I have a 2021 ********* *** series pontoon that has holes due to bad/defective welds in all three pontoons which are either a manufacturing defect or a design flaw. Per the Engineer's report: The subject vessel was inspected at ***** ******* ** * Boat Storage ***** ** *** *** ********* *** on *** *** 2023. At the time of the inspection, the subject vessel was equipped with a 2020 150 HP ****** ******** outboard engine and a 3-bladed 16” pitch propeller. In general, the vessel was in good condition with signs of general wear and tear and “dock rash” which would be expected with a rental boat having 453.0 hrs on the boat engine hour meter. As described in more detail and supported by specific examples in the following sections, it is my opinion that the damage observed on all three pontoons was caused or contributed to by the design and/or production of the subject vessel. In general, many widely distributed cracks and failures were found in the welds and/or emanating from one of the welds into the lifting strakes and/or into the pontoon body. More specifically, given the widely distributed cracks and complete weld failures observed on all three pontoons (all four lifting strakes) and the absence of any clear evidence of impacts at the crack/failure locations, it is unlikely that these cracks and weld failures were caused by or associated with one or more impacts with underwater objects. Given that the usage and detailed history of the vessel are unknown, it is not possible to rule out the possibility that an impact with some underwater object may have caused or contributed to any specific component of the physical damage.
