On November 10th we signed an agreement with AM Roofing to repair damage caused by Hurricane *** and provided a $2000 deposit. Prior to their starting any work we were advised by our ***************** that the roof would require replacement, not repair, to allow it to be insured. We advised AM Roofing immediately (November 21, 2022) to hold on the repair work, (which had not started) and to refund our deposit until we received insurance money for the replacement and received other bids for the work. No where ** their contract that we have copies of does it indicate deposits are not refundable yet they continue to refuse to refund our $2000. ** addition we never signed a contract with AM Roofing for the full roof replacement as the original contract was void due to insurance company requirements to fully replace the roof. We will shortly be filing a claim in Small Claims Court in the **************** to recover these funds plus all court costs associated with this filing. We want to warn others regarding the unethical and illegal practices of AM Roofing as they are a scam organization taking advantage of those in need.Business response

First Im sorry for not responding sooner. This might have no choice but to go to small claims. I hope I dont have to explain the legality of how contracts work. The laws are very clear. We are not in contract with the insurance company. We cannot make contracts and spend the money to get these jobs on guesswork. We do however work with our customers. The insurance company will normally provide the ************ more than what our company needs to replace a roof. We wouldnt have had any problems working with them on that. I dont have a reason why they wouldnt even consider working with us on that. The estimator made it clear that we are fully capable of doing roof replacements. When he first learned that they wanted to do a replacement, he made the suggestion that perhaps we could simply create a replacement contract, so that no money is wasted. He wouldve then run it by me for review. From the very beginning, we were waiting on a reasonable answer as to why they wouldnt agree to that. Is it possible that they signed with another company in exchange for a roof replacement? We dont know. There were no options, just ultimatums. Despite what people say, there is a lot of money invested in getting jobs. Sometimes more than the job itself. The job hasnt started because we havent been allowed to start. They are still the owners of the property. The repair contract doesnt give us permission to force ourselves on the property and do the repair.
Based on this line of reasoning, we would prefer it to be settled, possibly through the courts if need be. We really hope the Better Business Bureau understands this. We have a legal binding contract and we are not refusing to do the work. They are the owners of the property, not the insurance company. We really hope it can be resolved peacefully. We certainly do not want to counter any aggression.Customer response

I am rejecting this response because: AM Roofing does not appear to understand the sequence of events related to this complaint. They are also providing false information related to when they were ready to do the work. The only contract we signed with AM Roofing was to do a repair of our roof which is what their estimator recommended and we provided a $2,000 deposit for the repair. Within a few days we heard from our insurance company that the roof would have to be fully replaced (not repaired) and we advised AM Roofing to hold on the job and requested they provide a quote for full roof replacement. This notification by the insurance company voided the repair work contract (copies submitted with earlier correspondence). ** this conversation their estimator, *********************** advised that the material for the repair had not been received, so contrary to their statement they were not ready to do the work, also the work would have been for repair not replacement which was not an option. In addition nowhere in the contract we received does it indicate that deposits are not refundable. AM Roofing attempted to get us to sign a contract for the full roof replacement in order to get our deposit back. We refused to do this as we solicited other quotes that were lower than AM Roofing.In order to attempt to resolve this issue in a reasonable manner I sent *********************** an email on 02/06/23 (email thread attached) replaying to his email stating they had costs for restocking material that they needed to recover. I offered to cover these restocking costs and requested he send me invoices to substantiate the costs. They could then refund me the balance and we could put this issue behind **. I have heard nothing in response from AM Roofing.
This company seems to be comfortable committing Civil Theft, as they have taken our money, done no work, and refuse to refund our deposit. This is not something I like dealing with as we were flooded out by Hurricane *** and have had to rebuild our house at significant expense in time and money. AM Roofing is stealing from ** when we are already under financial strain and fighting with our insurance companies to get fairly reimbursed for our losses.
As I indicated in my correspondence with *********************** if AM Roofing can provide legitimate documentation of the costs they claim they expended on our voided contract we will accept that along with a refund of the balance of our deposit. If they refuse this or attempt to provide bogus documentation we will have no other choice but to pursue a legal remedy.
