      I went to buy a car the sold me the kia ******* 99 miles they had turn on the vehicle and we could notice the engine need to be replace we told them about the alignment of the car, and they said take the car and we could work on that on Monday I bought it on a Saturday. The next day we turn on the car and it felt like the engine was going to fall so we took the car back the same Sunday and left the keys in the key slot and on Monday we call them and told them we didn't want the car and they told us we need it to stay with the car I told them they can't obligate us to stay with the car I am not paying for a new engine and not going to be stranded somewhere just because you guys didn't fix the car.And we requested are deposit back ($2070.00) ***** the manager denied and told us that he won't be able to give us the deposit back so we call corporate and they told us that we need to speak to ************************* the General manager so went I call again ***** stated that he was the manager and that he didn't knew who ************************* was that there no one by that name working there went I told him that corporate told me to speak to him now he remember who ************************* was and say that he was going to pass him the message to call us back and this happen in 08/12/2023 now its 10/08/2023 and still no call.And up to this day they still trying to sell that car to some else, it's not fair that here in ******* there's been to many small dealers stilling money for person that need a car and live paycheck to paycheck and no one is doing anything about in BYRIDERS they act so nice so they could get you to buy damage vehicles and then they be on you to write good reviews. This need to stop $2070.00 stole in just a few hours went we need to work 2 weeks to get only part of that money I had to save 2 paychecks for then to take that money from me like nothing. DONT BUY CARS FROM HERE BETTER OFF BUYING A NEW CAR.Plus, they took my paperwork and shredded them they said I am sending a link the link never open we couldn't call because the close on Sunday. WORST MISTAKE I HAVE EVER DONE.

      In the case of *************************, Complaint Number: ********, we have investigated this matter with the full cooperation of the franchise-owned Byrider.  **************** is aggrieved by the mechanical difficulties he is experiencing with the vehicle.  
      **************** purchased a 2016 Kia ******* on August 12, 2023 from the franchise-owned Byrider location on *************** in ***************, *******.  The vehicle was covered by a 30-month, ****** mile warranty, whichever occurs first.  
      While we understand that dealing with any service issue may be frustrating, a pre-owned vehicle, like any other mechanical device with moving parts, will require routine maintenance and periodic repairs to ensure its continued use.
      **************** notified us that he felt the vehicle needed an alignment. We agreed to take care of this issue at no cost to ****************. He dropped the vehicle off on Sunday August 13th, and the work was completed on August 14th. 
      **************** at that time decided he did not wish to continue forward with his contract, believing that the engine would ultimately need to be replaced. There were no indications during the reconditioning process that this was correct. We informed him if the engine did need replacing he had purchased the vehicle warranty that would cover the costs of such a repair. He still insisted and as a courtesy to **************** offered him a mutual release which included that the down payment would not be refunded. He agreed to the terms, signed, and has since been released from his contractual obligations.

      I am rejecting this response because:

      On August 13th I did drop the vehicle and told them that the car needs it the alignment and a motor due to the noise it was making it was obvious that
      it needs a new motor. I never terminated the contract they did they never offer another vehicle nether they intended to replace the motor on the *** they were just trying to obligate me, to stay with the car as it was. There where indication that the motor needed to be replaced, and they knew that they told me to take the car and that they would replace the motor knowing me their intentions I refuse to take the car as it was. And then they told me that I would have to pay for the motor to be replace I told them I don't need to pay since the car is in warranty right and they keep on repeating that I need to take the car because they don't accept refund. I told them I understand that is a used car but if I was going to pay that much money for the car the least, they could do is replace the motor or offer another vehicle in wish they refuse. They did not offer any other solution they just told me they were terminating my contract and that I wasn't getting my deposit back. I call there corporation I told them everything that had happened and they told me they were supposed to give me the money back that if they don't to call them and ask for *********************** the general manager went I did  call them I spoke to ***** the office manager and told him that I need to speak to the *********************** and he stated that there no one by that name that he doesn't know any *********************** that he was the manager when I told him that I have call corporate then he knew who *********************** was and he told me that he would pass the message for him to call me back is not October 22nd and I haven't received any call I told them I could stay with the *** but went you replace the motor and they refuse. I didn't even get the proper paperwork from them they took my papers and shredded them saying that they are sending the link that never worked told them about it and they told me give it a few days and still don't work because I knew I need the paperwork for this. It's not fair that small dealers like this take advantage of people in need to get their commission like if we don't have to life paycheck to paycheck if not fair for us to buy cars trusting the Saler that the car is in good condition when they actually not taking advantage of people's needs to push a sale and take people money in less than a minute. They never told me that I needed to purchase an insurance to cover the motor because they told me that the warranty was already applied that they warranty that I had for the 30 months it was motor included from bumper to bumper. I insisted in not taking the vehicle because they weren't fixing it and we did not had a mutual agreement they just were very nasty to my wife and I went we were trying to solve the issues and they stated that there not giving us the deposit money and they going to stay with the *** as it is I did not agreed to any terms or nether did I sign a paper of termination I understand that If I terminate the contract I won't receive the deposit but I didn't terminated they did and they refuse to any other solution. They are taking advantage of us because they know we don't have proper paperwork to defend our self.

      **************** believes the vehicle had motor issues. We did inform him that his vehicle had a 30 month, ****** mile warranty that would cover if his motor needed to be replaced. **************** was not told that he would have to pay the cost of the repair. Upon inspection, an engine replacement was not warranted.  Unfortunately, **************** did not agree with the assessment and refused to accept any course of action other than an engine replacement. We offered to release **************** from his contractual obligation, which he agreed to. **************** signed a Mutual Release, which included that there would be no refund of his down payment.

      I am rejecting this response because: I knew the car need minor stuff they told me to bring it during the week, I told him I could wait because it was minor stuff but he kept insisted that we bring the car back during the week so that they could do whatever they were going to do so we took the car not knowing that was what they wanted so they could obligated us into staying with the car the next day like I said before as soon I turn on the car the motor was making knocking noise and the car was shaking it felt like it wanted to break as a tow driver I have seen same and heard the knocking noises that's when I learn that the motor is not good and is in need of serious repairs in the motor or replacement went we told them about the issues that we wanted to return the auto he stated that we took the vehicle out of the premises and they wouldn't be able to take the car back. No solution was given by the personal of the dealer I told them since they are obligating me to stay with the car, they would need to switch vehicles they decline and told me that the car had warranty and if the car breaks down that we could tow it to the facility I told then I wasn't going to risk my wife and son to be stranded with a vehicle that we need something to rely on to take us to work and back not something that is going to break at any giving moment no solution were giving they just keep repeating that they could take the car back. Now they stated with the deposit and the car. They are stating that I signed a mutual release but the paper I signed was with the bank. And the bank rep told me, and I quote if you don't sign the paper, we are going to keep charging you even if you don't have the car or even if they sell the car again you need to sign the paper and call the dealer so they could get you the deposit back. They pressure me into signing the paper taking advantage of our needs and that's not right. I have called several times to speak to the general manager ********************* and they keep saying the same thing I would deliver the message I have call corporate and they keep telling me that I need to speak to *********************** so I could get the money back. I still waiting for the call.

      I am rejecting this response because: They never try to help me like they claim to say they wouldn't help with the car issues or offer a different solution. They are trying to say that they have released me of the obligations with the vehicle and their corporate stated a different respond which the dealer been trying to avoid by keep repeating them self. I stated with the vehicle for less than 24 hours and just for that they trying to justify the fact that they are keeping the money. When they should be professionals this is not professional at all and for the record I am still waiting for the call of the general manager which the manager of the facility stated that he was giving it to him to call which corporate stated that I should get in touch with ********************* so I could receive my money back is not fair and nothing there doing justify the fact that they are basically robbing me ***** for a car that it was practically lemon. And this is not a professional environment that they claimed to be by supposedly help people when in fact there just taking hard working people' money (TAKING ADVANTAGE).

      We have contacted **************** and have come to an agreement to refund $500 as a one time courtesy. Byrider strives to achieve the satisfaction of every customer. We made more than reasonable attempts to accommodate **************** requests within the terms of his vehicle service contract which he declined. He has also been released from his contractual obligation. We consider this issue closed.
