to know what they are up against with this deceitful business.

      Sincerely,

      *************************

I have responded to the company responses (My response is written in Red between their response). They are not being truthful about this situation. They know they sold us a bad engine and do not want to take ownership of it. M&K say they operate under the highest business standards however, they are not trustworthy when given an opportunity to make right, they evaded the whole process of doing honest business in *******. If allowed to stay in business someone else will reap this same behavior out of them. I see they were already reported here for the exact same situation. We are not opposed to seeking further action if necessary. **Please post my attached responses. Thank you kindly.

We have been truthful in the matter this particular engine was running when we had it in our truck and it was running in the customers truck.  We sell a lot of parts so you cant look at 1 or 2 instances and say this represents who we are as a company every company gets good reviews and bad reviews its a used auto parts industry we are dealing with and we test our items before they are sent out.  We tried to go over all protocal with the customer and things are not adding up based on what we backtracked on our end but you are saying we are not being truthful.  If we got actual admission of the truth from start to finish this probably would of been handled differently so it gave us no choice but stand on ground the customers story changed at least 3 or 4 times of what actually happened from when the mechanic touched it to when the customer drove the vehicle.  At this point I am willing to come to some sort of compromise but I dont think we sold a bad item the engine was compromised by the customer at some point of when the vehicle was driven engine warranties have a lot of guidelines that need to be followed in order for the warranty to be executed into place.  Businesses have to have some sort of protection as well from non certified mechanics installing items as well as customers compromising the parts that have been sold to them as well.  Thank you.

Purchased a 5.9 Cummins engine from them for $3700 (June 2023) and my old engine as a core. Was replacing seals and oil pan (which had a hole in it, they claimed it happened during removal). Large metal chunks and significant rod bearing damage was found in an engine they claimed to run and be free of mechanical is***. I did not want a different engine from them, since they claimed this engine was good when it wasnt. I wanted my money back. They breached their contract by selling a faulty engine as functional, and then refused to refund money and were threatening. I showed up on their property with the engine, which they reluctantly took after charging me a $500 restock fee which means they will sell this engine to somebody else. Messages attached are from owner. I would *** him if I had the time but I need my truck on the road. This has already cost me $500 dollars in fuel, $300 in new seals for the engine, and $500 for their restock fee.

Our policy for the warranty to be implimented requires the customer to have the engine installed by a certifed diesel mechanic.  The engine was pulled from a running truck that was purchased from a auction from a insurance company that was labeled as running truck on top of testing the engine here as well when it reaches our facility.  We still honored by giving you a refund which we didnt have to under these circumstances based on what is written on the warranty.  When the engine is just brought back un installed we have to charge a restocking fee cause we have time as well as a business most other salvage yards would give you a in store credit only.  The customer was very rude on the phone as well that he never mentioned either.  He still got refunded his money just minus restocking on a item that was never even tested on his end but was tested by a insurance auction and our facility if failure occurs thats why warranties are in place.  The cost of labor and fuel is not in our control when we sell items thats a customers responbility to understand the pros and cons of any situation since nothing is always perfect.  Thank you for your time.
