I was contacted by a guy named ******************* who claimed to be from Allied Business Solutions. He stated that he had a buyer interested in buying my timeshare. After signing a contract I was told I would need to pay $4600 for a tax ID number in ******. Thats when I thought this doesnt sound right and might be a scam.. Now I need help because they are threatening to charge me a huge cancellation fee of upwards of $8000.Initial Complaint

In April of 2021 I received a phone call from Allied Business Solution with an offer to buy our El CID time share. El CID property is located in ******, ******. After several follow up phone calls from Allied Business Solutions a price for the transfer of the time share was agreed upon and a contract was signed and delivered via email. I was assured that all monies will be handled by ********************************** which is based in *****************. The final negotiated price for the time share was for $62,300.00. Allied Business Solutions was to receive 5% of total purchase price. The primary negotiation for the sale of the time share was with an agent for Allied Business Solutions, *******************************. On May 26, 2021 a Guaranteed Escrow Purchase Contract (#*****/55) was signed and initialed by all concerned parties, including the Buyer, ********, ******* Beltrones, the President of ************************************, ***************************, and the *** of Allied Business Solutions, *************************. By May 28, all the paperwork was completed and closing date was set to be July 16, 2021. On June 7, 2021, ******************************* forwarded me an email from ************************* of ********************************** that the ****************** is claiming that in order for the transaction to close, there is a Closing and Administration fee must be paid by the registered foreigner. ****************** stated that I needed to wire $4600.00 to a bank in ****** for the sale to proceed. ******************************* of Allied Business Solutions stated that my money would not be at risk because all funds would be held in escrow by ************************************ until the sale was completed. Initially I was not willing to do this but ****************** assured me that the money will be covered in escrow by her company. ****************** arranged to give me access to the escrow account to ********************************** with a user name and special password so I can view the escrow account. The client had signed a contract which clearly states the length of contract, which is 6 months. The contract has expired.
The client was informed that there is a cancellation process, with a penalty for cancelling, he refused to pay, so the company could not continue with the process.
Also cancellation must be accepted by all parties involved, the buyer refused to accept the cancellation.
The client refused to work with the company to get the cancellation process completed.
The client violated the privacy clause by posting in a public forum, name of buyer and or the company and its agents.
Now the client has decided to complain to the BBB 1 year and 3 months after the fact.The client did not follow processes and procedures of the contract, as did the other parties,(the buyer and the company), in the contract, who did fully comply.
The client signed a legal binding contract and refused to adhere to it. How can the buyer and the company be expected to follow the contract, but the client no?
The company always advises our clients to review the contract with their attorney before signing.Customer response

I am rejecting this response because: I have all the necessary documentation to support the claim that the contract was cancelled within the contract deadlines. I have supplied this documentation to the BBB and asked them to forward it to the business for review. Allied Business Solutions was the agent for the buyer and failed to perform its due diligence to safeguard funds. Allied Business Solutionos was my primary contract and should be held liable for my loss.As I said before the proof is in the documentation and Allied Business Solutions should not be able to wash its hands of this contract. They should do the right thing and give me my $4600.00 back. I am not asking for anything more nor will I accept anything less.

Mr ****** you read and signed the contract.It states if any party cancels the contract,
they are required to pay a cancellation fee, you refused to pay this.Also it states that all parties must accept the cancellation,
the buyer did not accept. Please review the contract that you signed.You can not sign a contract then decide you do not want to follow
the stipulations in them because you do not like them, you agreed to all the terms when you signed the contract.Customer response

I am rejecting this response because: I contacted your company representatives when I filed for the cancellation. Everyone I talked to in Allied Business Solutions said I was entitled to a refund and that I must wait until Allied Business Solutions received the money back from the buyer in ******. One of your own company officers admitted that process of fulfilling the contract had irregularities and he was concerned a possible fraud on the Buyer's part may have been committed. Your officer was s the one who strongly recommended that I cancel the contract and I would receive a full reimbursement within two weeks of the cancellation. No mention of a cancellation fee was made and so I never refused to pay a cancellation fee. The documentation that I received from Allied Business Solutions that I supplied you through the BBB does not demand I pay a cancellation fee. It also should be aware that a representative of Allied Business Solutions who responded to one of my many phone calls stated that the contract can move forward only if I paid another $3800.00 in addition to the $4600.00 that was wired to the buyer. Why would I give Allied business Solutions another $3800.00 after I cancelled the contract.My question is, did Allied Business Solutions ever get my money back from the buyer? Another question is, did Allied Business Solutions verify that the Buyer was legitimate or was this another case of fraud? If it was fraud your company should admit their mistake and reimburse me.
As I said in my previous correspondence Allied Business Solutions failed to guarantee my funds as per the contract. No matter how you try to change the history of what transpired Allied Business Solutions was an agent for the Buyer. I abided by the contract and your company failed to safeguard my money and now you want to penalize me while your company walks away without penalty.
I am requesting my $4600.00 back.

I am rejecting this response because: I have reviewed the contract again to determine the amount of the cancellation fee. There is no mention of a cancellation fee within the contract that I can find. Please send me the document that determines how much I must pay for a cancellation fee.Under the Guaranteed Escrow Purchase - Contract #*****/55, which was created on May 26. ************************************************ the contract, on June 26,2021, I sent the Cancellation Notice by certified mail and by email to *****************
Maybe we can reach a settlement if the only thing in question is a cancellation fee that you are making a reference to. If this fee is reasonable and meets my approval it can be deducted from the $4600.00 in question. I am not willing to send any additional money to your organization. Any agreement must be in writing.

In the next paragraph, part 12, under the part you are stating about misrepresentation, it clearly states the amount of the cancelation fee. The cancelation must be paid first before we can start the cancelation process, after the process has been completed, you will receive a refund in full. I am rejecting this response because: On 10-25-2022 I called Allied Business and left a message with ****************** to call us back at ************. As of today we have received no callback. I have attached a Georgia Consumer Alert issued by the ************************** of Georgias Attorney General's office. It is closely indicative of what we were subjected to.Allied Business called us on our home phone, made the offer to broker our timeshare at **************, ******. We signed the contract with Allied with a money back and no risk guarantee. Allied sent us the Escrow Contract and we signed it assuming we would be covered under the contract we signed with Allied. After Wiring $4600.00 Allied asked for another $3800.00. We became suspicious at this point and promptly sent a notice by certified mail and email to cancel the contract. For over a year ****************** of Allied Business repeatedly told us our money will be returned when the Buyer and the ****************** returns it.
We contacted the ************** and the representative stated that since we cancelled the contract and based on the Escrow Contract we would have to pay them $12000.00 to get our $4600.00 back. ******************************* (I don't know if this is his real name), of the *************** was in my opinion, was argumentative and verbally abusive and at the end of the conversation he stated if I posted anything of the Internet, including the BBB complaint, his company would file a lawsuit, get a warrant for my arrest and the sheriff's department would haul us off to jail.
It should be noted that the El CID timeshare Attorneys related to us that since this is a timeshare that accumulates points there is no actual real estate that needed to change hands. The ****************** should not be an issue and they confirmed that we were fully paid up on our EL CID fees.
******************, I am requesting once again that Allied Business do the right thing and return our $4600.00.
