      I purchased 2 Ragdoll kittens (DOB 05/25/2023) from Ms. Elena C*******, doing business in Florida as Adorable Stars, Adorablestars, Adorable Kittens and www.britishscottishkittens.com. The kittens had diarrhea when they were delivered to me on 07/30/2023, and were ultimately diagnosed with Feline Infectious Peritonitis (FIP) on 08/26/2023 and 08/29/2023, respectively. I submitted a claim to Ms. C******* today, 10/13/2023 pursuant to the terms of the Florida state statute 828.29 governing a consumer’s guarantee in connection with the purchase of a cat. Ms. C******* has denied my claim. Attached are: (a) a copy of my transmittal to Ms. C******* including a letter from my veterinarian, Dr. S**** of ********** ********** ****** (which includes supporting medical expenses); and (b) a complete and unedited chronology of all written communications (text and email) I have had with Ms. C*******. We never personally spoke. In support of my claim that the kittens were unfit for sale at the time of my purchase, please refer to ******* ************ ******* ** ********** ******** current program dedicated to “Studying the Genetics of Feline Infectious Peritonitis (FIP)”. As Cornell explains on its website (********************* FIP is a viral disease of cats caused by certain strains of a virus called the feline coronavirus. Once a cat develops clinical **** the disease is usually progressive and almost always fatal without therapy that has recently become available. Cornell explains that the most common mode of transmission is believed to occur when infected queens pass along the virus to their kittens, usually when the kittens are between five and eight weeks of age. Cats that are housed in high-density facilities (i.e., shelters and catteries) appear to be more susceptible to the development of ***, as are pure bred cats, male cats, and geriatric cats. Once exposed, the cat can develop **** and this can occur weeks, months or even years after initial exposure.

      Yes, this is slander. We read the veterinary document where the doctor wrote which reasons can cause ***. Nothing says about mother of these adorable kittens. In the first month the customer updated us stating the kittens are active, healthy, playful and eating "like horses". But there can unfortunate development that are outside of anyone's control. For this reason we are one from the few breeders, offer optional warranty against things of such nature. She has denied this warranty. Want to clarify her defamation about kitten mill. Our public information: inspections, photos, video tour, live stream, and no restriction to visits of the cattery show that our cats live in better conditions than even many people. Adequate customers understand and back to us! Welcome!

      Therfore.  We are glad to solve this issue.  We requested the required documents by Pet Lemon law.  But we still to this day haven't received them. For this reason we ask to notice that her complaint is not legally justified.

      Hello! 
      Update to our response:

      1. Her veterinary didn’t provide conclusion certifying that the kittens were unfit for sale at the moment of purchase, which is required by Pet Lemon Law section 5. Attached.
      2. Veterinary doesn’t have knowledge in giving legal advice about compensation.  Because Pet Lemons Laws are different from state to state.
      3. But the veterinary clearly and correctly explained the causes of ***. Attached.

      Yes, ***** ************* purchased 2 Ragdoll kittens on 7/4/23.
      Kittens flew off to her with a professional delivery nanny, absolutely healthy and happy.  See photo. The kittens just as all our other kittens have been to the vet for Florida State Health Certificates that confirm their health.  
      We create adorable kittens, but regarding health is under the vet's responsibilities.  Which under law also cannot guarantee anything -  only to the best of their knowledge.  

      From the first sentences, Susan already tried to write defamation.  We, for almost 10 years have our home breeding program.  And we know the Pet Lemon law very well which we strictly follow.

      When she requested money, we immediately responded and asked her to follow the Florida Pet Lemon Law procedures.  For this reason we sent her exactly what section concerns her and what documentation we need.  See Pet Lemon Law Section 5 attached.

      But she did not provide this and started to proceed with extortion and threats.

      In addition, want to note that she signed a waiver: "A consumer may sign a waiver relinquishing his or her right to return the dog or cat for congenital or hereditary disorders"  See Page 2 of the Agreement attached.  For this reason now her section that concerns her in the Pet Lemon law is section 6. Attached.  The waiver signed in the agreement. Attached.

      She received kittens on the 30th.  First mention of vet was on 3rd, which she said: "  Vet said kitten looks good ". Her text messages are attached.  So following the Pet Lemon Law Section 6, she has passed her 48 business hours.


       Discussing what infections can develop in kittens is the same as what infections can be found in veterinary clinics, human hospitals, etc. But for all this there are laws.  We invited Susan to follow the Pet lemon law just as we do.  But she became angry because she didn't find everything to satisfy her.  And for this reason she just wants to ruin our business with defamation.  

      There is nothing more to say.  Just can share that we have hundreds of happy customers, leaving 5 star reviews and return to us again for 2nd or 3rd kittens, and even their family's 8th kitten.  Attached google page. 
      Online you can see all our regular inspections, cattery tour, daily live stream.  Visitors are welcomed anytime or via FaceTime.  This all shows our openness and that our cats live even in better conditions than people.  So we confidently know that from our side we did maximum to what we can do to provide healthy and happy kittens.
      And want to repeat that we very strictly follow Pet Lemon law.
      By the way, unlike other breeders, we do offer an optional 2 year warranty on anything of such nature that is outside of anyone's control such as cancer, **** heart disease.  Things that cannot be tested early, vaccinated against, etc.   ***** ** declined this warranty.  Signed Agreement attached.  

      Therefore, Susan hopes to receive large sums of money while absolutely not wanting to follow the requirements of the Pet Lemon law.  
      1.  She didn't provide the conclusion from a licensed veterinarian   certifying that, at the time of the sale, the animal was unfit for purchase due to illness or disease.  Pet Lemon Law Section 5.  
      2. She missed her 48 business hours to visit the vet and confirm health.  Pet Lemon Law Section 6.  
      3.  Her first vet visit for the kittens was good: "  Vet said kitten looks good   "
      4.  Denied the optional extra warranty that includes against ***. 



      For this reason her demands for money don't match with law and shall not be fulfilled.  
      But her lies and defamation are provable and should be punished for.

      I am rejecting this response because:

      I am not satisfied with the response from C*******.  She does not acknowledge or respond to any of the issues in my complaint, but, rather, continues to talk in rhetoric.  

      1.  I am seeking reimbursement of my vet bills pursuant to Section 828.298.3(b)(5) of the statute.  My vet certified in writing within one year of the sale that they were unfit for purchase.  C******* keeps insisting that the kittens were healthy at the moment she put them on the plane to me, which is not the issue.  
      2.  C******* has never responded to my inquiry about why my Sales Contract states that the kittens were born on June 5, 2023, yet the Official Certificate of Veterinary Inspection states a date of birth of May 25, 2023.  Obviously, C******* misrepresented the age of the kittens when they were seen by the vet.  It should be noted that the kittens were under the age of 8 weeks when they were shipped to me, which is in violation of the Florida statute. 
      3.  C******* has a history of defrauding customers by selling sick cats and not abiding by Florida laws.  There are several complaints currently in the Florida court system - and they indicate that Florida Department of Agriculture and Consumer Services has knowledge of these past illegal practices.  I am surprised that she is allowed to continue to conduct business in a state that has some of the most protective pet lemon laws in the nation.  
      4.  The Florida State Attorney General has given me several suggestions on how to resolve this matter, one of which was to involve your agency.

      On 12/27/22 I contacted this co about a FULL BREED British Short hair that was listed on their website **************************************/. They introduced me to kitten that was described as British Short Hair. I had agreed to make a $400 deposit on 1/12/23. On 1/17/23 I asked if I am getting a British Shorthair; she replied "yes & has siblings that are Scottish fold & British Shorthair". On 1/18/23 I texted a copy of the signed contract. I really wanted to see the pictures of Mom/Dad. She eventually sent them over. ONE was a SCOTTISH FOLD & OTHER was BRITISH SHORTHAIR. This is not a full breed British shorthair cat. I questioned this & she immediately changed her story that it's always been mixed breed. I was very clear from the beginning that I only wanted to pay for a FULL BRITISH SHORTHAIR. She stated "By TICA, if I was to register her she would be called a British Shorthair". Any kittens who have 1 Scottish parent cannot be registered as British according to ******************* At the beginning I was very clear on what I wanted. I told her I no longer want the cat. She agreed to give the deposit back but then changed her mind and becamse defensive & refused to give me my deposit stating I was not entitled to that. I said "please & thank you" many times & she stated "please" isnt a good reason & that her accountant needed valid reason for refund. I replied the cat is not what was advertised. She said no refunds allowed on her website. It's not stated in contract about non-refundable deposit. She wants to keep the CAT & the DEPOSIT which is a breach of contact. I did research here on BBB & there are complaints about this very same issue. This seems to be common practice of this cattery. Advertising a British Pure Bred cat but sell a mixed breed. She stopped replying; she put the cat back onto her site with a higher price. We still have an active contract & she has deposit; how can she relist the CAT? All I want is my $400 deposit back

      This complaint is the same as complaining about some law.  
      On our website, each post's description and example of the contract states that the deposit is non-refundable.  This is not news.  This common practice for deposits to not be refundable.
      Customer knew everything completely clearly.  We responded swiftly to all questions.  Not like she said : "finally answered". Can prove.
      Of course I guess everywhere the deposit is refundable if the seller is at fault and or cannot provide the product.   We have same rules.  But our deposit policy is even more generous..  Deposit is not lost and can be used anytime later and be transferred to different kittens.  Even can be transferred to different people from the original client. 
      Same time, we have British Shorthair kittens where both parents are British Shorthair which the client could have chosen from. 
      We were ready to return deposit with presentation on the reason what was our violation.  But they couldn't provide that.  
      About Scottish - British breeding.  This is allowed and is the standard.  We know this.  But asked TICA again to be sure on how to classify kittens from those litters.  Their response you can see in attachment.  Kittens with dominant traits of a British Shorthair can be called and registered as British Shorthair with parents being both Scottish Fold and British Shorthair.  Such an example of the registration we have provided to the client.  
      Therefore, we don't have any secrets or violations.  With us especially, the deposit is not lost completely by client if they change their mind.   Again she reserved a good quality british shorthair kitten as you can see in photo. 
      Even she doesn't come our buyer, she has received the agreement and signed it.  This part she violated :   "The parties agree the that terms of this contract are confidential between the parties and their legal counsel.  Consequently, the posting of public views, critiques, and comments disparaging of either party is prohibited breaking this term will result in a penalty..."   Because as we can see her accusations don't have prove of our violation.

      Purchased a kitten from them on June 6th, 2022. On the night of June 28th our kitten started acting really strange and was swaying back and forth we immediately rushed her to the emergency vet. While in the car ride she was seizing and eyes were dilating and darting back and forth we thought that she had passed away. Upon arrival they immediately took her our of my arms and started emergency IV meds. Upon further examination they found a parasite along with congenital issues. She stayed in the animal hospital for 5 nights and unfortunately passed away on the evening of July 3rd. We have tried to reach out to the breeders to no avail and they have not assisted in anyway or shown any compassion. Their words were "she was doing so well" and "such pity". We have waited and waited on them to respond and have submitted all documentation from the vets. They state that they are waiting to hear back from their vet and lawyers determination of the the documents we submitted. When we asked for an update we got nothing and no response. Not once did they try to help us or show any sympathy. They are solely in this to make money off of these kittens that they sell, we believe they are cat brokers as they state they have new litters every month. Once they're sold it's on to the next cat, they do not care about anything but money. They have not offered any help in this situation and are not abiding by the Florida pet lemon law even after multiple attempts to reach out to them.

      Business Response /* (1000, 5, 2022/08/17) */ 1) We never violate the Florida Pet Lemon Law! Each kittens just as theirs has been to the vet for their Florida Health Certificates. We in fact provide the Pet Lemon Law attach with every purchase agreement which is visible on our website. They signed the agreement where it state the kitten needs to be taken to the vet within 48 hours to confirm the health of the kitten. The Pet Lemon Law also mentions that any health issues can be looked into within 2 weeks of purchase. They never been the vet prior. 2). They elected to euthanized her. 3) Yes, we have new litters each month. For this business we use all our house (5500sqft). We are doing this full time! More details such as daily live stream, cattery tour, photos, and videos you may see on our website and socials. Also presented documents such as genetic tests, and facility inspections with great results. We are not a broker! 4) We have many kittens going to new homes. We are very busy. But anyway we always happy to know how our kittens is adjusting and growing in new homes. Requirement to update us daily on the kitten for the first 2 weeks is stated in the agreement, which this buyer didn't follow fully. We received answer to our questions for update on the kitten, and see that kitten was healthy and happy in the first weeks! 5) After our last request update on the kitten, they went quite for 9 days! And answered only with upsetting news. We were very worried for the kitten. Of course, we don't agree with the decision to euthanize. 6) Next we started process of refund. By Pet Lemon law there needs to be a veterinary conclusion that the issue was present at the moment purchase which is needed for our accountant. In their vet documents everything is good and found only one positive result for Giardia. (Their vet document attached) Giardia is a common feline parasite that normally doesn't show any clinical symptoms and is not so dangerous (attached info). For 3 weeks after moved to new home, giardia could have became caught at any moment. So for compensation by Pet Lemon law needs a veterinary conclusion that confirms that whatever it was such as Giardia was present at the moment of purchase. 7) We multiple times request for the buyer to present us the exact documents with veterinary's conclusion was required in Pet Lemon law. They promised to do, but nothing came in so far. 8) By the way the Pet Lemon law states: "A veterinary finding of intestinal or external parasites is not grounds for declaring a dog or cat unfit for sale unless the animal is clinically ill because of that condition." Florida Pet Lemon Law 828.29 Section 9. Therefore, this buyer (Attached Photo) wrote many untrue information. Our company strictly follows the FL Pet Lemon Law. Buyer did not follow the Pet lemon law and has violated the signed agreement: "The parties agree the that terms of this contract are confidential between the parties and their legal counsel. Consequently, the posting of public views, critiques, and comments disparaging of either party is prohibited..." Which could lead to legal actions. Consumer Response /* (3000, 7, 2022/08/28) */ (The consumer indicated he/she DID NOT accept the response from the business.) After multiple documents have been given and after the vet even states our kitten had a parasite AND an underlying congenital condition they still are dismissive of this and said basically too bad so sad and will not provide anything. They are now threatening us by stating "be careful" with what we submitted to the BBB. The fact is we bought a kitten from them that had parasites and underlying congenital issues that attributed to her illness and death and is clearly stated in our documents and yet they will not do anything to help. We repeat: our company strictly follow Pet Lemon Law; They did not provide required documents to move foward with potential refund/compensation. If they have documents with veterinary conclusion that the kitten was unfit for sale at the day of purchase, please have them attach it to this complaint. If buyer doesn't do this, then all that we said, is true. And everything buyer say has no proof. What must we do in this situation? Just waiting on the required veterinary conclusion. Submitted all documents they are clearly disregarding and dismissing what the vet has to say and are not accepting the vets conclusion.
