      I purchased a new home from *******. Orientation was March 20th. A long list of items that still had not been repaired were made. 90% of these items had not been fixed by closing day. It is now April 19th and about 30% of the items have still not been fixed. I am almost 30 days past closing and according to my contract all repairs should be done by 30 days after closing. I have sent them NUMEROUS emails requesting help from anyone at all to get my new home repaired but this is not working. It's not a big deal to them because they do not care if they get the work done. They already have their money. I had to close or I would have been in breech of my contract. There are no consequences for them.

      We are diligently working to resolve ***************** complaints.  We have been in constant communication with her via emails from our on-site Builders and ************* department.  Many circumstances are out of our control and we will continue to provide resolution to the issues.

      November 2021 the first home walk through for walk through to fix problem while they building. Only small would and electricity work was done, all other issue was told to be put on the 11 months walk through by ***************************** by one of the company ******* employee. When that came checklist ***************************** came in wrote it down promise two week and nothing happen. No call no show, after me since email, texting certifed mail and calling since September 2021. ******* code, 43-41-7 SECOND time. Now this company avoid everyone call at The Collection at The East Lake of ***** *****************************************. The *** is trying to hire lawyer to dealing with this company and the 4 unsold Townhome.

      As a resident of the Villas of ******************* in *********, **, I am deeply concerned about the lack of choice when it comes to selecting an ******** Service Provider (***) for our community. I believe that every homeowner should have the right to choose their *** freely, without any interference or restrictions imposed by ******* Builder. ******* Builder signed an exclusive marketing agreement with ***** Other *** require a community entry agreement to be signed by *******; they have refused to sign any other *** agreements. The right to choose one's *** is not just a matter of convenience; it is a fundamental consumer right that ensures fair access to competitive prices and quality services. By allowing homeowners to select their preferred brand or provider, we can ****** healthy competition and encourage ***s to offer better services at reasonable prices.Currently, ******* Builder and **** are forcing homeowners in our community to purchase internet services exclusively from ***** 8.1 With respect to those **** Services indicated as exclusively marketed in Exhibit A, Developer will not directly market or sell any services on the Property, or allow any other party to directly market any services on the Property that compete with such **** services. This practice not only limits our options but also denies us the opportunity to explore other ***s that *** better suit our needs and preferences.By granting us the freedom to choose our own ***, we can benefit from improved customer service, faster internet speeds, and potentially lower costs. Competition among different providers will drive innovation and ensure that residents receive top-quality services at affordable rates. ******* and the HOA/management company need to sign agreements with other *** to be in the community (behind a gate and on private property). **** should not be allowed to contractually restrict owners from selecting the *** of their choosing.

      This is a dispute with AT&T and ******* not with ******* Properties.  Please see attached response provided to the customer on 9/12/2023.  AT&T will allow ******* to provide service to residents of this community.  It is up to ******* to decide to run this utility into the community.

      Thanks for reaching out to AT&***************** said the same thing I did. Nothing is stopping ******* from coming into the community except they are requesting the developer to sign an agreement.

      If the request is to have ******* in the community, Ive already said it is fine for them to come into the community. This is the same thing AT&T said. The road has Right of Way along each side for utilities.However, if they are request that the developer signs an agreement to come into the community, them the developer will have to get AT&T blessing to sign that due to the exclusive contract.

      Im going to reiterate that ODwyer Properties has nothing to do with the internet provider and no control over them. As I mentioned AT&T was the only option available to the developer at the time the community started. This is the same with Gas and electric services.

      So I guess this is back in *******s hands to figure out why they wont come into the community and what they are requesting to allow them into the community.

      How might we move forward with ******* agreeing  to sign entry agreements with any other ISP? I have cc'd ATT's Office of the President for additional context if needed.  

      In addition, 63% of the current owners have signed the petition to Ensure Homeowners in Villas of ******* Lake Have the Right to Choose Their ISP. I have turned the petition over to the FCC,BBB, FOX News on your side and WSB-TV.

      I am rejecting this response because: The build has not contacted ATT to ensure they have permission to sign an access agreement with other ISPs. ATT has stated to me that this is not a problem for them, and it does not violate the marketing agreement with ATT.

      This is the final response to this issue.  The complaint should be resolved with the Developer, AT&T, and *******.  As the Builder (******* Properties) we cannot contact AT&T as the customer wishes.  ******* ******************** does not prohibit **************** Providers from providing service to residents.  The customer should continue speaking with ******* and the Developer to resolve the issue.  Multiple attempts were made to contact the customer via phone and email and ******* ******************** received no response.
