They're took my money over 10 months now, but never pulled an permit for me build a garage yet. Over $13,800 now I want my money back.I called and emailed so many times No One return to me. Do I need my lawyer? To got my money back. Thank youBusiness response

As we have been telling the customer for months now, to no avail, his initial deposit check of $9,838.35 was returned to ** by the bank on 3/17/2022 (Please see attached bank statement), and we have been unsuccessful in collecting it from him since. If he would check his bank account, he will see that it was never debited, so he still has those funds, not us. He also paid additional fees for engineering that was completed, and therefore those fees are non-refundable. Regarding the building permit, he initially had us pull it for him, but he did not supply us with the correct information needed by the building department and decided later to pull the permit himself.
This is a confused customer who is refusing to produce any evidence that the check cleared his account. We have been very patient in dealing with him and in attempting to rectify the situation, but he has not been cooperative at all. Were not sure where hes getting the $13,800 from,but its incorrect. He has refused to pay the deposit owed and has since cancelled his order. The customers claim is not valid, and while we have the legal right to send this bad check out for collections through an attorney to collect the funds we are owed according to the contract he signed with us,the customer is fortunate in that we have decided not to pursue it at this time. In any case, even if we did collect the funds, as per the contract terms,the deposit would be non-refundable.

On January 31st I signed a contract for a steel building and wrote a check for the required deposit. I was told that it would take about a month to get the engineering drawings in order to get the permits. At the end of February, beginning of March I reached out to my account manager, *************************** by email asking about the status of the building. I was told that she would ask the project manager. I did not get a response. I waited about a week and requested information again. Again I was told that she would reach out to the project manager, but received no other response. This back and forth continued until about March 22nd when ***** called me, and said that my price matching has been rejected, due to the insulation that I was paying extra for on top of the cost of the building as well as the high impact windows that are required by code. She asked if I would like for her to send me another quote, I said yes, and received nothing. The next day I sent an email stating that the contract states that we agreed upon the price and that I would like to have a schedule. ***** responded that the schedule was in the original email, which said 4 to 6 weeks for drawings, we were going on week nine. I waited about a week, heard nothing, and called the head office in Georgia. I spoke to ******, he said he was the general manager, and that he would look into it and get back to me. I waited another week, and heard nothing back from them. I called the head office again and was sent to Javiers piece mail, then 30 minutes later ***** called me to tell me that the doors, windows, and trim items were more expensive. She then sent me an e-mail with these items listed. I emailed back asking for the cost of the building. I did not get a response until four days later when she asked me if I would like a new quote for the building. All I want is to get a building built in a timely manner for a fair price and I feel that I am just being strung along.Business response

We apologize that where was a delay in processing this customers order as there was some miscommunication. We have since spoken to him and are worked everything out to his satisfaction.Customer response

On 6/11/21 I signed a contract with Eversafe Buildings for a shop structure and paid a deposit of $3235.05. At the time this business showed accreditation and good ratings through your bureau. On 10/17/21 I received a contract cancelation from Eversafe Buildings, which I did sign and return to them immediately. I have been in contact with them multiple times regarding the return of my deposit and I have not received it as of today 10/25/21. Any assistance you can provide would be greatly appreciated, thank you.Business response

Business Response /* (1000, 5, 2021/10/30) */ Order not placed. Check to customer failed to deliver. A new check was issued immediately and sent out overnight to customer with tracking. Consumer Response /* (2000, 7, 2021/11/02) */ (The consumer indicated he/she ACCEPTED the response from the business.) Business responded immediately and overnighted a check for the total sum. The check has cleared in my account so no further action is needed. Thank you much for the assistance.
