Entered by BBB staff LO Consumer states they wanted to sell their home so they reached out to the business. A contractor came out on 7/24/24. After the contractor left the consumer received a call saying the contractor was at the door. The consumer told them that their contractor was there and left already. They told her they did not send the first ****** who came to her home. The consumer did not want to let the second contractor in and asked that any agreements be canceled and the business threatened to put a lean on her home and sue her.Business response

As a business that's been in existence for almost a decade, miscommunications happen. It's never in our position to point fingers or allot blame. We understand life happens and ******'s realities change overnight. If the customer wishes to not move forward with their originally intended sale, that is a conversation that can be mutually and respectfully had between parties involved.
I'm here to listen to and catalyze a mutually amicable resolution. What's not going to happen is one party using scare or bully tactics.

We caught the company in several lies to both ** and the people they represented as their business partners but were in fact not. We requested termination and they agreed via text. When we requested a release via email they ignored us for a week then sent an email stating were still in contract. They also lied about sending random people to the house and we have it recorded on ring video so we showing up saying the owner ******* sent him. These people are not honest and we want a release via email sent and no further contact.Business response

I run a real estate organization that sources off market properties. The seller who made the complaint was in a binding enforceable contract with my company and decided after signing the contract they either wanted more money for their house or suddenly didn't "trust" us. I recall getting on a call with the clients to try to explain the possible misunderstanding but was barely allowed to speak as the gentleman constantly interrupted and spoke over me. The seller resorted to name calling and issuing threats, all to the aim of wanting to bully my company out of the signed agreement. I understand people change their minds and life happens and clients might seek a different option contrary to what was signed and agreed to, however what I do not subscribe to is wrongly accusing me or my team falsely. I do not conduct unethical business and as such will not be bullied by a greedy client. We have long encouraged them to pursue litigation if they so wished. Every action taken with this client was according to the governing laws of the state. The prospective party the client chose to want to sell the property to called me to offer stipends for me to walk away from the deal I already had a binding contract on. In my quest for a resolve, I reassured the client I will terminate the agreement with them on the basis I'm able to work out favorable terms with the party they decided to sell the house to. Unfortunately, a favorable agreement was never reached. Per the contract, the seller is bound to cooperate up until the closing table, their failure to do so implies they are in severe breach of contract.Customer response

I am rejecting this response because: the owner of the company is lying; he agreed to terminate the contract and there were no conditions (see his text in attachment); contract was not legal and binding because he was in violation of *********** Broker and ***** Business Code #*****, practicing real estate in ********** without a license, and used a contract not enforceable in **********. We have reported him to the *** and to our local DA for prosecution.We sold the house to a different company for the same price, so his assertions are absurd. He specifically told the buyer not to tell us the truth. At this point we asked him to terminate, which he agreed to with no conditions. After his separate negotiations with buyer fell thru he began harassing us. At this point I spoke to an attorney and found out he is in violation of the above referenced ***** code, so I reported him to the *** and DAs office.
NO further action is needed by the BBB. It is now a criminal matter for the district attorney to pursue.
